(1) In this Regulation, “CSA” means the CSA Group; (“CSA”) “elevating work platform” is any machine or device intended for moving persons, tools and materials to working positions, typically powered by hydraulic or electric systems and includes mast climbing work platforms, mobile elevating work platforms and vehicle mounted aerial devices; (“plateforme de travail élévatrice”) “mast climbing work platform” is a machine or device intended to be installed in a fixed location with hold-to-run controls located on an open carrier type platform that are intended to be operated by workers on the platform of the device to vertically transport material and persons to working levels on a structure, and includes a mast climbing transport platform; (“plateforme de travail élévatrice sur mât”) “mobile elevating work platform” is a mobile machine or device intended for moving persons, tools and materials to working positions, consisting of at least a work platform with controls, an extending structure and a chassis, and includes elevating rolling work platforms, self-propelled elevating work platforms and boom-type elevating work platforms; (“plateforme élévatrice mobile de personnel”) “vehicle mounted aerial device” is a machine or device installed on a chassis, primarily used to position workers at an elevated working position and includes extensible boom aerial devices, aerial ladders, articulating boom aerial devices, vertical towers and any combination of such devices. (“engin élévateur à nacelle porté sur véhicule”) (2) In this Regulation, a requirement that something be done in accordance with good engineering practice includes a requirement that it be done in a manner that protects the health and safety of all workers. (3) In this Regulation, a requirement that a design, drawing, instruction, report, specification, opinion or other document be prepared by an engineer includes a requirement that he or she sign and seal it. Application 2. This Regulation applies to all projects. Requirements re Platforms Requirement to comply 3. (1) Subject to subsection (2), every elevating work platform shall comply with section 4. (2) Subsection (1) does not apply to, (a) suspended scaffolds or suspended work platforms; and (b) buckets or baskets suspended from or attached to the boom of a crane. Design, manufacture, use, etc. 4. (1) An elevating work platform shall be designed by an engineer in accordance with good engineering practice, (a) to meet the requirements of the applicable CSA standard set out in the Table to subsection (6); and (b) to support a minimum of 1.3 kilonewtons rated working load as determined in accordance with the applicable CSA standard set out in the Table to subsection (6). (2) An elevating work platform shall be manufactured in accordance with the design referred to in subsection (1). (3) An elevating work platform, (a) shall be tested in accordance with the applicable CSA standard set out in the Table to subsection (6); and (b) shall be inspected each day before use, in accordance with the manufacturer’s instructions by a worker trained in accordance with section 9 or 13, as applicable. (4) An elevating work platform shall only be used if an engineer has certified in writing that it complies with the CSA standard set out in the Table to subsection (6). (5) The certification required by subsection (4) shall include the details of testing. (6) The CSA standards applicable to the type of elevating work platform listed in Column 1 of the Table to this subsection are the standards set out opposite it in Column 2: TABLE Item Column 1 Type of elevating work platform Column 2 CSA standard 1. (8) An elevating work platform shall have signs that are clearly visible to an operator at its controls indicating, (a) the rated working load; (b) all limiting operating conditions, including the use of outriggers, stabilizers, and extendable axles; (c) the specific firm level surface conditions required for use in the elevated position; (d) such warnings as may be specified by the manufacturer; (e) other than for a boom-type elevating work platform, the direction of machine movement for each operating control; (f) the name and number of the CSA standard to which it was designed; and (g) the name and address of the owner. Maintenance Maintenance 5. (1) The owner of an elevating work platform shall maintain it such that the safety factors of the original design are maintained. (2) The owner of an elevating work platform shall keep a permanent record of all inspections, tests, repairs, modifications, and maintenance performed on it. (3) The permanent record required by subsection (2), (a) shall be kept up to date; (b) shall include complete records from the more recent of, (i) the date of purchase, or (ii) May 10, 1991; and (c) shall include the signature and name of the person who performed the inspection, test, repair, modification, or maintenance. Inspection 6. A maintenance and inspection record tag, (a) shall be provided and attached to the elevating work platform near the operator’s station; and (b) shall include, (i) the date of the last maintenance and inspection, (ii) the signature and name of the person who performed the maintenance and inspection, and (iii) an indication that the maintenance has been carried out in accordance with the manufacturer’s recommendations. Use 7. (1) An elevating work platform, (a) shall not be loaded in excess of its rated working load; (b) shall be used and moved only in accordance with the manufacturer’s written instructions; (c) shall not be loaded or used in such a manner as to affect its stability or endanger a worker; (d) shall not be moved unless all workers on it are protected from ejection by being attached to an adequate anchorage point on the elevating work platform by a method of fall protection; and (e) shall not be used, in the case of a self-propelled or vehicle-mounted boom-type elevating work platform or a vehicle-mounted aerial device, unless all workers on it are attached to an adequate anchorage point on the elevating work platform by a method of fall protection. (2) Clause (1) (d) does not apply to, (a) a mast climbing work platform, if the platform has guardrails protecting all open sides of the platform where