Transitional, registration ......................................................................................................................... 22 Page 4 Current to: April 1, 2026 t c PART 1 – INTERPRETATION AND ADMINISTRATION Registered Nurses and Registered Psychiatric Nurses Regulations Section 1 REGULATED HEALTH PROFESSIONS ACT CHAPTER R-10.1 REGISTERED NURSES AND REGISTERED PSYCHIATRIC NURSES REGULATIONS _____________________________________________________________________________________ Pursuant to sections 2 and 96 of the Regulated Health Professions Act R.S.P.E.I. 1988, Cap. R-10.1, Council made the following regulations: PART 1 – INTERPRETATION AND ADMINISTRATION 1. Definitions In these regulations, (a) “Act” means the Regulated Health Professions Act R.S.P.E.I. 1988, Cap. R-10.1; (b) “College” means the Prince Edward Island College of Nursing and Midwifery; (c) “Council” means the Council of the College; (d) “former regulations” means the Registered Nurses Regulations (EC350/18); (e) “nurse practitioner” means a member who is registered in the nurse practitioners register; (f) “nursing” means the health profession in which a person applies specialized and evidence-based knowledge of nursing theory and health and human sciences, skills and judgment in providing professional services to another person, including (i) the promotion, maintenance and restoration of health, and (ii) the prevention, treatment and palliation of illness and injury, primarily by (A) assessing health status, (B) planning, implementing and evaluating interventions, and (C) coordinating health services, and (iii) the research, education, management or administrative activities incidental to performing the services referred to in subclauses (i) and (ii); (f.1) “psychiatric nursing” means the health profession in which a person applies specialized and evidence-based knowledge of psychiatric nursing theory and health and human sciences, skills and judgment in providing services to another person, including (i) the promotion of mental health, (ii) the prevention, management and treatment of mental illness or developmental challenges, c t Current to: April 1, 2026 Page 5 PART 2 – REGISTERED NURSES Section 2 Registered Nurses and Registered Psychiatric Nurses Regulations (iii) the assistance of individuals, families, groups and communities to achieve an optimal state of health, and (iv) the research, education, management, or administrative activities incidental to performing the services referred to in subclauses (i) to (iii); (g) “registered nurse” means a member who is registered in the registered nurses register; (h) “registered psychiatric nurse” means a member who is registered in the registered psychiatric nurses register. (EC551/23; 755/24; 150/26) 2. Designation as regulated health profession Nursing and psychiatric nursing are designated as regulated health professions.. (EC551/23; 755/24) 3. College Revoked by EC150/26. (EC551/23; 150/26) 4. Register (1) The register for nursing is divided into the following sub-registers and classes: (a) registered nurses register (i) general class, (ii) provisional class, (iii) special class; (b) nurse practitioners register (i) general class, (ii) provisional class, (iii) special class. Register for psychiatric nursing (2) The register for psychiatric nursing contains the psychiatric nurses register, which is divided into the following classes: (a) general class; (b) provisional class; (c) special class. (EC551/23; 755/24) PART 2 – REGISTERED NURSES Registration General Class 5. General Class (1) The registrar shall register an applicant in the general class of the registered nurses register where Page 6 Current to: April 1, 2026 t c PART 2 – REGISTERED NURSES Registered Nurses and Registered Psychiatric Nurses Regulations Section 6 (a) the registrar is satisfied that the applicant meets all the requirements for registration set out in subsection 12(2) of the Act and these regulations and registers the applicant pursuant to subsection 12(3) of the Act; or (b) the Council directs the registrar to register the applicant in the general class pursuant to subsection 12(6) of the Act or reinstate the registration of the applicant in the general class pursuant to subsection 24(4) of the Act. Reinstatement period (2) For the purpose of subsection 24(1) of the Act, a former member may apply for reinstatement of registration in the general class of the registered nurses register within three years after a lapse in the registration. (EC551/23) 6. Education For the purpose of clause 12(2)(c) of the Act, the requirement for registration under this Part with respect to education is the successful completion of (a) an undergraduate degree program in nursing, approved by the Council; or (b) a nursing education program that the Council considers substantially equivalent to a program described in clause (a). (EC551/23) 7. Examination (1) For the purpose of clause 12(2)(d) of