If you find any errors or omissions in this consolidation, please contact: Legislative Counsel Office Tel: (902) 368-4292 Email: legislation@gov.pe.ca Public Health Act Recreational Camp Regulations Section 1 c PUBLIC HEALTH ACT Chapter P-30.1 RECREATIONAL CAMP REGULATIONS Pursuant to section 72 of the Public Health Act R.S.P.E.I. 1988, Cap. P-30.1, Council made the following regulations: 1. Definitions In these regulations (a) “Act” means the Public Health Act R.S.P.E.I. 1988, Cap. P-30.1; (b) “Minister” means the Minister of Health and Wellness; (c) “operator” means a person who, either alone or through an agent, owns or operates, or proposes to own or operate, a recreational camp; (d) “recreational camp” means a camp for recreational, educational, social, cultural or religious activities that consists of one or more cabins, buildings or structures established or maintained as living quarters for temporary occupancy of 3 or more days, with or without charge, and includes a camping program, but does not include a tourist establishment as defined in the Tourism Industry Act R.S.P.E.I. 1988, Cap. T-3.3; (e) “waste” means materials discarded by persons in the course of their daily activities. (EC416/15) 1.1 Cleaning and sanitation policy (1) An operator shall establish, maintain and follow a written policy with respect to the cleaning and disinfection of a recreational camp. Contents of policy (2) A written policy referred to in subsection (1) shall include, but need not be limited to, (a) procedures for (i) cleaning and disinfecting frequently used items and surfaces, such as light switches, doorknobs and countertops, (ii) monitoring for pests, and (iii) maintaining shower rooms and bunkhouses in a sanitary condition; (b) a schedule on which the procedures referred to in clause (2)(a) shall be carried out; and (c) a list of approved cleaning and disinfection agents and, for each approved agent, c t Current to: November 23, 2024 Page 3 Section 2 Public Health Act Recreational Camp Regulations (i) the agent’s intended use, (ii) instructions with respect to mixing and concentration, where applicable, and (iii) storage requirements. Records (3) An operator shall establish a record of each time a procedure referred to in this section is carried out. Retention and production of records (4) With respect to a record referred to in subsection (3), an operator shall (a) retain the record for a period of at least 12 months; and (b) produce the record for inspection by a public health official on request. Waste storage (1) An operator shall ensure that all waste from the recreational camp shall be stored in covered, fly-tight and watertight containers that are adequate to contain the waste without overflowing. Removal and disposal of waste (2) An operator is responsible for the removal and disposal of waste from the recreational camp in compliance with the Environmental Protection Act R.S.P.E.I. 1988, Cap. E-9, and the Waste Resource Management Regulations. (EC416/15) 3. Water supply An operator shall provide (a) a supply of hot and cold potable water that is adequate in quantity and pressure to meet the requirements of the recreational camp; and (b) a waste water system for the recreational camp that operates in compliance with the requirements of the Environmental Protection Act and the Sewage Disposal Systems Regulations. (EC416/15) 4. Toilet, minimum requirements (1) An operator shall provide a minimum of one toilet for every twenty-four persons of each sex. Partition for privacy (2) Where there is more than one toilet, an operator shall provide a partition between the toilets constructed in such a manner as to ensure privacy. Tissue, etc. (3) An operator shall provide toilet tissue and suitable dispensers for each toilet. Urinals (4) An operator may substitute urinals for one-half the required number of toilets that are intended solely for male use. Sanitation (5) An operator shall ensure that all toilet facilities are maintained in a sanitary condition at all times. Page 4 Current to: November 23, 2024 t c Public Health Act Recreational Camp Regulations Section 5 Wash basin requirements (6) An operator shall provide at least one wash basin, with hot and cold running potable water, single-use soap in a dispenser and single-service disposable towels in a dispenser for every two toilets or combination of toilets and urinals, with a minimum of one wash basin for each sex. Location of toilets (7) An operator shall ensure that toilets are located in a well constructed building with impervious flooring and screened windows and exterior doors. (EC416/15) 5. Construction of floors (1) An operator shall ensure that floors of permanent buildings used for living, sleeping, kitchen or dining areas at a recreational camp, if not built on solid concrete or rodent-proof foundations, are built at least twelve inches above the ground. Idem, materials (2) An operator shall ensure that floors, if not built of concrete, are constructed of impervious materials. (EC416/15) 6. Windows, screened openings (1) An operator shall ensure that every living room, sleeping room, kitchen and dining room shall have one or more windows or screened openings to provide a reasonable movement of air. Idem, aggregate area (2) An operator shall ensure that the aggregate area of windows or screened openings in sleeping areas is equal to not less than one-tenth of the floor area. Screens required (3) An operator shall ensure that exterior doors and windows of all buildings in the recreational camp are screened. (EC416/15) 7. Air space (1) An operator shall ensure that there is a minimum of three hundred cubic feet (8.495 cubic metres) of air space provided for each occupant in sleeping rooms. Separate bed (2) An operator shall ensure that there is a separate bed or bunk for each occupant. Clear space (3) An operator shall ensure that there is at least three feet (.91 metre) of clear space between beds or bunks. Mattresses (4) An operator shall ensure that, where the operator provides a mattress to an occupant, (a) the mattress (i) is constructed of a washable material, and (ii) has been washed between occupants; or c t Current to: November 23, 2024 Page 5 Section 8 Public Health Act Recreational Camp Regulations (b) the mattress is fully encased in a mattress cover that was applied between occupants. (EC416/15; 1021/24) 8. Approval by Minister (1) With respect to the construction or renovation of an area of a recreational camp that is not a food premises as defined in the Food Premises Regulations (EC616/14) under the Act, the operator shall submit a construction plan and specifications that meet the requirements of these regulations and all other applicable legislation to the Minister and obtain the Minister’s approval prior to the commencement of the construction or renovation. Approval by public health official (2) With respect to the construction or renovation of the food premises in a recreational camp, the operator shall submit a construction plan and specifications that meet the requirements of the Food Premises Regulations (EC616/14) under the Act, these regulations and all other applicable legislation to a public health official and obtain the public health official’s approval prior to the commencement of the construction or renovation. Register (1) Every operator shall establish and maintain a register which contains the name and permanent address of each guest, together with the guest’s dates of arrival at and departure from the recreational camp. Inspection (2) The register shall be open to inspection by a public health official. (EC416/15) 10.
