NEWFOUNDLAND AND LABRADOR REGULATION 60/07 Physiotherapy Regulations under the Physiotherapy Act, 2006 Amended by: 23/22 NEWFOUNDLAND AND LABRADOR REGULATION 60/07 Physiotherapy Regulations under the Physiotherapy Act, 2006 (Filed May 8, 2007 ) Under the authority of section 9 of the Physiotherapy Act, 2006, the Council of the Newfoundland and Labrador College of Physiotherapists, with the approval of the Minister of Health and Community Services, makes the following regulations. These regulations may be cited as the Physiotherapy Regulations . 60/07 s1 Back to Top Definition 2. In these regulations, "Act" means the Physiotherapy Act, 2006. 60/07 s2 Back to Top Registration categories 3. An applicant for registration as a physiotherapist may be granted (a) active registration; (b) conditional registration; (c) temporary registration; or (d) inactive registration. 60/07 s3 Back to Top Active registration 4. (1) An applicant may be granted active registration as a physiotherapist where the applicant applies for active registration on the prescribed form and (a) successfully completes the required academic program from a school of physiotherapy approved by the council; (b) successfully completes a course of clinical practice in physiotherapy satisfactory to council; (c) successfully completes the examinations required by the council; (c.1) provides proof, in the form set by the council, that the applicant has completed a mentorship program under subsection 5(5) in the manner and for the duration approved by the council; (d) provides a certificate of conduct acceptable to the council; (e) completes a declaration of conduct as required by the council which is satisfactory to the council; (f) provides proof of having obtained professional liability insurance satisfactory to council or a statement from an insurer of an intention to provide insurance; (g) provides proof of membership in the Canadian Physiotherapy Association; and (h) pays the required fees. (2) An applicant who has been previously registered in this jurisdiction or another jurisdiction recognized by the college may be granted active registration as a physiotherapist where the applicant meets the requirements of subsection (1) and (a) provides evidence of good standing from all jurisdictions where the applicant has been registered in the past 5 years; (b) provides proof, as determined necessary by council, that the applicant has completed a minimum number of hours or physiotherapy practice in the previous 5 years which are considered to be acceptable by the council; and (c) meets the continuing competency requirements set by the council. (3) Notwithstanding paragraph (1)(c) an applicant who has not written the examinations required by the council may be granted active registration where the applicant (a) was a member of the college on or before April 1, 2000 ; (b) was registered with another physiotherapy regulatory body in Canada on or before April 1, 2000 ; or (c) is eligible for registration under the alternate accommodation mechanisms negotiated with other Canadian jurisdictions as accepted by the council. 60/07 s4 ; 23/22 s1 Back to Top Conditional registration 5. (1) An applicant may be granted conditional registration as a physiotherapist where the applicant applies for conditional registration in the prescribed form and (a) passes the written examination required by the council; (b) complies with the "Conditions of Registration" and "Conditions of Practice" for conditional registration approved by the council; (c) provides proof of having obtained professional liability insurance satisfactory to the council or a statement from an insurer of an intention to provide insurance; and (d) pays the required fees. (2) Notwithstanding subsection (1), an applicant who has been previously registered in this jurisdiction or another jurisdiction recognized by the college and who meets the requirements of subsection 4(1), but who has not met the requirements for active registration under subsection 4(2), may be granted conditional registration where that applicant enters and completes a remediation program approved by the council. (3) A conditional registration may be reviewed, revised or revoked by the council where the circumstances under which the conditional registration was given change. (4) A person holding a conditional registration shall not serve as a member of the council, sit on college committees or be entitled to vote at meetings of the college. (5) A person holding a conditional registration shall not practice physiotherapy unless the person is mentored, in a manner acceptable to the council, by a person with active registration as a physiotherapist whose registration is not subject to conditions or restrictions. 60/07 s5 ; 23/22 s2 Back to Top Temporary registration 6. (1) An applicant may be granted a temporary registration where the applicant applies for temporary registration in the prescribed form and (a) provides proof satisfactory to council that the applicant has qualifications appropriate to the specific purpose for registration as a physiotherapist in this province; (b) provides proof where required by council that the applicant is in good standing with another physiotherapy regulatory body; (c) provides proof that the applicant carries appropriate professional liability insurance during the period of practice in this province at a minimum coverage determined by council; and (d) pays the required fees. (2) Where a person has been granted temporary registration under this section, that person shall practice physiotherapy only within the scope of practice and on those terms and conditions prescribed by the council in the temporary registration. (3) A person holding a temporary registration shall not serve as a member of council, sit on college committees or be entitled to vote at meetings of the college. 60/07 s6 ; 23/22 s3 Back to Top Inactive registration 7. (1) A physiotherapist may be registered as an inactive member and use the designation "physiotherapist" where the physiotherapist meets the requirements for active membership under section 4, except paragraphs 4(1)(f) and (g). (2) An inactive member shall not practice physiotherapy. (3) An inactive member may serve as a member of council and be appointed by council to college committees. 60/07 s7 ; 23/22 s4 Back to Top Registration certificate 8. A certificate of registration or a renewal of a certificate of registration is valid for the period stated on the certificate unless registration is subsequently suspended or cancelled. 60/07 s8