the Act, the requirement for registration under this Part with respect to an examination is the successful completion of one of the following, depending on the applicable time period: (a) where the examination was written on or after January 1, 1982, but before January 1, 2015, the Canadian Registered Nurse Examination (CRNE) or the National Council Licensing Examination for Registered Nurses (NCLEX-RN); (b) where the examination was written on or after January 1, 2015, the National Council Licensing Examination for Registered Nurses (NCLEX-RN) or, if it was not offered, a substitute competency examination approved or adopted by the Council. Successful completion of examination (2) The successful completion of an examination referred to in subsection (1) means obtaining the established pass mark or other minimum standard approved by the Council. (EC551/23) 8. Currency requirements For the purpose of clause 12(2)(f), subclause 22(2)(a)(ii) and clause 24(4)(c) of the Act, to demonstrate currency of professional knowledge and skills, an applicant under this Part shall have done one of the following within the three years preceding the application: (a) successfully completed the education requirement set out in section 6; (b) actively practised nursing as a registered nurse, without the imposition of any restrictions, in the province or another jurisdiction recognized by the Council, to an extent acceptable to the Council; (c) successfully completed a refresher program acceptable to the registrar. Insurance requirements (1) For the purpose of clause 12(2)(j), subclause 22(2)(a)(v) and clauses 24(4)(f) and 25(3)(c) of the Act, an applicant under this Part or a registered nurse, as the case may be, is required to be c t Current to: April 1, 2026 Page 7 PART 2 – REGISTERED NURSES Section 10 Registered Nurses and Registered Psychiatric Nurses Regulations eligible to or to hold or be covered by professional liability insurance or protection satisfactory to the Council that, at a minimum, (a) is issued in the name of the applicant or registered nurse or clearly extends to the applicant or registered nurse; (b) extends to any practice setting in Prince Edward Island; (c) provides protection of not less than $10,000,000 per claim or occurrence and an aggregate limit of not less than $10,000,000; (d) extends to professional liability for any professional service the applicant will be providing or the registered nurse provides in practising nursing; and (e) includes an extended reporting period of at least six years in the case of claims-based protection or a minimum retroactive date of six years in the case of occurrence-based or claims-based protection. Proof of insurance (2) An applicant or registered nurse, as the case may be, shall provide proof or ensure proof is provided to the registrar that the applicant or registered nurse is eligible to hold or be covered by or holds or is covered by, as the case may be, professional liability insurance or protection that meets the requirements of subsection (1). (EC551/23) Provisional Class 10. Provisional class (1) The Council may direct the registrar to register an applicant in the provisional class of the registered nurses register, where (a) the applicant does not meet the examination requirement in section 7, subject to the term or condition that the applicant successfully completes the examination requirement in clause 7(1)(b) within a specified time period; or (b) the applicant does not meet the requirements for currency of professional knowledge and skills in section 8, subject to the term or condition that the applicant successfully completes a refresher program, approved by the Council, within a specified time period. Renewal (2) Registration in the provisional class may be renewed if the time period specified by the Council under subsection (1) has not expired or the Council extends the time period for meeting the term or condition, and section 8 does not apply in respect of the renewal of the registration of an applicant registered pursuant to clause (1)(b). Subject to supervision (3) A registered nurse registered in the provisional class shall be supervised in practising nursing by a registered nurse registered in the general class, approved by the Council. Satisfaction of term or condition (4) Where a registered nurse satisfies the term or condition imposed under subsection (1), the registrar shall register, or renew or reinstate the registration of, as the case may be, the registered nurse in the general class. No reinstatement (5) Registration in the provisional class may not be reinstated. Special registration (1) Where the Council directs the registrar to register an applicant in the registered nurses register pursuant to subsection 13(3) of the Act, the registrar shall register the applicant in the special class. No renewal or reinstatement (2) Registration in the special class may not be renewed or reinstated. (EC551/23) Designations and Reserved Activities 12. Designations For the purpose of subsection 89(1) of the Act, (a) the designations of a registered nurse include the following titles, abbreviations and initials: (i) registered nurse, (ii) R.N. or RN, (iii) Reg. N. or Reg N; and (b) the designations of a registered nurse with special authorization pursuant to section 13.1 include the following titles, abbreviations and initials: (i) registered nurse (authorized prescriber), (ii) R.N.