A repair shop operator may notify the owner of repaired goods after they go unclaimed for three months, sell the goods if the charges are unpaid, and keep any balance for a further three months before depositing it with the Minister of Finance if still unclaimed.
The Repair Shops Act, C.C.S.M. c. R90 bilingual version (HTML) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows: When owner of goods left to be repaired may be notified of intention to sell 1 Where goods have been left with a manufacturer, keeper of a repair shop, a person operating a business with a manufacturing or repair department in connection therewith, or a person operating a business who sends goods out to be worked upon, for alterations, repairs, or to be added to, if the goods so left have been actually altered, repaired, or added to, and have not been called for or claimed by the owner thereof, the owner's representative, servant, or agent, within three months next after the goods were altered, repaired, or added to, or were to be ready for delivery, the person with whom the goods were so left may notify the owner thereof, by sending a registered letter addressed to the owner or their representative at their last known address, that the goods are ready for delivery and that they will be sold three months from the date of mailing of the notice, unless the charges against the goods are sooner paid. Sale of goods 2(1) At the end of the three months the person with whom the goods were so left, may sell the goods, either by private sale or by auction, and out of the proceeds thereof, pay all charges against the goods and the cost of advertising, if any, and selling them. Disposal of balance of proceeds 2(2) The balance of the proceeds, if any, shall be kept by the person who made the sale for a further period of three months to be paid over to the person entitled thereto. Disposal of unclaimed balances 3(1) In default of the balance being claimed before the expiration of the period last aforesaid, it shall be deposited with the Minister of Finance and form part of the Consolidated Fund. Time for making claim 3(2) The balance may be claimed by the person entitled thereto, at any time within six years from the date of the deposit.
