If you find any errors or omissions in this consolidation, please contact: Legislative Counsel Office Tel: (902) 368-4292 Email: legislation@gov.pe.ca Preamble Pei Firefighters Long Service Medal Act Section 1 c PEI FIREFIGHTERS LONG SERVICE MEDAL ACT CHAPTER F-10.1 PREAMBLE WHEREAS it is recognized that firefighters serve with dedication and selflessness in the protection of life and property within the province; AND WHEREAS it is appropriate that firefighters of long service be recognized by the award of PEI Firefighters Long Service Medals and additional bars thereto; 1. Definitions In this Act (a) “firefighter” means any person who, in the opinion of the Fire Marshal, has served in the fighting or preventing of fires; (b) “Fire Marshal” means the Fire Marshal of Prince Edward Island appointed pursuant to section 2 of the Fire Prevention Act R.S.P.E.I. 1988, Cap. F-11; (c) “municipality” means a municipality as defined in the Municipal Government Act R.S.P.E.I. 1988, Cap. M-12.1. 1999,c.8,s.1; 2016,c.44,s.271. 2. Medal There is established a PEI Firefighters Long Service Medal. 1999, c.8, s.2 3. Responsibilities of Fire Marshal The Fire Marshal shall be (a) responsible for the administration of this Act; and (b) by virtue of the office, permitted to wear a PEI Firefighters Long Service Medal. 1999,c.8,s.3. 4. Medals Committee (1) There is established a Medals Committee consisting of (a) the Fire Marshal; and (b) the chief of every fire department recognized by the Fire Marshal. Applications (2) Applications for a PEI Firefighters Long Service Medal may be made to the Medals Committee on behalf of a firefighter by (a) the chief or deputy chief of a fire department recognized by the Fire Marshal; (b) the mayor or chief administrative officer of a municipality; c t Updated December 23, 2017 Page 3 Preamble Section 5 Pei Firefighters Long Service Medal Act (c) repealed by 2016,c.44,s.271(3); or (d) any other person recognized by the Fire Marshal. Application not permitted (3) A firefighter may not apply for a PEI Firefighters Long Service Medal on the firefighter’s own behalf. Criteria (4) Applications made pursuant to subsection (2) shall (a) be in a form approved and provided by the Medals Committee; and (b) contain proof and documentation, as required by the Medals Committee, of at least 20 years service in the province as a volunteer firefighter, paid firefighter, or both. 1999,c.8,s.4; 2016,c.44,s.271. 5. Award (1) Where the Medals Committee is satisfied that the requirements of this Act have been met with regard to an application for a PEI Firefighters Long Service Medal, the Fire Marshal shall award a PEI Firefighters Long Service Medal to the firefighter satisfying the requirements. Ten-year bar (2) Where a firefighter has (a) been awarded a PEI Firefighters Long Service Medal; and (b) completed an additional 10 years service as a firefighter, the Fire Marshal shall award a bar representative of the 10 years additional service to be worn with the PEI Firefighters Long Service Medal. Additional bars (3) The Fire Marshal shall award a bar in addition to a bar awarded pursuant to subsection (2) for every 10 years of additional service completed by a firefighter, to be worn with the PEI Firefighters Long Service Medal. Application (4) This Act applies to both active and retired firefighters. 1999,c.8,s.5. 6. Offence Any person who has not been awarded a PEI Firefighters Long Service Medal or bar and who (a) wears a PEI Firefighters Long Service Medal or bar; or (b) purports to have been awarded an PEI Firefighters Long Service Medal or bar, is guilty of an offence and is liable on summary conviction to a fine of not more than $500. 1999,c.8,s.6.