(A.P.) or RN(AP), (iii) Reg. N.(A.P.) or Reg N(AP). (EC551/23; 755/24) 13. Reserved activities (1) Subject to subsections (2) and (3) and any terms or conditions imposed on the registered nurse’s registration, a registered nurse is authorized to perform the following reserved activities: (a) performing a procedure on tissue below the dermis, below the surface of a mucous membrane or on the surface of the cornea; (b) setting or casting a fracture of a bone or a dislocation of a joint; (c) administering a substance by injection, transfusion, inhalation, mechanical ventilation, irrigation or enteral or parenteral instillation; (d) administering a drug or vaccine by any means; (e) putting an instrument, hand or finger (i) beyond the external ear canal, (ii) beyond the point in the nasal passages where they normally narrow, (iii) beyond the pharynx or larynx, (iv) beyond the opening of the urethra, (v) beyond the labia majora, (vi) beyond the anal verge, or (vii) into an artificial opening into the body; (f) applying sound energy or electrical energy, other than ionizing radiation; c t Current to: April 1, 2026 Page 9 PART 2 – REGISTERED NURSES Section 13 Registered Nurses and Registered Psychiatric Nurses Regulations (g) applying electrical energy in the form of ionizing radiation to conduct an X-ray for the purpose of dental screening, diagnosis or treatment; (h) performing allergy challenge testing by any method; (i) managing labour in an institutional setting where the primary health care provider is not present. Conditions (2) A registered nurse shall not perform a reserved activity referred to in subsection (1) unless it is performed pursuant to (a) an order made by (i) a person authorized to practise as a medical practitioner or a nurse practitioner under the laws of this province or another province or territory, or (ii) a person authorized to practise as a dentist or a midwife under the laws of this province; or (b) a Health PEI protocol. Exceptions (3) Notwithstanding subsection (2), a registered nurse is authorized to perform the following reserved activities under the specified conditions: (a) administering by any means, a drug or vaccine prescribed by (i) a registered nurse with a special authorization issued under section 13.1, (ii) a registered psychiatric nurse with a special authorization issued under section 23.10, or (iii) a person authorized to practise as a pharmacist under the laws of this province; (b) performing a procedure on tissue below the dermis to collect blood for a screening or diagnostic test ordered by (i) a registered nurse with a special authorization issued under section 13.1, (ii) a registered psychiatric nurse with a special authorization issued under section 23.10, or (iii) a person authorized to practise as a pharmacist under the laws of this province. (EC551/23; 898/23; 755/24; 202/25) 13.1 Special authorization to perform additional reserved activities (1) A registered nurse may apply to the registrar, in the form approved by the Council, for a special authorization to perform one or more of the following reserved activities: (a) diagnosing a disease, disorder or condition for which a drug listed in clause (c) may be prescribed, dispensed or administered, and communicating the diagnosis in circumstances in which it is reasonably foreseeable that it will be relied on in health care decisions; (b) ordering and interpreting screening and diagnostic tests that do not use prescribed forms of energy for the purpose of making a diagnosis under clause (a) or monitoring and managing drug therapy prescribed, dispensed or administered under clause (c); (c) prescribing, dispensing and administering the following drugs or classes of drugs: (i) analgesics, (ii) antibiotics, (iii) anticoagulants, Page 10 Current to: April 1, 2026 t c PART 2 – REGISTERED NURSES Registered Nurses and Registered Psychiatric Nurses Regulations Section 13 (iv) antifungals, (v) antihistamines, (vi) anti-inflammatories, (vii) antivirals, (viii) beta2 agonists, (ix) contraceptives, (x) emergency contraceptives, (xi) epinephrine, (xii) glucagon, (xiii) hypoglycemics, (xiv) immune globulins, (xv) inhaled corticosteroids, (xvi) insulin, (xvii) lactation aids or suppressants, (xviii) laxatives, (xix) leukotriene inhibitors, (xx) medicated dressings, (xxi) nicotine replacements, (xxii) opioid antagonist, (xxiii) permethrin, (xxiv) topical anesthetics, (xxv) topical corticosteroids, (xxvi) vitamins; (d) prescribing a new