(« cerf ») "department" means the department of government over which the minister presides and through which the Act is administered; (« ministère ») "director" means the person in the department with the title "Director of Wildlife Branch"; (« directeur ») "farm produce" means (a) a crop that is standing in the field in which it was planted, (b) a crop that has been mowed, swathed, baled, stooked or piled, and (c) a crop that has been harvested and stored in any type of container; (« produit agricole ») "game bird refuge" means a game bird refuge designated by regulation under the Act; (« réserve de gibier à plume ») "game hunting area" means a game hunting area designated by regulation under the Act; (« zone de chasse au gibier ») "hunting year" means the period beginning on April 1 and ending March 31; (« année de chasse ») "migratory game bird" means a migratory game bird as defined in the Migratory Birds Convention Act, 1994 (Canada); (« oiseau migrateur considéré comme gibier ») "muzzleloader" or "muzzleloading firearm" means a firearm in which the propellant powder, the patch and the projectile can only be loaded from the muzzle; (« arme à feu à chargement par la bouche ») "provincial road" means a provincial road as defined in The Transportation Infrastructure Act ; (« route provinciale secondaire ») "provincial trunk highway" means a provincial trunk highway as defined in The Transportation Infrastructure Act ; (« route provinciale à grande circulation ») "scent" means a natural or manmade substance that is intended to lure or attract wildlife by smell, but does not include any substance that is designed or intended to be ingested by wildlife; (« substance odorante ») "tree stand" means (a) a platform or structure placed in a tree, or (b) any other elevated structure, from which a person may observe or shoot wildlife, and includes all posts, poles and ladders and any other materials used as part of the stand; (« plateforme d'affût ») "upland game bird" means a game bird listed in Division 3 of Schedule A to the Act but does not include a wild turkey or a migratory game bird protected in Canada under the Migratory Birds Convention Act, 1994 (Canada); (« gibier à plume sédentaire ») "vendor" means a person authorized in writing by the Minister to issue licences or permits under The Wildlife Act ; (« vendeur ») "wildlife management area" means a wildlife management area designated by regulation under the Act. (« zone de gestion de la faune ») M.R. 76/92; 167/92; 195/96; 153/98; 130/2001 ; 123/2002 ; 140/2003 ; 110/2005 ; 55/2007 ; 108/2012 ; 100/2013 ; 87/2017 ; 9/2019 ; 91/2022 PART II GENERAL HUNTING REQUIREMENTS Hunting or discharge of firearm from roads 2 No person shall (a) hunt from a provincial road or provincial trunk highway; (b) while hunting, discharge a bow or a firearm from a provincial road or provincial trunk highway or cause a projectile from a bow or firearm to pass along or across a provincial road or provincial trunk highway; or (c) while hunting, discharge a rifle requiring a centrefire cartridge, muzzleloading firearm or a shotgun using a single projectile from a public road within a municipality or local government district or cause a projectile from such a firearm to pass along or across a public road located within a municipality or local government district. M.R. 194/90; 196/90; 167/92; 153/98 Posting of signs to prohibit hunting on Crown lands 2.1(1) In this section, "forest harvested area" means an area from which timber has been removed as a result of a timber operation; (« zone de coupe ») "mine" means a mine as defined in The Mines and Minerals Act ; (« mine ») "resource road" means an existing or proposed access road or trail that is created to facilitate the management of a natural resource on Crown lands; (« chemin de desserte ») "timber operation" means a timber operation as defined in the Forest Use and Management Regulation under The Forest Act . (« exploitation forestière ») 2.1(2) The minister may cause signs to be posted on Crown lands prohibiting hunting, the discharge of a firearm or bow or the possession of a loaded firearm on or within 300 m of a resource road, timber operation, forest harvested area or mine that is located on Crown lands. 2.1(3) No person shall hunt, discharge a firearm or bow or possess a loaded firearm in contravention of a sign posted under subsection (2). M.R. 114/91; 165/97; 115/2025 Restricted discharge in game hunting area 38 2.2 No person shall discharge a firearm or bow while hunting migratory game birds or white-tailed deer in those portions of game hunting area 38 described in Plan Nos. 20245B and 20302 filed in the office of the Director of Surveys at Winnipeg . M.R. 140/2003 ; 149/2004 ; 110/2005 ; 93/2010 ; 30/2020 ; 91/2022 ; 16/2023 Hunting hours 3 No person shall hunt wildlife between 1/2 hour after sunset and 1/2 hour before sunrise of the following day. M.R. 355/88; 194/90; 113/95 3.1 [Repealed] M.R. 206/93; 165/97; 156/2000 ; 130/2001 ; 140/2003 ; 149/2004 ; 110/2005 ; 55/2007 ; 69/2008 ; 54/2009 ; 93/2010 ; 84/2023 Prohibited hunting areas 4(1) No person shall hunt or kill (a) an upland game bird, a wild turkey, a migratory game bird, or a big game animal in Riding Mountain