M.R. 142/2018 2 and 3 [Repealed] M.R. 142/2018 Courses as lesson helps 4(1) At the discretion of the principal of the distance learning unit, correspondence courses may be provided as lesson helps to: (a) school teachers who are regularly engaged in teaching in a school in Manitoba; and (b) subject to the approval of the pupil's principal, a pupil who is receiving regular classroom instruction. 4(2) The fees for lesson helps are the fees established by the minister, and the minister must make information concerning the fees publicly available in accordance with subsection 1(3). M.R. 142/2018 5 [Repealed] M.R. 142/2018 Admission where no grade 12 instruction 6 A school division or district operating a secondary school not offering instruction in grade 12 shall admit resident grade 12 correspondence pupils who are up to three years beyond the age of majority, if in the opinion of the superintendent, or, where there is no superintendent, in the opinion of a field representative, there is accommodation for them. M.R. 161/2007 Attendance by pupils of school age 7 Correspondence pupils of compulsory school age shall attend school unless exempted from doing so by the superintendent, or, where there is no superintendent, by a field representative. Attendance records 8 The names of correspondence pupils attending school shall be entered upon the school register, and a record of attendance shall be kept. Pupils subject to rules 9 Correspondence pupils in attendance at a public school shall be subject to the rules and regulations of the school. Records and reports by principals, etc. 10 Principals or teachers in charge of schools at which correspondence pupils are in attendance shall keep records, submit such reports, and provide such supervision of these pupils as may be required by the distance learning unit. M.R. 142/2018 Courses offered 11 The subjects or courses offered by the distance learning unit are those approved by the minister, and the minister must make information concerning the approved subjects and courses fees publicly available in accordance with subsection 1(3). M.R. 142/2018 PART II EVALUATIONS AND PROMOTIONS Principal's responsibility 12(1) Subject to subsection (2), and the authority of the superintendent or of a field representative if no superintendent has been appointed, the testing and promotion of students from grades 1 to 12 inclusive is the responsibility of the principal. 12(2) The superintendent or assistant superintendent is responsible for the testing and promotion of students who are 19 years or older and who are not registered in a regular public school program, provided that the superintendent or assistant superintendent, as applicable, (a) hold a valid and subsisting Manitoba teaching certificate; and (b) has been authorized to do so by the school board. M.R. 141/2001 ; 161/2007 Responsibilities of school divisions, etc. 13 School divisions and school districts are responsible for setting tests for the purpose of determining school standing in those subjects offered by the secondary schools of the division or district for persons resident in the division or district and not regularly enrolled as full-time students in a public school. Student records 14 School divisions and school districts shall maintain a record of achievement for all students. Furnishing transcripts 15 The principal of each school shall furnish to each student, free of charge, a transcript of his or her record of achievement at least at the end of each school year, or on request of persons who are no longer enrolled. Examinations and tests 16(1) School divisions, school districts and private schools shall, in each year, (a) require pupils at grade levels prescribed by the minister to write such province-wide examinations as the minister may prescribe; and (b) provide such accommodation and supervision for pupils writing the examinations under clause (a) as the minister may prescribe. 16(2) The results of any examination written by a pupil in a subject under subsection (1) shall constitute that percentage of the pupil's final mark in that subject as the minister prescribes. 16(3) School divisions and school districts shall, in each year, (a) conduct such tests of pupils at any grade level as the minister may prescribe; and (b) provide such accommodation and supervision for pupils taking the tests under clause (a) as the minister may require. 16(4) School divisions and school districts shall, in each year, (a) report on pupil evaluation in a manner prescribed or authorized by the minister; and (b) for all subject areas from grades 7 to 12, state pupil marks (i) as percentage scores, or (ii) in another manner authorized by the minister, for the subject areas where the minister is satisfied percentage scores are not assigned. M.R. 33/92; 68/97; 161/2007 ; 132/2008 ; 150/2013 PART III 17 to 20 [Repealed] M.R. 108/2016 ; 22/2021 PART IV DEPARTMENT'S LIBRARY 21 [Repealed] M.R. 142/2018 Materials available without charge 22(1) The library's multimedia kits, videos, books and other resource materials may be made available without charge to grades kindergarten to 12 educational personnel, student teachers and Department of Education staff and at the discretion of the department to other people involved in educational activities. 22(2) Subsection (1) does not apply to braille, large print and audio books. M.R. 161/2007 ; 142/2018 23 [Repealed] M.R. 178/93 Returns of resource material 24 Borrowers returning resource materials by any mode of transportation other than mail shall return them prepaid unless otherwise requested or approved by the library. M.R. 142/2018 25 [Repealed] M.R. 142/2018 Loan policies 26 The department shall publish procedures governing the borrowing and return of the library's collection. M.R. 142/2018 PART V RESPONSIBILITIES OF PRINCIPALS AND TEACHERS RESPONSIBILITIES OF PRINCIPALS Principal for each school 27 A school board shall designate a principal for every school, and in a school in which two or more teachers are employed, one of those teachers must be designated as the principal. M.R. 68/97 Principal's general authority 28(1) Subject to The Public Schools Act and the instructions of the school board, the principal is in charge of the school in respect of all matters of organization, management, instruction and discipline. 