Disputes arising from certain agreements or awards may be referred to the Commission for arbitration, and the Commission must appoint and refer the dispute to an arbitrator or board of arbitration.

(1) Where, (a) an agreement is made by a negotiating agency established in connection with a plan under paragraph 25 of subsection 7 (1) of the Act; or (b) an award is made by a board under paragraph 27 of subsection 7 (1) of the Act, and a dispute arises out of that agreement or that award, any party to the dispute or the local board may refer the matters in dispute to the Commission and request that the matters in dispute be settled by an arbitrator or a board of arbitration. (2) Where matters in dispute are referred to the Commission under subsection (1), the reference shall be accompanied by a statement of matters in dispute in writing signed by the party or by a person authorized so to do on the party’s behalf or by the secretary or other officer of the local board, showing, (a) the names and addresses of the parties to the dispute; (b) particulars of the matters in dispute, including the times when and places where and the circumstances under which the dispute arose; (c) the provisions of the agreement or award out of which the dispute arose; and (d) the matters to be settled by an arbitrator or a board of arbitration. R.R.O. 1990, Reg. 389, s. 1 (2). 2. (1) Where the Commission receives a statement of matters in dispute, the Commission, if it is of the opinion that the dispute is in respect of matters arising out of an agreement or award in force at the time the dispute arose and no provision is made in the agreement or award for the settlement of such dispute, shall appoint an arbitrator or a board of arbitration and shall refer the matters in dispute to the arbitrator or board of arbitration, as the case may be. (2) A board of arbitration shall consist of three members, one of whom shall be a member of the negotiating committee appointed by the local board, and one of whom shall be a member of the negotiating committee appointed other than by the local board. R.R.O. 1990, Reg. 389, s. 2 (2). 3. An arbitrator or a board of arbitration appointed by the Commission under subsection 2 (1) shall make an award in respect of the matters submitted to it.
