The Farm and Food Awareness Act, C.C.S.M. c. F28 (Assented to November 5, 2015) bilingual version (HTML) Table of Contents Section 1 Purpose 2 Definitions 3-4 Repealed 5 Establishing goals 6 Scope of goals 7 Information to be provided to minister 8 Regulations 9 C.C.S.M. reference 10 Coming into force HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows: Purpose 1 The purpose of this Act is (a) to foster thriving and resilient farm and food economies throughout Manitoba; (b) to increase access to, and awareness of the availability of, Manitoba food and other products of farming carried on in Manitoba; (c) to increase awareness of agriculture, including the diversity of Manitoba farms; (d) to encourage farmers and agri-processors to capture and develop new market opportunities; and (e) to increase international awareness of Manitoba food and other products of farming carried on in Manitoba. Definitions 2 The following definitions apply in this Act. "farming" means (a) growing plants to use as food or another commodity or to produce non-food products from the plants; or (b) raising or keeping animals to use as food, to produce animal products that are used as food or to produce non-food products from the animals. (« agricole ») "food" means (a) food or drink for human consumption; (b) any ingredient of food or drink; or (c) anything specified as being food in the regulations; but does not include anything that the regulations specify is not food. (« produit alimentaire ») "Manitoba farm" means a farming enterprise in which the land, buildings and equipment used for farming are located in Manitoba. (« exploitation agricole du Manitoba ») "Manitoba food" means food that is grown, raised, produced or processed by individuals or businesses in Manitoba. (« produit alimentaire du Manitoba ») "minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre ») "public sector entity" means (a) the government of Manitoba; (b) a city, municipality or other local government entity, other than a First Nation band council; (c) a reporting organization as defined in section 1 of The Financial Administration Act ; and (d) an entity controlled by an entity referred to in clause (a), (b) or (c). (« entité du secteur public ») 3 and 4 [Repealed] S.M. 2022, c. 28, s. 3 . Establishing goals 5(1) To further the purpose of this Act, the minister may establish goals to (a) sustain Manitoba's agriculture and food industries and strengthen their capacity to contribute to the provincial economy; (b) encourage increased use of Manitoba food and other products of farming carried on in Manitoba; (c) increase access to, and awareness of the availability and origin of, Manitoba food and other products of farming carried on in Manitoba; (d) encourage collaboration among all participants in the agriculture and food industries; and (e) promote consumer awareness of the significance of Manitoba farms in our society and the provincial economy. Additional food-oriented goals 5(2) The minister may also for the purpose of this Act establish other goals to strive for in respect of Manitoba food. Consultation before goal is established 5(3) Before establishing a goal, the minister must consult with organizations or groups of persons that, in the minister's opinion, have an interest in the goal. Scope of goals 6(1) A goal (a) may be general or particular in its application; and (b) without limiting the generality of clause (a), may be established in respect of (i) one or more types of Manitoba food or other products, (ii) one or more entities specified in the goal, including one or more public sector entities, (iii) one or more specified geographic areas, or (iv) a specified period of time. Limitation on scope of goals 6(2) A goal must not be inconsistent with commitments made among Canadian provinces and territories regarding interprovincial and interterritorial trade and movement of goods and services. Information to be provided to minister 7(1) The minister may request a public sector entity to provide the minister with specified information in order to assist the minister in (a) establishing a goal or determining the actions required to meet a goal; (b) understanding the steps that are being taken or have been taken to meet a goal; or (c) assessing the progress that is being made or has been made toward meeting a goal. Public sector entity to provide information 7(2) If the minister requests a public sector entity to provide information, the public sector entity must provide the information on or before the deadline specified by the minister in the request. Regulations 8 The Lieutenant Governor in Council may make regulations (a) specifying things that are or are not food for the purpose of the definition of "food" in section 2; (b) respecting any matter the Lieutenant Governor in Council considers necessary or advisable to carry out the purpose of this Act. Coming into force 10 This Act comes into force on the day it receives royal assent.