dose of a drug indicated by Health Canada for the treatment of diabetes, originally prescribed for that purpose by a person authorized to practise as a medical practitioner or a nurse practitioner under the laws of this province or another province or territory. Requirements for special authorization (2) An applicant is eligible for a special authorization to perform a reserved activity listed in subsection (1), if the applicant has successfully completed (a) for the purpose of clauses (1)(a), (b) and (c), (i) a certificate or diploma program in prescribing for registered nurses, approved by the Council; or (ii) an education program that the Council considers substantially equivalent to a program described in subclause (i); and (b) for the purpose of clause (1)(d), a diabetes educator program approved by the Council. Grant of special authorization (3) On receipt of an application in accordance with subsection (1), the registrar may grant the applicant a special authorization to perform a reserved activity listed in subsection (1), if the registrar is satisfied that the applicant meets the applicable requirement in subsection (2). Referral to the council (4) Where the registrar is not satisfied that the applicant meets the applicable requirement in subsection (2), the registrar shall refer the application to the Council. c t Current to: April 1, 2026 Page 11 PART 3 – NURSE PRACTITIONERS Section 14 Registered Nurses and Registered Psychiatric Nurses Regulations Review by the council (5) On receipt of an application referred by the registrar, the Council shall review the application and may (a) direct the registrar to grant a special authorization to perform a reserved activity listed in subsection (1); and (b) impose any terms and conditions on the special authorization that the Council considers appropriate. Register and certificate (6) Where the registrar grants a special authorization under subsection (3) or (5), the registrar shall record the special authorization and any terms and conditions on the special authorization in the register and on the certificate of registration of the registered nurse. Notice (7) Where the Council refuses to grant a special authorization, the Council shall serve on the applicant written notice of and reasons for the refusal. Suspension, cancellation, expiration, renewal (8) A special authorization granted under this section is suspended or cancelled, or expires, on the suspension, cancellation or expiration of the registered nurse’s registration, as the case may be, and may be renewed on renewal of the registered nurse’s registration. (EC755/24) PART 3 – NURSE PRACTITIONERS Registration General Class 14. General Class (1) The registrar shall register an applicant in the general class of the nurse practitioners register where (a) the registrar is satisfied that the applicant meets all the requirements for registration set out in subsection 12(2) of the Act and these regulations and registers the applicant pursuant to subsection 12(3) of the Act; or (b) the Council directs the registrar to register the applicant in the general class pursuant to subsection 12(6) of the Act or reinstate the registration of the applicant in the general class pursuant to subsection 24(4) of the Act. Reinstatement period (2) For the purpose of subsection 24(1) of the Act, a former member may apply for reinstatement of registration in the general class of the nurse practitioners register within three years after a lapse in the registration. Education For the purpose of clause 12(2)(c) of the Act, the requirements for registration under this Part with respect to education are (a) the successful completion of Page 12 Current to: April 1, 2026 t c PART 3 – NURSE PRACTITIONERS Registered Nurses and Registered Psychiatric Nurses Regulations Section 16 (i) an undergraduate degree program in nursing, approved by the Council, or (ii) a nursing education program that the Council considers substantially equivalent to a program described in subclause (i); and (b) the successful completion of (i) a graduate degree program for nurse practitioners or a post-graduate certificate or diploma program for nurse practitioners, approved by the Council, or (ii) a nurse practitioner education program that the Council considers substantially equivalent to a program described in subclause (i). Examinations (1) For the purpose of clause 12(2)(d) of the Act, the requirements for registration under this Part with respect to examinations are (a) the successful completion of one of the following, depending on the applicable time period: (i) where the examination was written on or after January 1, 1982, but before January 1, 2015, the Canadian Registered Nurse Examination (CRNE) or the National Council Licensing Examination for Registered Nurses (NCLEX- RN), (ii) where the examination was written on or after January 1, 2015, the National Council Licensing Examination for Registered Nurses (NCLEX-RN) or, if