National Park, Birds Hill Provincial Park, Beaudry Provincial Park, those portions of Pembina Valley Provincial Park set out in Plan No. 20106 filed in the office of the Director of Surveys at Winnipeg or that portion of the Park Creek drain located within the west half of Section 27, Township 13, Range 3 east; (b) a white-tailed deer in Whiteshell Game Bird Refuge, in Delta Game Bird Refuge or on Hecla Island; (c) a moose (i) on Hecla Island or Deer Island, (ii) in that portion of game hunting areas 2A, 4 or 7A shown on a plan filed in the Office of the Director of Surveys at Winnipeg as Plan No. 19580, or (iii) [repealed] M.R. 140/99; (d) a black bear, (i) within 100 m of a clearing around a garbage dump or nuisance ground, or (ii) [repealed] M.R. 76/92, (iii) on Hecla Island; (e) [repealed] M.R. 165/97; (f) except as provided in subsection (2), wildlife in those portions of game hunting area 5 identified as the Rocky Lake restricted hunting area on a plan filed in the office of the Director of Surveys as Plan No. 19541; (g) wildlife on lands reserved for Wapusk National Park as described in Plan 19701 filed in the office of the Director of Surveys at Winnipeg without first obtaining written authority from the park superintendent; or (h) in game hunting area 38, (i) an upland game bird, a wild turkey or a big game animal. However, a Manitoba resident may hunt and kill a white-tailed deer on privately owned land in the Rural Municipality of Macdonald under the authority of a general white-tailed deer licence, a second white-tailed deer licence, a third white-tailed deer licence or a white-tailed deer and game bird licence (youth), or (ii) a migratory game bird, unless the bird is killed on privately owned land in the Rural Municipality of Rosser or the Rural Municipality of Macdonald under the authority of a Manitoba resident game bird licence. 4(2) A person may kill a furbearing animal or gray (timber) wolf by trapping in the area described in clause (1)⁠(f) as the Rocky Lake restricted hunting area. M.R. 355/88; 222/89; 75/90; 194/90; 208/91; 76/92; 167/92; 186/94; 113/95; 195/96; 165/97; 153/98; 140/99; 156/2000 ; 123/2002 ; 140/2003 ; 149/2004 ; 55/2007 ; 182/2010 ; 25/2016 ; 131/2017 ; 91/2022 ; 7/2024 Transporting big game 5(1) Subject to subsection (2), a person who kills a big game animal — other than a caribou, black bear or gray (timber) wolf — during a season with a bag limit restricted to male animals shall transport the animal with its antlers or reproductive organs from the place it was killed until it is processed. 5(1.1) Subject to subsection (2), a person who kills a big game animal — other than a black bear or gray (timber) wolf — during a season with a bag limit restricted to antlerless animals shall transport the animal from the place it was killed until it is processed (a) with its head or reproductive organs, in the case of a female animal; or (b) with its antlers, in the case of a male animal. 5(1.2) Subject to subsection (2), a person who kills a caribou during a season with a bag limit restricted to male caribou must transport the caribou with its reproductive organs from the place where it was killed until it is processed. Information and biological samples 5(2) Every person shall, when so requested orally or in writing by an officer, the director or another person designated by the minister, without delay provide (a) information relating to the person's hunting activities and any wild animal that he or she killed; and (b) if he or she killed a wild animal, the entire animal or a specified portion of it; to a person or location specified in the request. 5(3) Every outfitter licenced under The Resource Tourism Operators Act and every guide licensed under this Act shall, when so requested orally or in writing by an officer, the director or another person designated by the minister, (a) request specified information from a client regarding any wild animal killed by the client and the hunting activities of the client; (b) obtain the entire wild animal killed by a client or a specified portion of it; and (c) submit the information and the wild animal or specified portion of it to a person or location specified in the request. 5(4) Every person who kills a wild animal while a client of an outfitter licenced under The Resource Tourism Operators Act or a guide licensed under this Act shall without delay provide to the outfitter or guide (a) any information requested by the outfitter or guide relating to the person's hunting activities and the wild animal killed; and (b) the entire wild animal killed or a specified portion of it when requested by the outfitter or guide. 5(5) The information obtained in subsections (2), (3) and (4) is to be used to assist in wildlife management, disease monitoring and conservation efforts and, without limiting the type of information to be obtained, may include: (a) the name, telephone number and address of a person and his or her hunting licence number; (b) the species hunted or killed; (c) the game hunting areas hunted; (d) the number of days hunted; (e) the game hunting area in which a wild animal was killed, if applicable; (f) the sex and age of each wild animal killed, if applicable; and (g) the name of the outfitter or guide, if applicable. 