28(2) The principal is responsible for the supervision of staff, pupils, buildings, and grounds during school hours. 28(3) The principal is responsible for placing pupils in classes and issuing statements of their standing, subject to the approval of the superintendent where one has been appointed. M.R. 68/97 Information provided to parents and others 29(1) A principal must provide pertinent and meaningful information about the school and related educational matters to parents and the community. 29(2) A principal must ensure that parents are provided with information on their children's individual achievement on a regular basis. 29(3) The principal must provide the pupil file of a pupil who has transferred to another school to that school within one week of the school requesting it. 29(4) In subsection (3), "pupil file" has the same meaning as in section 42.2 of The Public Schools Act . M.R. 68/97; 119/2000 ; 156/2005 Hiring, assignment and evaluation of teachers 30 A principal is to participate in the hiring, assignment and evaluation of teachers, and may have regard to parental and community views when making recommendations about those matters to the school board. M.R. 68/97 Teacher involvement in planning process 31 A principal must involve teachers in any planning process that is undertaken for the school. M.R. 68/97 32 and 33 [Repealed] M.R. 68/97; 60/2015 Supplementary curriculum and extracurricular activities 34 A principal is responsible for implementing (a) optional supplementary curricula, subject to the approval of the school board and the minister; and (b) extracurricular activities, subject to the approval of the school board. M.R. 68/97 Information and reports 35(1) The principal must prepare and provide to the minister, in a form acceptable to the minister, any information, report or return that the minister may require. 35(2) The principal must compile and provide to the secretary-treasurer of the division the attendance reports completed by teachers under section 40.1. 35(3) The principal must bring to the attention of pupils of the school and parents of pupils any information that the minister requires be brought to their attention. M.R. 68/97 36 [Repealed] M.R. 68/97; 150/2013 Inspection of school premises 37 The principal must inspect the school premises and report any necessary repairs promptly to the secretary-treasurer of the school board or other person designated for that purpose by the school board, and must endeavour to ensure that the premises are properly cared for by the pupils of the school. M.R. 68/97 When position vacated 38 A principal who leaves his or her position must leave at the school all records pertinent to the operation of the school. M.R. 68/97 RESPONSIBILITIES OF TEACHERS General responsibilities 39 A teacher is responsible for (a) teaching the curriculum prescribed or approved by the minister; (b) providing an effective classroom learning environment; (c) maintaining order and discipline among pupils attending or participating in activities that are sponsored or approved by the school, whether inside or outside the school; (d) advising pupils as to what is expected of them in school, reviewing their assessments with them, and evaluating their progress and reporting on that progress to parents; (e) administering and marking any assessment of pupil performance that the minister may direct, in the manner that the minister directs; (f) ongoing professional development. M.R. 68/97 When duties begin on school day 40 A teacher must be on duty in the school at least 10 minutes before the morning session begins and at least five minutes before the afternoon session begins, unless prevented from doing so by exceptional circumstances. M.R. 68/97 Information and reports 40.1(1) A teacher must complete and deliver promptly to the principal the attendance reports that are required by the school division or district. 40.1(2) A teacher must prepare and provide to the minister, in a form acceptable to the minister, any information or report that the minister may require. M.R. 68/97 When position vacated 40.2 A teacher who leaves his or her position must leave at the school all school records, including his or her last timetable and a statement of the work covered by the pupils under his or her charge. M.R. 68/97 40.3 to 40.8 [Repealed] M.R. 68/97; 91/2013 40.9 [Repealed] M.R. 156/2005 ; 91/2013 40.10 to 40.12 [Repealed] M.R. 156/2005 ; 91/2013 PART VI FIELD REPRESENTATIVES Rights and duties 41 A field representative has the right to make such inquiries, and carry out such duties, as are consistent with his or her responsibility to survey or assess any or all aspects of a school or a school system. PART VII SCHOOL BUILDINGS Designation of school to be attended 42(1) The school board in any school division or school district that has more than one school building may (a) designate the school building or buildings which any designated pupil or the pupils resident within any designated area shall attend; and (b) subject to section 262 of The Public Schools Act designate a public school outside the division or district to be attended by any designated pupil or pupils resident in an area. 42(2) The parent, parents, guardian, corporation, society, or organization having charge of any such designated pupil or of a pupil resident within a designated area, shall cause that pupil to attend in accordance with subsection (1). Insurance 43 The school board shall adequately insure all buildings and other property owned by the school division. Repeal 44 Manitoba Regulations 250/80, 240/81, 99/82 and 115/83 are repealed.
