About this statute

This regulation sets required forms, fees, thresholds, and court procedure for builders’ lien matters. An affidavit must be sworn before the proper official depending on where it is sworn: inside the Northwest Territories, before a commissioner for oaths or another authorized person; outside the Northwest Territories, before a notary public or another authorized person. The bond sets notice, response, payment, and lawsuit deadlines for claims against the surety. The Bond requires the Surety and Owner to follow notice, conference, mitigation, reimbursement, and claim-timing rules, and limits the Surety’s liability. The form requires all parties to be ready for trial and to bring evidence and witnesses on the trial day. It also lists several builders’ lien registration fees, mostly $30 each.