5(6) and (7) [Repealed] M.R. 108/2012 M.R. 208/91; 113/95; 156/2000 ; 140/2003 ; 149/2004 ; 110/2005 ; 182/2009 ; 108/2012 ; 15/2024 5.1 [Repealed] M.R. 208/92; 156/2000 ; 185/2002 ; 85/2003 Hunting equipment 6 No person shall (a) hunt wild turkeys or big game, other than gray (timber) wolves, with electronic recorded (b) hunt big game with a firearm requiring rimfire cartridges; (c) have a muzzleloading firearm in his or her possession while hunting deer or caribou that (i) is less than .44 calibre, or (ii) is loaded with more than one projectile in any barrel; (c.1) have a double-barrelled muzzleloading firearm in his or her possession while hunting deer during a muzzleloader deer season; (d) have a muzzleloading firearm in his or her possession while hunting black bear, moose or elk that (i) is less than .50 calibre, or (ii) is loaded with more than one projectile in any barrel; (e) hunt big game or wild turkeys with, or have in his or her possession while hunting big game or wild turkeys, (i) a long bow or recurved bow requiring less than 18 kg (40 lbs) draw weight at 71 cm (28 in) draw, or (ii) a compound bow set at less than 18 kg (40 lbs) peak draw weight, (iii) [repealed] M.R. 161/2014 ; (f) have in his or her possession while hunting during an archery big game season any weapon or other contrivance that is capable of being used to kill big game other than (i) a long bow, recurve bow or compound bow, or (ii) a crossbow, if the person is the holder of a disabled crossbow permit; (g) have in his or her possession while hunting during the muzzleloading big game season any weapon or contrivance that is capable of being used to kill big game other than a muzzleloading firearm or a crossbow; (g.1) have in his or her possession while hunting during a muzzleloader/shotgun season any weapon or contrivance that is capable of being used to kill big game other than a muzzleloading firearm or a shotgun; (h) [repealed] M.R. 140/99; (i) hunt with or have in his or her possession while hunting big game (i) a shotgun loaded with more than a single projectile in any barrel, (ii) a crossbow requiring less than 150 lbs draw, or (iii) a shotgun of less than 20 gauge; (j) hunt with a rifle requiring a centrefire cartridge in that portion of Township 56 lying east of the Hudson Bay Railway right-of-way in game hunting area 6A; (k) hunt or kill upland game birds with a centrefire rifle, shotgun or muzzleloading firearm loaded with a single projectile; (l) hunt wild turkeys with, or have in his or her possession while hunting wild turkeys, (i) a rimfire or centrefire rifle, or (ii) a muzzleloading firearm or shotgun that is loaded with a single projectile; (m) hunt with a long bow, recurved bow or compound bow drawn, held or released by a mechanical device other than a hand-held mechanical release attached to the bowstring, unless the person is the holder of a disabled crossbow permit; or (n) have a rifle requiring a centrefire cartridge in his or her possession while hunting deer in lands identified as a Near Urban Wildlife Zone on Plan No. 20350 or 20525 filed in the office of the Director of Surveys. M.R. 355/88; 222/89; 194/90; 76/92; 167/92; 206/93; 195/96; 153/98; 140/99; 156/2000 ; 123/2002 ; 185/2002 ; 149/2004 ; 110/2005 ; 69/2008 ; 93/2010 ; 115/2011 ; 108/2012 ; 172/2013 ; 161/2014 Arrow requirements 6.0.1(1) A person hunting big game or wild turkeys with a crossbow or a long, recurve or compound bow must not use or have in his or her possession any arrow other than a broadhead point arrow that is at least 2.2 cm wide at the widest point of its cutting edges. 6.0.1(2) A person hunting big game or wild turkeys with a crossbow or a long, recurve or compound bow must not use or have in his or her possession an arrow that (a) contains an explosive charge or has an explosive charge affixed to it; or (b) contains a drug, scent or poison or has a drug, scent or poison applied to it. 6.0.1(3) In this section, "broadhead point arrow" means an arrow with a pointed head and at least two sharp cutting edges. M.R. 161/2014 6.1 [Repealed] M.R. 206/93; 186/94; 140/99 7 [Repealed] M.R. 195/96 Tree stands and blinds 7.1(1) No person shall erect or place a tree stand or blind on Crown land for a purpose related to hunting unless he or she erects or places the stand or blind when permitted to do so under this section. 7.1(1.1) Subject to subsection (1.2), a person who holds a valid hunting licence may erect or place a tree stand or blind on Crown land during the open season for an animal that the person is permitted to hunt under authority of that licence, but that person shall remove the stand or blind before the end of each day. 7.1(1.2) A person who holds a valid deer, moose, black bear, elk, caribou or wild turkey hunting licence may erect or place a tree stand or blind on Crown land up to two weeks before the open season for the animal in question, but that person shall remove the stand or blind no more than two weeks after the end of that open season. 7.1(2) A person may erect or place a tree stand or blind or leave it in place beyond the time periods set out in subsection (1.1) or (1.2) if he or she has received written authorization to do so from an officer. 