Languages of Instruction and Study Regulation, M.R. 469/88 R The Public Schools Act , C.C.S.M. c. P250 Regulation 469/88 R Registered November 7, 1988 bilingual version (HTML) Definitions 1 In this regulation, "division" means a school division; (« division ») "elementary grade" means kindergarten to grade VIII inclusive; (« classes de niveau élémentaire ») "language of study" means any language approved by the minister as a subject of study in the schools, including English and French when taught as second languages; (« langue enseignée ») "secondary grade" means grades IX to XII inclusive. (« classes de niveau secondaire ») Languages of instruction 2 Courses of study may be taught in the schools in either the French or English language, in those grades, from kindergarten to grade XII, for which a course of study has been duly approved by the minister, or for which a proposal and course of study have been duly approved by the minister. Time allotments 3 Time allotments for courses of study taught in either English or French shall be the same, except that, where English is a required subject, under subsection 79(6) of the Act, for those classes using French as the language of instruction, the time allotment for English shall not exceed 25% of the total instructional time. Insufficient number of pupils 4 If a school board is in receipt of a petition requesting the use of French or English as the language of instruction under subsection 79(3) of the Act, and is unable to group together for instruction the minimum number of pupils required under that subsection, or is unable to make satisfactory arrangements with the school board of another division or district for the provision of joint classes as permitted under subsection 79(7) of the Act, the school board shall inform the minister accordingly. Languages of study 5 Languages of study may be taught in the schools in those grades from kindergarten to grade XII (a) for which a course of study has been duly approved by the minister; or (b) for which a proposal and course of study have been duly approved by the minister in the form and manner set out herein. Proposal 6 A proposal and course of study for instruction in a language of study shall be submitted by a school board of a division or district in the form approved by the minister, and its approval is subject to such terms and conditions as the minister may approve. Text books 7 The text books and supplementary materials to be used for languages of study shall be those authorized or approved by the minister. Time allotments 8 Time allotments allocated to a language of study other than English, approved by the minister under a school board proposal, shall not exceed the time allotments allocated to other languages of study authorized by the minister and set down in curriculum guides issued under the authority of the minister. Language of administration 9(1) In a school in which English is used as the language of instruction for 75% or more of the school day in the elementary grades, and 60% or more of the school day in the secondary grades, the administration and operation of the school shall be carried out in the English language. 9(2) In a school in which French is used as the language of instruction for 75% or more of the school day in the elementary grades, and 60% or more of the school day in the secondary grades, the administration and operation of the school shall be carried out in the French language. 10 In a school in which instruction is given in the English language or in the French language for a period of 50% or more, but (a) less than 75% of the school day in the elementary grades; and (b) less than 60% in the secondary grades; the administration and operation of the school shall be carried out in either English or French, depending upon the predominance of the language of instruction in that school; but the intent of all administrative and operational procedures and directives shall be duly communicated in the other language to those members of the staff, and to those pupils, for whom the language of instruction is not easily understandable. Term of office 11 Except for a member appointed to complete the term of a member who has resigned or died, or has ceased to be eligible as a member before the end of his or her term, members of the Languages of Instruction Advisory Committee, as established under subsections 79(8) and 79(9) of the Act, shall serve for a period of two years, and thereafter until their successors are appointed. Re-appointment 12 Appointed members of The Languages of Instruction Advisory Committee are eligible for re-appointment for a second consecutive term of office, but are not eligible for appointment for a third or subsequent term of office as a member of the committee, unless one year has elapsed since the expiry of any previous term of office as a member of the committee. Vacancies 13(1) A person appointed to The Languages of Instruction Advisory Committee who ceases to be a member of the association or society that nominated him or her thereupon ceases to be a member of the committee. 13(2) Where an appointed member of The Languages of Instruction Advisory Committee vacates office for any cause before the expiry of the term, his or her successor shall be appointed, or nominated and appointed, in the same manner as that member was, for the unexpired portion of his or her term. Election of chairperson 14 At the first meeting in each calendar year, The Languages of Instruction Advisory Committee shall proceed immediately to the election of a chairperson and vice-chairperson, who shall hold office for that calendar year and until their successors have been duly elected. Appointment of secretary 15 The minister shall appoint a secretary to The Languages of Instruction Advisory Committee. Procedure 16 The Languages of Instruction Advisory Committee may make rules, not inconsistent with the Act, respecting its procedure and fixing its own quorum. Meetings 17 The Languages of Instruction Advisory Committee shall meet at least annually, and at such other times as it determines or as the minister directs.