it was not offered, a substitute competency examination approved or adopted by the Council; and (b) the successful completion of the Canadian Nurse Practitioner Examination (CNPE) or other competency examination approved by the Council, in not more than three attempts. Successful completion of examination (2) The successful completion of an examination referred to in subsection (1) means obtaining the established pass mark or other minimum standard established by the Council. Currency requirements For the purpose of clause 12(2)(f), subclause 22(2)(a)(ii) and clause 24(4)(c) of the Act, to demonstrate currency of professional knowledge and skills, an applicant under this Part shall have done one of the following within the three years preceding the application: (a) successfully completed the education requirement in clause 15(b); (b) actively practised nursing as a nurse practitioner, without the imposition of any restrictions, in the province or another jurisdiction recognized by the Council, to an extent acceptable to the Council; (c) successfully completed a refresher program acceptable to the registrar. Insurance requirements (1) For the purpose of clause 12(2)(j), subclause 22(2)(a)(v) and clauses 24(4)(f) and 25(3)(c) of the Act, an applicant under this Part or a nurse practitioner, as the case may be, is required to hold or be eligible for professional liability insurance or protection satisfactory to the Council that, at a minimum, c t Current to: April 1, 2026 Page 13 PART 3 – NURSE PRACTITIONERS Section 19 Registered Nurses and Registered Psychiatric Nurses Regulations (a) is issued in the name of the applicant or nurse practitioner or clearly extends to the applicant or nurse practitioner; (b) extends to any practice setting in Prince Edward Island; (c) provides protection of not less than $10,000,000 per claim or occurrence and an aggregate limit of not less than $10,000,000; (d) extends to professional liability for any professional service the applicant will be providing or the nurse practitioner provides in practising nursing; and (e) includes an extended reporting period of at least six years in the case of claims-based protection or a minimum retroactive date of six years in the case of occurrence-based or claims-based protection. Proof of insurance (2) An applicant or nurse practitioner, as the case may be, shall provide proof or ensure proof is provided to the registrar that the applicant or nurse practitioner is eligible to hold or be covered by or holds or is covered by, as the case may be, professional liability insurance or protection that meets the requirements of subsection (1). Provisional class (1) The Council may direct the registrar to register an applicant in the provisional class of the nurse practitioners register, where (a) the applicant does not meet the examination requirements in subsection 16(1), subject to the term or condition that the applicant successfully completes the examination requirements in subsection 16(1) within a specified time period; or (b) the applicant does not meet the requirement for currency of professional knowledge and skills in section 17, subject to the term or condition that the applicant successfully completes a refresher program, approved by the Council, within a specified time period. Renewal (2) Registration in the provisional class may be renewed if the time period specified by the Council under subsection (1) has not expired or the Council extends the time period for meeting the term or condition, and section 17 does not apply in respect of the renewal of the registration of an applicant registered pursuant to clause (1)(b). Subject to supervision (3) A nurse practitioner registered in the provisional class shall be supervised in practising nursing by a nurse practitioner registered in the general class, approved by the Council. Satisfaction of term or condition (4) Where a nurse practitioner satisfies the term or condition imposed under subsection (1), the registrar shall register, or renew or reinstate the registration of, as the case may be, the nurse practitioner in the general class. No reinstatement (5) Registration in the provisional class may not be reinstated. Special class (1) Where the Council directs the registrar to register an applicant in the nurse practitioners register pursuant to subsection 13(3) of the Act, the registrar shall register the applicant in the special class. No renewal or reinstatement (2) Registration in the special class may not be renewed or reinstated. (EC551/23) Condition on Registration 21. Access to medical practitioner A nurse practitioner shall not practise nursing as a nurse practitioner unless the nurse practitioner has reasonable access to a medical practitioner in respect of any patient for the purposes of consultation, referral and transfer. (EC551/23) Designations and Reserved Activities 22. Designations For the purpose of subsection 89(1) of the Act, the designations of a nurse practitioner include the following titles, abbreviations and initials: (a) nurse practitioner; (b) NP or N.P.; (c) RNNP, R.N.N.P., RN(NP) or R.N.