7.1(3) A person placing a tree stand or blind on Crown land shall (a) securely affix to the tree stand or blind a notice clearly showing his or her name and address; and (b) ensure that the notice remains affixed while the tree stand or blind remains on Crown land. M.R. 140/2003 ; 115/2011 Baiting 8(1) No person shall place a bait for the purpose of hunting black bears or gray wolves (a) within 200 m of a public road or a dwelling; (b) within 500 m of a campground, picnic site or cottage subdivision located on Crown land; (c) [repealed] M.R. 104/93; (d) that is more than 100 kg (220 lbs) of meat or fish, or both, on Crown land; (e) that contains, either in whole or in part, the head, hide, hooves, internal organs or mammary glands of livestock; or (f) within 100 m of Riding Mountain National Park; (g) [repealed] M.R. 87/2017 . 8(2) A person placing a bait shall (a) affix a notice clearly showing his or her name and address securely to the bait or immediately adjacent to the bait; and (b) ensure that the notice remains affixed to the bait or adjacent to the bait until the bait is removed. 8(2.1) A person placing a bait for the purpose of hunting black bears or gray wolves in game hunting area 23 or 23A (a) must not place bait more than 14 days before the start of the applicable hunting season; and (b) must remove the bait no later than five days after the end of the applicable season. 8(3) No person shall (a) place a bait for the purpose of hunting cervids or game birds; or (b) hunt within 800 m of a cervid bait or game bird bait. 8(4) If an officer believes on reasonable grounds that any farm produce (a) may lure or attract cervids or game birds; and (b) has been allowed to remain on land or has been placed on land for a purpose related to hunting; the officer may make a written order requiring the owner or occupant of the land on which the farm produce is located to take the action set out in the order within the time period specified in the order. 8(5) [Repealed] M.R. 140/2003 8(6) An order under subsection (4) may require the owner or occupier of the land to do one or more of the following: (a) construct a fence or other barrier that will effectively prevent cervids from coming into contact with the items specified in the order; (b) remove the items specified in the order to a specific location. 8(7) An order under subsection (4) may be served on the owner or occupant of the land by (a) personal service; (b) leaving a copy of the order with an adult person on the land with respect to which the order was made; or (c) posting a copy of the order in a conspicuous place on the land with respect to which the order was made, if reasonable efforts have been made to serve the order under clause (a) or (b). 8(8) No person shall fail to comply with an order made under subsection (4). 8(9) If an officer determines that any farm produce (a) may lure or attract cervids or game birds; and (b) has been allowed to remain on land or has been placed on land for a purpose related to hunting; the officer may cause signs to be posted prohibiting hunting, the discharge of a firearm, or the possession of a loaded firearm within 800 m of the farm produce, whether or not the officer makes an order under subsection (4). 8(10) No person shall hunt, discharge a firearm or possess a loaded firearm in contravention of a sign posted under subsection (9). 8(11) and (12) [Repealed] M.R. 140/2003 M.R. 222/89; 208/91; 167/92; 104/93; 186/94; 165/97; 140/99; 156/2000 ; 123/2002 ; 140/2003 ; 110/2005 ; 135/2006 ; 55/2007 ; 69/2008 ; 54/2009 ; 93/2010 ; 115/2011 ; 108/2012 ; 100/2013 ; 87/2017 Use of guides 9(1) A non-Canadian resident shall not hunt a big game animal unless he or she is using the services of a guide who is employed by the outfitter, or who is the outfitter, that issued the big game licence under authority of which he or she is hunting. 9(2) A Canadian resident shall not hunt caribou or moose unless he or she is using the services of a guide who is employed by the outfitter, or who is the outfitter, that issued the caribou or moose licence under authority of which he or she is hunting. 9(3) A non-Canadian resident who obtained their general non-Canadian resident migratory game bird licence from an outfitter shall not hunt migratory game birds unless they are using the services of a guide who is employed by the outfitter, or who is the outfitter, that issued their licence under authority of which they are hunting. M.R. 355/88; 76/92; 113/95; 195/96; 156/2000 ; 149/2004 ; 135/2006 ; 54/2009 ; 129/2022 ; 7/2024 ; 15/2024 Drones prohibited 9.1(1) A person must not operate or possess a drone while hunting or while accompanying another person who is hunting. 9.1(2) In this section, "drone" means an unmanned airborne vehicle that is guided remotely. M.R. 161/2014 Hunter dress 10(1) No person shall hunt, dress or retrieve a big game animal or coyote or act as a guide or otherwise accompany a person hunting, dressing or retrieving a big game animal or a coyote unless the person is wearing the following items that are not covered in any way: (a) a head covering completely hunter orange in colour (other than on the brim of a hat), which may have a crest or logo not exceeding 78 cm 2 (12 in 2 ) affixed to it, provided that on the side where the logo or crest is affixed, the hunter orange colour is not completely covered; and (b) 2,580 cm 2 (400 in 2 ) of material hunter orange in colour, affixed above the waist and visible from all sides. 