This Order applies to specific lands in Springwater and restricts land use there, except for listed permitted uses.
Definition 1. In this Order, “zoning by-law” means Zoning By-law No. 5000 of the Township of Springwater. Application 2. This Order applies to lands in the Township of Springwater in the County of Simcoe, in the Province of Ontario, being the lands outlined in red on a map numbered 372 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street. Permitted uses 3. Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in section 2, except for the following uses: 1. The uses permitted in the Urban Residential (UR2) Zone under section 10 of the zoning by-law. 2. The uses permitted in the Environmental Protection (EP) Zone under section 32 of the zoning by-law. 3. Home occupations. 4. Public uses. 5. Model homes. Zoning requirements 4. (1) The following zoning requirements apply to the uses permitted under paragraphs 1, 3, 4, and 5 of section 3: 1. The zoning requirements for the Urban Residential (UR2) Zone set out in section 10.3 of the zoning by-law, except that the minimum side yard setback is 1.2 metres on one side and 0.6 metres on the other side for single detached dwellings and semi-detached dwellings. 2. The sight triangle requirements set out in section 3.22 of the zoning by-law do not apply where a sight triangle has been incorporated into the road allowance at a corner intersection. On a corner lot, sight triangles shall have a minimum size of 3 metres by 3 metres. Within these triangular spaces, no hedge, shrub, tree, fence, sign or other such structures shall be planted, maintained or erected. Where a sight triangle exists, yards are measured from the point of the intersection to the extension of the lot lines. 3. The calculation of building height does not include the following: i. Cupolas, finials, weather vanes or similar features. ii. Light standards. iii. Lightning rods. iv. Parapets. v. Skylights. vi. Transmission or telecommunication towers, antennas or similar structures. 4. Swimming pools are permitted in rear and side yards if no part of the pool is located closer to any lot line or street line than the minimum distance required for the principal building located on the same lot. 5. Architectural elements of buildings, including sills, belt courses, cornices, gutters, chimneys, pilasters, eaves, parapets, canopies or fireplaces, may encroach by a maximum of 0.6 metres into any yard. 6. Window bays may encroach by a maximum of 0.9 metres into the front, rear and exterior side yards. 7. Balconies may encroach by a maximum of 1.8 metres into front, rear and exterior side yards. 8. Porches, including access stairs from grade, eaves and cornices, may encroach into the front, rear and exterior side yards if there is a minimum setback of 0.6 metres from any lot line. 9. Exterior stairs providing access to a building or structure may encroach by a maximum of 2.5 metres into front, rear and exterior side yards. 10. Decks, including access stairs from grade, may encroach into the rear yard by a maximum of 2.5 metres from a lot line and interior side yards and by a maximum of 0.6 metres from any lot line. 11. Air conditioners, heat pumps and swimming pool pumps, filters and heaters may encroach by a maximum of 0.6 metres from any lot line into rear and exterior side yards. 12. Rain barrels and rain harvesting system components may encroach by a maximum of 0.6 metres from any lot line into rear, exterior side and interior side yards. 13. Coach houses may encroach by a maximum of 1.2 metres from any lot line into any yard. (2) The zoning requirements of the Environmental Protection (EP) Zone set out in section 32.3 of the zoning by-law apply to the uses permitted under paragraph 2 of section 3 of this Order. Terms of use 5. (1) Every use of land and every erection, location and use of buildings or structures shall be in accordance with this Order. (2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force. (3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased and its original use is not altered. (4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure. Deemed by-law 6. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the Township of Springwater. 7. Omitted (provides for coming into force of provisions of this Regulation).