(N.P.). Reserved activities Subject to any terms or conditions imposed on the nurse practitioner’s registration, a nurse practitioner is authorized to perform the following reserved activities: (a) diagnosing a disease, disorder or condition and communicating the diagnosis in circumstances in which it is reasonably foreseeable that it will be relied on in health care decisions; (b) performing a procedure on tissue below the dermis, below the surface of a mucous membrane or on the surface of the cornea; (c) setting or casting a fracture of a bone or a dislocation of a joint; (d) ordering a therapeutic diet that is to be administered by enteral instillation or parenteral instillation; (e) administering a substance by injection, transfusion, inhalation, mechanical ventilation, irrigation or enteral or parenteral instillation; (f) prescribing or dispensing a drug, as defined in the Pharmacy Act R.S.P.E.I. 1988, Cap. P-6.1, or vaccine; (g) administering a drug or vaccine by any means; (h) putting an instrument, hand or finger (i) beyond the external ear canal, c t Current to: April 1, 2026 Page 15 PART 3.1 – REGISTERED PSYCHIATRIC NURSES Section 23 Registered Nurses and Registered Psychiatric Nurses Regulations (ii) beyond the point in the nasal passages where they normally narrow, (iii) beyond the pharynx or larynx, (iv) beyond the opening of the urethra, (v) beyond the labia majora, (vi) beyond the anal verge, or (vii) into an artificial opening into the body; (i) ordering and interpreting screening and diagnostic tests that do not use prescribed forms of energy; (j) applying sound or electrical energy, other than ionizing radiation; (k) ordering the application of electrical, electromagnetic or sound energy; (l) applying electrical energy in the form of ionizing radiation to conduct an X-ray for the purpose of dental screening, diagnosis or treatment; (m) managing labour in an institutional setting where neither a medical practitioner nor a midwife is present; (n) performing allergy challenge testing by any method; (o) performing a psycho-social intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality or the ability to meet the ordinary demands of life. (EC551/23; 755/24; 202/25) PART 3.1 – REGISTERED PSYCHIATRIC NURSES Registration General Class 23.1 General Class (1) The registrar shall register an applicant in the general class of the registered psychiatric nurses register where (a) the registrar is satisfied that the applicant meets all the requirements for registration set out in subsection 12(2) of the Act and these regulations and registers the applicant pursuant to subsection 12(3) of the Act; or (b) the Council directs the registrar to register the applicant in the general class pursuant to subsection 12(6) of the Act or reinstate the registration of the applicant in the general class pursuant to subsection 24(4) of the Act. Reinstatement period (2) For the purpose of subsection 24(1) of the Act, a former member may apply for reinstatement of registration in the general class of the registered psychiatric nurses register within three years after a lapse in the registration. (EC755/24) 23.2 Education For the purpose of clause 12(2)(c) of the Act, the requirement for registration under this Part with respect to education is the successful completion of Page 16 Current to: April 1, 2026 t c PART 3.1 – REGISTERED PSYCHIATRIC NURSES Registered Nurses and Registered Psychiatric Nurses Regulations Section 23 (a) an undergraduate degree program in psychiatric nursing, approved by the Council; or (b) a psychiatric nursing education program that the Council considers substantially equivalent to a program described in clause (a). (EC755/24) 23.3 Examination (1) For the purpose of clause 12(2)(d) of the Act, the requirement for registration under this Part with respect to an examination is the successful completion of the Registered Psychiatric Nurses of Canada Examination. Successful completion of examination (2) The successful completion of the examination referred to in subsection (1) means obtaining the established pass mark or other minimum standard approved by the Council. (EC755/24) 23.4 Currency requirements For the purpose of clause 12(2)(f), subclause 22(2)(a)(ii) and clause 24(4)(c) of the Act, to demonstrate currency of professional knowledge and skills, an applicant under this Part shall have done one of the following within the three years preceding the application: (a) successfully completed the education requirement set out in section 23.2; (b) actively practised psychiatric nursing as a registered psychiatric nurse, without the imposition of any restrictions, in the province or another jurisdiction recognized by the Council, to an extent acceptable to the Council; (c) successfully completed a refresher program