10(2) Subsection (1) does not apply to the following: (a) archers hunting during an archery season; (b) registered trappers hunting black bears, coyotes or gray wolves during trapping season for the animal in question; (c) a person hunting black bears during the period April 1 to June 30; (d) a person hunting coyotes or gray wolves at a date and location for which there is no open hunting season for any other big game animals; (e) a person who is acting as a guide or otherwise accompanying a person referred to in this subsection; (f) trappers in an open trapping area hunting black bear, coyotes or gray wolves during the trapping season for the animal in question, except during any period when deer may be hunted under a Manitoba resident general deer licence. 10(3) No person shall hunt upland game birds during the general deer season unless the person is wearing the following items that are not covered in any way: (a) a head covering completely hunter orange in colour, which may have a crest or logo not exceeding 78 cm 2 (12 in 2 ) affixed to it, provided that on the side where the logo or crest is affixed, the hunter orange colour is not completely covered; (b) 2,580 cm 2 (400 in 2 ) of hunter orange material, affixed above the waist and visible from all sides. 10(4) In this section, "hunter orange" means a daylight fluorescent orange colour with a dominant wave length between 595 and 605 nanometres, excitation purity of not less than 85% and a luminance factor of not less than 40%. M.R. 355/88; 167/92; 165/97; 153/98; 54/2009 ; 182/2010 ; 100/2013 ; 161/2014 ; 7/2024 11 [Repealed] M.R. 121/90 PART III LICENCES Authority to act as vendor 12(1) No person shall sell, give, issue or attempt to sell, give or issue any licence or permit without having received written authority to act as a vendor from the minister. 12(2) No vendor shall sell, give or issue a licence or permit to a person without first taking reasonable steps to confirm that the person is entitled to hold the licence or permit. M.R. 76/92; 140/2003 Entitlement to licence 13(1) No person shall apply for or obtain a licence to which he or she is not entitled under the Act or regulations under the Act. For greater certainty, (a) a Manitoba resident may only apply for or obtain a Manitoba resident licence; (b) a Canadian resident may only apply for or obtain a Canadian resident licence; and (c) a non-Canadian resident may only apply for or obtain a non-Canadian resident licence. 13(2) A licence is not valid if (a) it is obtained by theft, fraud or misrepresentation; or (b) the holder is not entitled to it. M.R. 76/92; 195/96; 140/2003 ; 93/2010 ; 7/2024 Licences and permits issued using Internet 13.1(1) If a person is issued a licence or permit over the Internet, the person must either (a) print the licence or permit and carry it with them at all times while carrying out any activity that is authorized by the licence or permit; or (b) carry an electronic device that contains the licence or permit with them at all times while carrying out any activity that is authorized by the licence or permit, unless the person is hunting as a member of a hunting party. 13.1(2) If a person is carrying an electronic device that contains their licence or permit, the person must access the licence or permit on their device and show it to an officer upon being requested to do so, and permit the officer to view it for such period of time as the officer may require. 13.1(3) If a person is carrying an electronic device that contains their licence or permit and is unable to access it and show it to an officer for any reason, that person is deemed to contravene subsection 61(2) of the Act. For greater certainty, it is not a defence if the device was out of power, damaged or experienced any technical difficulties that prevented the licence or permit from being displayed on the device when requested. M.R. 76/92 15.1 [Repealed] M.R. 194/90; 76/92 Restrictions on licences that can be held 16(1) Except as permitted by this section or the Hunting Seasons and Bag Limits Regulation , Manitoba Regulation 165/91, no person shall apply for or obtain more than one licence that authorizes the hunting of wild turkeys, migratory game birds or the same species of big game animal in the same hunting year. 16(2) [Repealed] M.R. 108/2012 16(3) [Repealed] M.R. 153/98 16(4) [Repealed] M.R. 115/2011 16(5) The holder of an unused non-Canadian resident big game licence may return the licence without receiving a refund and purchase a non-Canadian resident big game licence for the same species and equipment type in any game hunting area. 16(6) [Repealed] M.R. 108/2012 M.R. 355/88; 208/91; 76/92; 167/92; 186/94; 195/96; 165/97; 153/98; 140/99; 140/2003 ; 110/2005 ; 55/2007 ; 54/2009 ; 93/2010 ; 115/2011 ; 108/2012 ; 129/2022 ; 7/2024 Lost licences 17(1) A person whose licence is lost or destroyed may be issued a replacement licence if the person submits (a) a declaration attesting to the loss or destruction; and (b) the replacement licence fee prescribed in the Wildlife Fees Regulation , Manitoba Regulation 31/92. 