This provision sets administrative penalty amounts for ticket businesses and says the Director must wait at least seven days before issuing a further penalty order for the same contravention.
Interpretation 1. (1) In this Regulation, “order” means an order made under subsection 30 (1) of the Act; (“ordonnance”) “prescribed provision” means a provision of the Act set out in Column 1 of Schedule 1 to this Regulation. (2) The contravention of each prescribed provision is classified as minor, moderate or major as indicated opposite the prescribed provision in Column 2 of Schedule 1 to this Regulation. O. (1) For the purposes of this section, the base amount of an administrative penalty for a contravention of a prescribed provision by a ticket business is, (a) if the contravention of the prescribed provision constitutes a minor contravention, (i) $300, in the case of a ticket business that is not a corporation, and (ii) $3,000, in the case of a ticket business that is a corporation; (b) if the contravention of the prescribed provision constitutes a moderate contravention, (i) $500, in the case of a ticket business that is not a corporation, and (ii) $5,000, in the case of a ticket business that is a corporation; and (c) if the contravention of the prescribed provision constitutes a major contravention, (i) $1,000, in the case of a ticket business that is not a corporation, and (ii) $10,000, in the case of a ticket business that is a corporation. (2) For the purposes of subsection 30 (3) of the Act, the amount of an administrative penalty for a contravention of a prescribed provision is, (a) in the case of a first order issued against the ticket business for a contravention of the prescribed provision, the base amount; (b) in the case of a second order issued against the ticket business for a contravention of the prescribed provision, one and half times the base amount; and (c) in the case of a third or subsequent order issued against the ticket business for a contravention of the prescribed provision, two and a half times the base amount. (3) If 24 months have elapsed without an order having been issued against a ticket business for the contravention of a prescribed provision, any previous order issued against the ticket business for a contravention of the prescribed provision shall not be taken into account for the purposes of subsection (2). (1) If the Director is satisfied that a ticket business has contravened or is contravening the same prescribed provision at any one or more times before issuing an order imposing an administrative penalty in respect of the contraventions, the order shall treat the contraventions as a single contravention. (2) If the Director issues an order imposing an administrative penalty in respect of the contravention by a ticket business of a prescribed provision and if the Director is satisfied that business is subsequently in contravention of the same provision, the Director shall not issue an order imposing an administrative penalty in respect of the subsequent contravention until at least seven days have passed since the day that the first order has been served on the business. An order imposing an administrative penalty against a ticket business shall specify that the business is required to pay the penalty within 30 days of being served with the order imposing the penalty. 4.