a worker is exposed to a hazard of falling 2.4 metres or more; and (b) a vehicle-mounted aerial device if the non-conductive requirements of the basket prevent the placement of an anchorage attachment inside the basket. Operator’s manual 8. The operator’s manual for an elevating work platform shall be kept with it while it is on a project. Training – Mobile Elevating Work Platforms Training program 9. (1) An employer shall ensure that a worker who operates any mobile elevating work platform completes the training program described in section 10 before operating it for the first time. (2) If the training program described in section 10 was not provided with respect to the make and model of the mobile elevating work platform that the worker will use at the workplace, then an employer shall ensure that the worker is familiarized with that specific make and model of equipment in accordance with section 11. (3) The training program described in section 10 is valid for five years from the date of successful completion of the training program. Training program, group and type of equipment 10. (1) A training program for the operation of a mobile elevating work platform shall include training for each group and type of equipment that a worker will operate and must consist of both theory and practical training that addresses the following: 1. The safe movement of the equipment under structures to avoid trapping or crushing anyone on the platform. 2. The proper conduct of a risk assessment process related to a workplace and the work to be performed. 3. The selection of an appropriate mobile elevating work platform for the work to be performed. 4. The purpose and use of a manufacturer’s operator’s manual, placards, decals and applicable standards. 5. Proper storage and maintenance of an operator’s manual. 6. Inspection and maintenance requirements, including pre-start inspection requirements. 7. Factors affecting the stability of the mobile elevating work platform in all operation configurations. 8. Hazard identification and avoidance, including daily workplace inspections. 9. The intended purpose and function of device controls, including emergency controls. 10. Addressing problems or malfunctions affecting the operation of the device. 11. Use of personal protective equipment, including fall protection equipment, appropriate to the task and the conditions at the workplace. 12. Safe travelling procedures and route inspections. 13. Loading and unloading procedures for transport. 14. Securing the device from unauthorized use. 15. Worker rescue procedures. 16. The importance of workers familiarizing themselves with the device and accessories prior to operation. 17. The importance of providing instructions to any occupants of the device to work safely, including the following: i. Use of appropriate fall protection equipment and the location of anchorage. ii. Factors affecting stability. iii. Safe use of device accessories. iv. Site-specific work procedures. v. Hazards and their avoidance, including any applicable site risk assessment. vi. General knowledge of the intended purpose and function of device controls, including emergency shutdown and lowering procedures. vii. The manufacturer’s specific warnings and instructions related to the work to be completed. viii. The location of the manufacturer’s operator’s manual. (2) A training program for the operation of a mobile elevating work platform shall include methods for evaluating a worker’s ability to operate the equipment and must require a worker to demonstrate proficient operation of the equipment. (3) If, before the day this Regulation comes into force, a worker completed training for a mobile elevated work platform that meets the requirements of section 147 of Ontario Regulation 213/91 (Construction Projects) for the group and type of equipment that the worker uses, the worker does not need to complete the training program described in this section until five years after the date that training was completed. Familiarization 11. (1) If a training program described in section 10 was not provided with respect to the make and model of mobile elevating work platform that the worker will use at the workplace, the employer shall ensure that the worker is familiar with the following with respect to that specific make and model of platform: 1. The location of the manufacturer’s operator’s manuals. 2. The manufacturer’s specific warnings and instructions related to the work to be completed. 3. The functions of specific commands for the device. 4. The functions of specific safety mechanisms for the device. 5. Any specific operating characteristics of the device. 6. Verification that an annual inspection of the device and components was conducted. Records 12. (1) An employer shall maintain written records of the training described in section 10 that includes the following: 1. The type of equipment covered in the training. 2. The date the training was provided. 3. The name of the worker who received the training. 4. The name and signature of the instructor. (2) The employer shall make the training record for each worker available to an inspector on request. (3) If a worker completes a training program described in section 10 for an employer, the employer shall, at the request of the worker, provide the worker with written proof of completion of the training. (4) If a worker is no longer performing work for an employer, but within 3 years after the training is delivered, the worker requests the written proof described in subsection (3), the employer shall provide it to the worker. Training – Other Elevating Work Platforms Oral and written instruction 13. (1) Before operating an elevating work platform other than a mobile elevating work platform for the first time, a worker shall be given oral and written instruction on the operation and be trained to operate that group and type of work platform. (2) The instruction and training required by subsection (1) shall include, (a) the manufacturer’s instruction; (b) instruction in the load limitations; (c) instruction in and a hands-on demonstration of the proper use of all controls; and (d) instruction in the limitations on the kinds of surfaces on which it is designed to be used. 14.
