About this statute

This part gives individuals a right to access and ask for correction of their personal health information, and sets rules for custodians to respond, verify identity, and handle refusals. Custodians generally need legal authorization or consent to collect, use, or disclose personal health information, but the Act allows several consent-based and exception-based uses and disclosures. Custodians must keep, protect, log, and limit use/disclosure of personal health information, and the Minister/Commissioner have related access and oversight powers. This section lets a custodian employee report certain confidential personal health information to the Commissioner, protects the employee from retaliation in specified cases, and sets limits on identity disclosure, offences, fees, and regulation-making powers.
