Northern Manitoba Population Determination Regulation, M.R. 552/88 The Northern Affairs Act , C.C.S.M. c. N100 Regulation 552/88 Registered December 12, 1988 bilingual version (HTML) Definitions 1(1) In this regulation, "census" means the enumeration of persons for the purpose of determining number, sexes, ages, occupations and other information required by this regulation; (« recensement ») "census coordinator" means the person charged by the Minister with the administration of this regulation; (« coordonnateur du recesement ») "census enumerator" means a person appointed by the Minister to make a census under this regulation; (« agent recenseur ») "designated area" means an area designated by the minister; (« région désignée ») "Northern Affairs representative" means the person designated by the minister. (« représentant du ministère des Affaires du Nord ») 1(2) For the purpose of this regulation, a place of residence shall be governed by the following rules insofar as they are applicable. Fixed Home Rule 1. The residence of a person shall be his or her true, fixed, permanent, home or lodging place to which, whenever he or she is absent, he or she has the intention of returning. Temporary absence Rule 2. A person does not lose his or her residence by leaving his or her home for temporary purposes. Temporary residence Rule 3. A person shall be deemed not to have gained a residence in a community, local committee area or designated area if he or she comes for temporary purposes only, without the intention of making some place in the community, local committee area or designated area his or her home. Leaving the community, local committee area or designated area Rule 4. A person who leaves a community, local committee area or designated area with the intention of making his or her residence elsewhere, loses his or her residence in the community, local committee area or designated area. Indefinite absence Rule 5. A person who moves to a place outside a community, local committee area or designated area, with the intention of making that place his or her place of residence for an indefinite time, loses his or her residence in the community, local committee area or designated area notwithstanding that he or she entertains the idea or intention of returning at some future time. Regular lodger Rule 6. The residence of a single person is the place where he or she occupies a room as a regular lodger, or to which he or she habitually returns, not having any other permanent lodging place. The family residence Rule 7. The place where a person's family resides shall be deemed to be his or her place of residence unless he or she takes up or continues his or her abode at some other place with the intention of remaining there in which case he or she shall be deemed to be resident at that other place. Appointment of census coordinator etc. 2 The minister shall appoint a census coordinator and Northern Affairs representatives as required. Engagement of census enumerator 3 The minister may engage the services of a census enumerator for each community, local committee area or designated area in which a census is made. Census by minister 4 The minister may, from time to time on a day determined by the minister, to be known as census day, cause a census to be made of a community, local committee area or designated area in Northern Manitoba to determine (a) the number of residents and their (i) addresses, (ii) occupations, (iii) sexes, and (iv) ages; and (b) the numbers of, and information with respect to, persons in a category or class determined by the minister. Oath of secrecy 5 The census coordinator, each Northern Affairs representative and each census enumerator shall, before commencing his or her duties, subscribe an oath or affirmation in Form 1. Preparation list 6(1) The census enumerator shall, in the appropriate column in Form 2, by household (a) list in alphabetical order the names of persons according to surname, and where surnames are the same, the first given name; and (b) set out opposite the name the other information with respect to each person. 6(2) A census enumerator may obtain the information required to complete Form 2 from any source and, if necessary, from a house-to-house canvass. 6(3) A census enumerator shall upon completion of the census certify the list true and complete to the best of his or her knowledge and belief. Revision of census 7 The census enumerator shall within 14 days of the census day submit two copies of a summary of the census results in Form 3 (a) in the case of a community or local committee area, to the community council or local committee; and (b) in the case of a designated area, the Northern Affairs representative; who shall within 14 days of receipt consider the summary and refer it back to the census enumerator with recommended revisions, if any, in writing. Duties of census enumerator 8 The census enumerator shall (a) consider the recommended revisions and, where satisfied that they are proper, alter the census results accordingly; and (b) within 14 days of receipt of the summary and revisions from the community council, local committee or Northern Affairs representative forward to the census coordinator (i) a copy of the original census results on Form 2, (ii) a copy of the summary of the census results in Form 3, and (iii) a copy of the recommended revisions described in section 7, and (iv) a copy of Form 2 with revisions made. Report to minister 9 The census coordinator shall submit to the minister a report of the census results. Procedure 10 Where a census enumerator, community council, local committee or Northern Affairs representative fails to discharge a duty imposed under section 6, 7, or 8, the minister may remedy the omission in any manner he or she considers fit. Arrangements with Statistics Canada 11 Despite anything in this regulation, the minister may enter into an agreement or arrangement with Statistics Canada or the Manitoba Bureau of Statistics for the determination of the population and the provision of information with respect to persons in a community, local committee area or designated area. Approval by minister 12 Upon approval by the minister, the census results or the determinations or information obtained under section 11 are approved for use under the Act.
