About this statute

This part of the Act sets rules for access to certain lands and waters, creates the Surface Rights Board, and gives the Minister and Board powers and duties about appointments, reviews, and access orders. The Board can make bylaws and issue access orders, but it also has filing, audit, reporting, and fairness duties and must not use Act-based information for other purposes. The Board can and sometimes must issue access orders, set compensation, and review or amend those orders for Tåîchô lands and certain non-designated lands. The Board must make rules, give public notice of proposed rules, consider timely comments, maintain a public registry, and keep confidential material out of that registry. The Commissioner in Executive Council may make regulations on the listed matters.
