About this statute

This Act gives people a right to request access to public-body records, and requires public bodies to help applicants and keep applicant identity confidential. Public bodies must respond to access requests within 20 business days, may extend in some cases, and must not charge a fee for translating a record into an Official Language of the Northwest Territories when the Act applies. The provision limits disclosure of certain personal, business, labour-relations, and workplace-investigation information by public bodies, and sets notice, summary, and review steps. Public bodies must collect, use, disclose, protect, and correct personal information only under the Act’s limits, and some decisions can be appealed to the Supreme Court. A public body’s head must report a material privacy breach to the Commissioner and notify affected individuals when the breach creates a real risk of significant harm.