17(2) No refund shall be made with respect to a lost or destroyed licence. M.R. 76/92; 129/2022 18 [Repealed] M.R. 149/2004 ; 135/2006 19 [Repealed] M.R. 76/92; 167/92; 206/93; 195/96; 153/98; 140/2003 ; 135/2006 ; 128/2007 19.1 [Repealed] M.R. 206/93; 186/94 Game tags 20(1) Subject to subsection (1.2) or (1.3), in order to hunt a big game animal or a wild turkey, a person must (a) obtain a game tag from the department or a vendor; and (b) carry the game tag with them at all times while hunting until a big game animal or wild turkey is killed, unless the person is hunting as a member of a hunting party. 20(1.1) If a big game or wild turkey hunting licence is issued over the Internet, the holder must (a) provide the number of the game tag when applying for the licence; (b) write the number of the licence and the species that may be hunted under that licence in ink on all parts of the game tag before the holder goes hunting; and (c) carry the licence and the game tag with them at all times while hunting until a big game animal or wild turkey is killed. 20(1.2) If multiple persons are hunting together under authority of any of the following licences, only one of the persons must comply with subsection (1): (a) Manitoba resident draw general elk licence; (b) Manitoba resident landowner draw general elk licence; (c) Manitoba resident draw general moose licence; (d) Manitoba resident conservation moose licence. 20(1.3) Subsection (1) does not apply to a person who is hunting a gray (timber) wolf or coyote under the authority of a Manitoba resident big game hunting licence during a period outside of the applicable big game hunting season under that licence. 20(2) A person who takes or kills a big game animal or wild turkey shall immediately after taking or killing the big game animal or wild turkey (a) cut out and remove the spaces provided on the game tag to indicate the correct date of the taking or killing; and (b) securely attach the game tag to the big game animal or wild turkey. 20(3) Despite clause (2)⁠(b), the holder of a licence may (a) delay attaching the game tag to a big game animal or wild turkey until it is delivered to a means of transportation if the holder of the licence remains in physical possession of the big game animal or wild turkey from the time of taking or killing until delivery; and (b) remove a game tag that has been attached in accordance with clause 2(b) for the time the big game animal or wild turkey is being delivered from the place of taking or killing to a means of transportation. 20(4) Except where the holder of a licence hunts as a member of a party or in accordance with the regulations respecting the hunting of gray wolves and coyotes, a licence is invalid for further hunting once the associated game tag has been used or all portions of the game tag are not in the possession of the licence holder. 20(5) No person shall possess, buy, sell, give to another person, transport, import, export, or attempt to import or export a big game animal or a part of a big game animal under the authority of a tag, seal or shipping coupon other than the tag, seal or shipping coupon that was issued with or as part of the licence under the authority of which the animal was taken or killed. M.R. 222/89; 76/92; 167/92; 195/96; 110/2005 ; 55/2007 ; 93/2010 ; 96/2020 ; 7/2024 Party hunting 21(1) Persons who hold a big game licence or a wild turkey licence may hunt as a member of a hunting party in accordance with this section. 21(1.1) [Repealed] M.R. 87/2017 21(1.2) The maximum size of a hunting party is as follows: (a) a hunting party for white-tailed deer consisting of non-Canadian resident white-tailed deer licence holders — two persons; (b) a hunting party for white-tailed deer consisting of any other type of white-tailed deer licence holder — four persons; (b.1) a hunting party for mule deer consisting of Manitoba resident mule deer licence holders — four persons; (c) a hunting party for any other type of big game animal — two persons; (d) a hunting party for wild turkey — two persons. 21(1.3) A person may be part of only one hunting party that is hunting a particular species of animal during the hunting season for that species. 21(1.4) All members of a hunting party must carry a physical version of the licence with them at all times while hunting as a party. 21(2) [Repealed] M.R. 161/2014 21(3) Before hunting as a party, each member shall sign and record his or her licence number in ink on the licence of the other member or members. 21(3.1) Once a hunting party is formed, no changes may be made to the membership of the party. 21(4) A member of a hunting party who has used his or her own game tag may continue to hunt with another member of the party who has an unused game tag as long they remain in such close physical proximity that they can be readily identified together. 