This Act lets the Minister of Justice appoint commissioners, requires commissioners to perform conference and reporting duties, and says commissioners receive no compensation but may be reimbursed for eligible expenses.
The Uniform Law Conference Commissioners Act, C.C.S.M. c. U30 bilingual version (HTML) WHEREAS, to facilitate the carrying on of business in Canada it is desirable that there should be uniformity of provincial legislation on subjects relating thereto; THEREFOR HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows: Appointment of commissioners 1(1) The Minister of Justice may appoint as members of the Uniform Law Conference of Canada (hereinafter referred to as "commissioners") suitable members of the Bar of the province. Terms of office 1(2) Subject to subsection (3), each commissioner, unless the commissioner sooner resigns or is removed from office or unless the Minister of Justice appoints a commissioner for a shorter term, shall hold office for three years from the date of their appointment and thereafter until their successor is appointed. Vacancies 1(3) Where a commissioner dies, resigns, or is removed from office, before the expiration of the period for which they were appointed, any person appointed to fill the vacancy in the office shall have the qualifications hereinbefore stated and shall be appointed for the unexpired balance of the term of office of the person in whose place they were appointed. Duty of commissioners 2 The commissioners shall (a) examine the following subjects: Incorporation of companies, insurance, assignments for the benefit of creditors and the discharge of debtors, frauds on creditors, extra-provincial judgments and their enforcement, partnership, sales and transfer, mortgage and pledge of property real and personal, the execution and probate of wills, and other subjects upon which uniformity is desirable, and also examine the criminal law of Canada and the administration thereof, and make to the Minister of Justice of Canada and to the respective attorneys-general of the provinces of Canada such reports and recommendations as to the commissioners shall seem advisable; (b) meet annually in conference with the commissioners appointed for the same purpose by any other province, and with The Canadian Bar Association where expedient, concerning the matters above mentioned and concerning the drafting of uniform laws to be submitted for approval and adoption by the Legislatures of the several provinces; and (c) join with the other commissioners, and where expedient with the association, in such measures as may be deemed most expedient to advance the purposes hereinbefore mentioned. 3 [Repealed] S.M. 2010, c. 33, s. 68 . No compensation for services 4(1) No commissioner shall receive any compensation for their services but they shall be paid out of the Consolidated Fund, upon a certificate approved by the Minister of Justice, the amount of the travelling and other personal expenses necessarily incurred by the commissioner in the discharge of their official duties. Payment of expenses 4(2) There may be paid out of the Consolidated Fund with moneys authorized under an Act of the Legislature to be so paid and applied, the expenses of printing and clerical assistance incurred by the commissioners in their work and the province's share of expenses of the work carried on by the Uniform Law Conference of Canada.
