Registrants may use the Authority’s visual mark only in the allowed way and must follow detailed use, display, notice, audit, and removal rules.
Interpretation 1. For the purposes of the Act and this Regulation, “visual mark” means a visual mark or other identifier issued by the Authority for a class of registrants. Issuance 2. The Authority may issue visual marks for the purpose of identifying that an individual registrant is registered in one or more specific classes of registration. Authorization 3. (1) A registrant may only use a visual mark that is associated with the registrant’s class of registration. (2) A registrant may display the visual mark for their class of registration, in its unaltered form, on an identification badge, card, pin or similar item when providing health and supportive care services, and in printed and digital promotional materials. Conditions of use 4. Every registrant shall comply with the following conditions of use and display with respect to visual marks for their class of registration: 1. The registrant shall not provide permission to any other individual or organization to use the visual mark. 2. The registrant’s use of the visual mark must be limited to identification items or promotional materials specific to the health and supportive services provided by the registrant in the class for which they are registered. 3. A registrant associated with a group of practitioners shall ensure that the visual mark is not used on a website or other promotional materials that offer services delivered by practitioners who are not registered with the Authority, but, for greater certainty, the registrant may use the visual mark on individual web pages within a website if those pages solely promote the registrant’s services. 4. The registrant shall immediately notify the Authority if they become aware of any unauthorised use of the visual mark. 5. The registrant shall ensure that when using the visual mark, they do not alter, adapt or modify it in any way, apart from resizing it proportionally. 6. The registrant shall ensure that the visual mark is legible when they use or display it. 7. On cancellation, expiration or revocation of registration the registrant shall remove all instances of the visual mark from any materials and identification used by or associated with them. 8. The registrant shall not use the visual mark while their registration is suspended. 9. The registrant shall provide the Authority with such information regarding the use of the visual mark as the Authority may from time to time require. 10. The registrant shall permit an authorized representative of the Authority to conduct an audit, on reasonable notice and during regular business hours, of the uses to which the registrant is putting the visual mark. 11. The registrant shall comply with section 35 of Ontario Regulation 215/24 (Code of Ethics) made under the Act, as it relates to the visual mark. 5.