21(5) Every member of a hunting party must have the same type of licence, except for the following: (a) a hunting party for white-tailed deer may have members who hold a Manitoba resident general white-tailed deer licence or a Canadian resident general white-tailed deer licence; (b) a hunting party for white-tailed deer may include a minor who holds a white-tailed deer and game bird licence (youth) if that minor is accompanied at all times by an adult who complies with the requirements of clauses 27.2(2)⁠(a) and (b); (c) the holder of a wild turkey licence (youth) may form a hunting party with an adult who holds a wild turkey licence if that minor is accompanied at all times by an adult who complies with the requirements of clauses 27.2(2)⁠(a) and (b). 21(6) Subject to subsection (6.1), where one game tag only is issued with two licences, the holders of the licences shall hunt only as members of a party consisting of the two licence holders, except that either member may hunt alone while in possession of an unused game tag. 21(6.1) The holders of two conservation moose licences may hunt together as members of a party of four hunters. 21(7) A minor who is hunting under the authority of section 27.1 and who is accompanied by an adult referred to in clause 27.1(2)⁠(b) may hunt with the adult's party and does not count as a member of the party for the purpose of subsection (1.2). M.R. 194/90; 76/92; 167/92; 140/99; 156/2000 ; 123/2002 ; 140/2003 ; 149/2004 ; 110/2005 108/2012 ; 161/2014 ; 196/2014 ; 87/2017 ; 96/2020 ; 91/2022 ; 7/2024 Big game licences 22(1) The number of big game licences to be issued for any big game species for any season shall be determined by the minister. 22(2) An application for a licence to hunt big game may be made to the minister using the form prescribed by the minister and shall be accompanied by the fee prescribed in the Wildlife Fees Regulation . 22(3) Where the number of applications for licences to hunt big game exceeds the number of licences the minister has determined should be issued under subsection (1), licences shall be issued on the basis of a draw. M.R. 76/92; 129/2022 General non-Canadian resident migratory game bird licence 22.1(1) A general non-Canadian resident migratory game bird licence may be obtained (a) from an outfitter who has received an allocation of those licences under the Allocation of Hunting Licences Regulation , Manitoba Regulation 77/2006; or (b) on the basis of a draw. 22.1(2) The minister shall determine the number and classes of general non-Canadian resident migratory game bird licences to be issued in a season and the distribution of those licences between outfitters and those available by draw. 22.1(3) An application for a general non-Canadian resident migratory game bird licence issued by draw may be made to the minister using the form prescribed by the minister and must be accompanied by the fee prescribed in the Wildlife Fees Regulation . M.R. 129/2022 ; 7/2024 Legacy non-Canadian resident migratory game bird licence 22.2(1) A person may obtain a legacy non-Canadian resident migratory game bird licence if (a) they are a non-Canadian resident who, on September 1, 2022, was (i) the registered owner of land in Manitoba, (ii) the lessee of Crown land in Manitoba, (iii) a shareholder in a corporation that was the registered owner of land in Manitoba, (iv) a shareholder in a corporation that was the lessee of Crown land in Manitoba, (v) a member of a non-profit corporation with no more than 30 members that was the registered owner of land in Manitoba, or (vi) a member of a non-profit corporation with no more than 30 members that was the lessee of Crown land in Manitoba; (b) there is no change to their applicable ownership or leasehold interest described in clause (a) between September 1, 2022, and the time the person applies for a legacy non-Canadian resident migratory game bird licence; and (c) they held a licence that authorized the hunting of migratory game birds in Manitoba at any time in the five-year period before September 1, 2022. 22.2(2) By no later than June 1, 2023, a person described in subsection (1) may provide the department with a list they made that contains the names of no more than four non-Canadian residents who will also be eligible to obtain a legacy non-Canadian resident migratory game bird licence in accordance with subsection (3). The list may only include persons from one or both of the following categories: (a) immediate family members of the person making the list; (b) persons whom the person making the list attests they have hunted migratory game birds with in Manitoba in the previous five years. 22.2(3) Each person named in a list provided under subsection (2) may obtain a legacy non-Canadian resident migratory game bird licence if (a) the person who made the list has already obtained a legacy non-Canadian resident migratory game bird licence for that hunting year; and (b) the authorized hunting period under their licence is for the same period as the person who made the list. 22.2(4) For the purpose of this section, the following are immediate family members of a person: (a) the person's spouse or common-law partner; (b) the person's children and the children of the person's spouse or common-law partner; (c) the person's parents and the parents of their spouse or common-law partner; (d) the person's siblings and the siblings of their spouse or common-law partner; (e) the person's grandchildren. M.R. 129/2022 ; 40/2023 ; 7/2024 