Definitions In this Act (a) “Chief Electoral Officer” means the Chief Electoral Officer appointed pursuant to section 2 of the Election Act R.S.P.E.I. 1988, Cap. E-1; (b) “Commission” means an Electoral Boundaries Commission established under section 8; (c) “district” means an electoral district established pursuant to this Act; (d) “Register of Electors” means the Register of Electors established and maintained by the Chief Electoral Officer under section 24.1 of the Election Act. 1994, c.13, s.1; 2006,c.44,s.1. PART II — ELECTORAL DISTRICTS 2. Electoral districts (1) The province, for the purpose of the election of members to serve in the Legislative Assembly, is divided into twenty-seven districts, with the names, district numbers and boundaries as set out in the Schedule. Single member districts One member shall be returned to the Legislative Assembly for each district. 1994, c.13, s.6. 7. Municipalities A reference by name to any municipality in the Schedule means that municipality as it exists with the area and boundaries that it has on the date this section comes into force. 1994, c.13, s.7; 2006,c.44,s.4. PART III — ELECTORAL BOUNDARIES COMMISSION 8. Electoral Boundaries Commission, establishment (1) The Lieutenant Governor in Council shall establish an Electoral Boundaries Commission within 18 months following the general election of May 4, 2015, and within one year following ordinary polling day of each third general election after that general election. Membership of Commission (2) A Commission shall be broadly representative of the population of the province and shall consist of (a) a chairperson, appointed by the Lieutenant Governor in Council, who is a judge or retired judge of the Supreme Court of Prince Edward Island; (b) two persons, appointed by the Speaker of the Legislative Assembly on the nomination of the Leader of the Opposition, after consultation with the leader of any other political party registered under section 24 of the Election Act that is represented in the Legislative Assembly, who are not (i) members of the Legislative Assembly, (ii) members of the Parliament of Canada, or (iii) employees of the Government of Prince Edward Island; and (c) two persons, appointed by the Speaker of the Legislative Assembly on the nomination of the Premier, who are not (i) members of the Legislative Assembly, (ii) members of the Parliament of Canada, or (iii) employees of the Government of Prince Edward Island. 1994, c.13, s.8; 2006,c.44,s.5; 2008,c.10,s.1; 2015,c.4,s.1; 2016,c.1,s.1. 9. Functions A Commission shall, in accordance with this Part, review the districts of the province, and make a report to the Legislative Assembly setting out its recommendations as to the area, boundaries, and names of the districts of the province. 1994, c.13, s.9. 10. Remuneration (1) Each member of a Commission, including the chairperson if he or she is a retired judge, shall be paid such remuneration as may be determined by the Lieutenant Governor in Council. Page 6 Current to: March 26, 2019 t c PART III — ELECTORAL BOUNDARIES COMMISSION Electoral Boundaries Act Section 11 Expenses (2) Each member of a Commission, including the chairperson, is entitled to be paid reasonable travelling and living expenses while away from the member’s ordinary place of residence in the course of his or her duties as a member, at such rates as may be determined by the Lieutenant Governor in Council. 1994, c.13, s.10. 11. Administrative support There shall be made available to a Commission such advisers, clerks, and assistants, as may be required to enable it to discharge its functions. 1994, c.13, s.11. 12. Vacancy If a vacancy in the membership occurs, through inability to act, resignation or otherwise, the vacancy may be filled in accordance with subsection 8(2). 1994, c.13, s.12; 2016,c.1,s.2. 13. Assistance of Chief Electoral Officer A Commission may request the Chief Electoral Officer to provide any information possessed by his or her office, and any other assistance that a Commission considers necessary, and the Chief Electoral Officer shall comply with any reasonable request. 1994, c.13, s.13. 14. Powers Each member of a Commission has the powers of a commissioner under the Public Inquiries Act R.S.P.E.I. 1988, Cap. P-31. 1994, c.13, s.14. 15. Public hearings (1) A Commission shall hold public hearings throughout the province at such times and places as it considers appropriate to enable representations to be made by any person as to the area and boundaries of any district. Notice (2) A Commission shall give reasonable public notice of the time, place and purpose of any such public hearings. 1994, c.13, s.15. 16. Procedure A Commission may regulate its own proceedings and the conduct of its business. 1994, c.13, s.16. 17. Criteria (1) Subject to subsection (2), in determining the area to be included in, and in fixing the boundaries of a district, a Commission shall take into consideration (a) the Canadian Charter of Rights and Freedoms; (b) data from the Register of Electors; (c) polling divisions from the most recent general election; (d) geographical features; (e) information pertaining to population; c t Current to: March 26, 2019 Page 7 PART IV — GENERAL Section 18 Electoral Boundaries Act (f) community of interest; (g) municipal boundaries; (h) public input; and (i) guidelines or criteria proposed for the consideration of the Commission by resolution of the Legislative Assembly, and may consider such other factors as it regards as relevant. 2006,c.44,s.6. Number of electors (2) The number of electors of a proposed district shall not be more than 25 per cent above, nor more than 25 per cent below the average number of electors of all the proposed districts. 1994, c.13, s.17. 18. Report (1) Within six months of its establishment, a Commission shall prepare and, subject to subsection (2), submit its report to the Speaker of the Legislative Assembly, who shall lay a copy thereof before the Legislative Assembly forthwith, if it is then in session, and, if not then in session, within seven days of the opening of the next session. Enlargement of time (2) The Lieutenant Governor in Council may, at the request of a Commission, extend the time for submission of the report for a period not to exceed three months. Public document (3) The report of a Commission is a public document. 1994, c.13, s.18. 18.1 New electoral districts After the Speaker of the Legislative Assembly lays a copy of the report of a Commission before the Legislative Assembly, the Legislative Assembly shall, by resolution, approve of the proposals of the Commission, as set out in the Commission’s report, and the Government shall, at the same session during which the resolution is made, introduce a Bill to establish new electoral districts in accordance with the resolution and the proposals of the Commission. 2006,c.44,s.7. PART IV — GENERAL 19. Consequential amendments Consequential amendments. 1994, c.13, s.19. 20. Transitional The Chief Electoral Officer shall, for the general election next following the enactment of this section, divide each district into as many polling divisions as necessary, giving due consideration to the matters set out in section 16 of the Election Act, and shall, until the appointment of the returning officers for the districts, stand in the stead of those returning officers for the purpose of making all reasonable preparations for the transition from the districts that were established by this Act immediately before the date this section comes into Page 8 Current to: March 26, 2019 t c PART IV — GENERAL Electoral Boundaries Act Section 20 force to the districts that are established by this Act on the date this section comes into force. 1994, c.13, s.20; 2006,c.44,s.8. c t Current to: March 26, 2019 Page 9 Electoral Boundaries Act SCHEDULE SCHEDULE 1. (1) Unless the context requires otherwise, words used in this section have the same meaning as in the Emergency 911 Act R.S.P.E.I. 1988, Cap. E-5.1. (2) In this Schedule “civic address community” means an area or municipality the name of which is used in a civic address. (3) The civic address assigned to a property pursuant to the Emergency 911 Act determines the electoral district in which the property is located. 2.