Hunting of game birds on privately owned land 23 The owner or occupier of privately owned land, and every member of that person's immediate family, may hunt without a game bird licence any upland game bird on that land if the person otherwise complies with every other provision of the Act and the regulations. M.R. 222/89; 167/92 Written permission of landowner 23.1 No person shall hunt under the authority of a deer licence in game hunting area 33 or 38 unless the person is, while hunting with a shotgun or muzzleloader, in possession of written permission to do so obtained from the landowner. M.R. 194/90; 206/93; 113/95; 93/2010 24 [Repealed] M.R. 140/99 Draw landowner licence 25 The holder of a valid and subsisting draw landowner licence shall hunt only (a) on land which he or she owns; or (b) on land which an immediate family member owns if the holder has received a licence jointly with the family member. M.R. 140/99 26 [Repealed] M.R. 140/99 Licence for person 65 years of age and older 27(1) A Manitoba resident who is 65 years of age or older does not require a game bird licence to hunt upland game birds or migratory game birds. 27(2) A person who is hunting upland game birds or migratory game birds under subsection (1) shall produce proof of age at the request of an officer. M.R. 225/89; 76/92; 167/92; 104/93; 7/2024 Licence exemption for minors 27.1(1) A Manitoba resident who is 12 years of age or older and under 18 years of age does not require a licence to hunt deer, elk, moose, black bear, caribou, game birds or wild turkey. 7.1(1.1) A Manitoba resident who is 10 years of age or older and under 18 years of age does not require a licence to hunt game birds or wild turkey. 27.1(2) A person who is hunting deer, elk, moose, black bear, caribou, game birds or wild turkey under subsection (1) or (1.1) shall (a) carry and produce proof of age and a valid hunter education certificate or apprentice hunter education certificate or an equivalent certificate from another province, territory or country; (b) be accompanied by a person who is 18 years of age or older who possesses a valid licence for the species being hunted; (b.1) at all times when hunting, be in the immediate physical vicinity of the person referred to in clause (b); and (c) include any game taken as part of the bag limit and possession limit of the person by whom he or she is accompanied. 27.1(3) An adult referred to in clause 27.1(2)⁠(b) must not accompany more than two minors hunting under subsection (1) or (1.1) at any time. M.R. 206/93; 186/94; 113/95; 156/2000 ; 135/2006 ; 54/2009 ; 182/2010 ; 102/2016 ; 87/2017 ; 7/2024 Youth licence application requirements 27.2(1) No person shall apply for or obtain a white-tailed deer and game bird licence (youth), a wild turkey licence (youth) or a black bear licence (youth) other than a Manitoba resident who is 12 years of age or older and under 18 years of age. 27.2(2) No person shall hunt under authority of a white-tailed deer and game bird licence (youth), a wild turkey licence (youth) or a black bear licence (youth) unless the person (a) is accompanied by a person who is 18 years of age or older who possesses (i) a valid hunter education certificate, or (ii) a hunting licence for any species that was issued in the current hunting year; and (b) is at all times in a position where he or she can be readily identified with the person referred to in clause (a). M.R. 140/99; 156/2000 ; 140/2003 ; 135/2006 ; 54/2009 ; 93/2010 ; 182/2010 ; 87/2017 ; 91/2022 ; 7/2024 Licence exemption for Waterfowler Heritage Days 27.3(1) Subject to subsection (2), a Manitoba resident who is 10 years of age or older and under 18 years of age does not require a licence to hunt ducks and geese where permitted to do so during Waterfowler Heritage Days if he or she (a) is accompanied by a person who is 18 years of age or older who possesses a valid hunter education certificate or a valid hunting licence; (a.1) is in the immediate physical vicinity of the person referred to in clause (a) at all times when hunting; and (b) is carrying proof of age and a valid hunter education certificate or apprentice hunter education certificate. 27.3(2) The person referred to in clause (1)⁠(a) must not (a) have a firearm in his or her possession or use a firearm while accompanying the minor; and (b) accompany more than two minors at one time. 27.3(3) In this section, "Waterfowler Heritage Days" means the period specified as Waterfowler Heritage Days in Schedule A of the Hunting Seasons and Bag Limits Regulation , Manitoba Regulation 165/91. M.R. 110/2005 ; 135/2006 ; 54/2009 ; 102/2016 ; 7/2024 Duty of adult accompanying minor hunters 27.4(1) A person who is 18 years of age or older who is accompanying a hunter who is 10 years of age or older and under 18 years of age must not assist, direct or advise the younger person to do, or refrain from doing, anything that would constitute an offence under the Act, the Migratory Birds Convention Act, 1994 (Canada) or any regulation made under those Acts. 27.4(2) A person who holds a valid hunter education certificate who is accompanying a hunter who is 10 years of age or older and under 18 years of age may call wildlife while accompanying the minor hunter.