acceptable to the registrar. (EC755/24) 23.5 Insurance requirements (1) For the purpose of clause 12(2)(j), subclause 22(2)(a)(v) and clauses 24(4)(f) and 25(3)(c) of the Act, an applicant under this Part or a registered psychiatric nurse, as the case may be, is required to be eligible to or to hold or be covered by professional liability insurance or protection satisfactory to the Council that, at a minimum, (a) is issued in the name of the applicant or registered psychiatric nurse or clearly extends to the applicant or registered psychiatric nurse; (b) extends to any practice setting in Prince Edward Island; (c) provides protection of not less than $10,000,000 per claim or occurrence and an aggregate limit of not less than $10,000,000; (d) extends to professional liability for any professional service the applicant will be providing or the registered psychiatric nurse provides in practising nursing; and (e) includes an extended reporting period of at least six years in the case of claims-based protection or a minimum retroactive date of six years in the case of occurrence-based or claims-based protection. Proof of insurance (2) An applicant or registered psychiatric nurse, as the case may be, shall provide proof or ensure proof is provided to the registrar that the applicant or registered psychiatric nurse is eligible to hold or be covered by or holds or is covered by, as the case may be, professional liability insurance or protection that meets the requirements of subsection (1). (EC755/24) c t Current to: April 1, 2026 Page 17 PART 3.1 – REGISTERED PSYCHIATRIC NURSES Section 23 Registered Nurses and Registered Psychiatric Nurses Regulations Provisional Class 23.6 Provisional class (1) The Council may direct the registrar to register an applicant in the provisional class of the registered psychiatric nurses register, where (a) the applicant does not meet the examination requirement in section 23.3, subject to the term or condition that the applicant successfully completes the examination requirement in section 23.3 within a specified time period; or (b) the applicant does not meet the requirements for currency of professional knowledge and skills in section 23.4, subject to the term or condition that the applicant successfully completes a refresher program, approved by the Council, within a specified time period. Renewal (2) Registration in the provisional class may be renewed if the time period specified by the Council under subsection (1) has not expired or the Council extends the time period for meeting the term or condition, and section 23.4 does not apply in respect of the renewal of the registration of an applicant registered pursuant to clause (1)(b). Subject to supervision (3) A registered psychiatric nurse registered in the provisional class shall be supervised in practising psychiatric nursing by a registered psychiatric nurse registered in the general class, approved by the Council. Satisfaction of term or condition (4) Where a registered psychiatric nurse satisfies the term or condition imposed under subsection (1), the registrar shall register, or renew or reinstate the registration of, as the case may be, the registered psychiatric nurse in the general class. No reinstatement (5) Registration in the provisional class may not be reinstated. (EC755/24) Special Class 23.7 Special registration (1) Where the Council directs the registrar to register an applicant in the registered psychiatric nurses register pursuant to subsection 13(3) of the Act, the registrar shall register the applicant in the special class. No renewal or reinstatement (2) Registration in the special class may not be renewed or reinstated. (EC755/24) Designations and Reserved Activities 23.8 Designations For the purpose of subsection 89(1) of the Act, Page 18 Current to: April 1, 2026 t c PART 3.1 – REGISTERED PSYCHIATRIC NURSES Registered Nurses and Registered Psychiatric Nurses Regulations Section 23 (a) the designations of a registered psychiatric nurse include the following titles, abbreviations and initials: (i) registered psychiatric nurse, (ii) R.P.N. or RPN; and (b) the designations of a registered psychiatric nurse with special authorization pursuant to section 23.10 include the following titles, abbreviations and initials: (i) registered psychiatric nurse (authorized prescriber), (ii) R.P.N.(A.P.) or RPN(AP). (EC755/24) 23.9 Reserved activities (1) Subject to subsections (2) and (3) and any terms or conditions imposed on the registered psychiatric nurse’s registration, a registered psychiatric nurse is authorized to perform the following reserved activities: (a) performing a procedure on tissue below the dermis or below the surface of a mucous membrane; (b) administering a substance by injection, transfusion, inhalation, mechanical ventilation, irrigation or enteral or parenteral instillation; (c) administering a drug or vaccine by any means; (d) putting an instrument, hand or finger (i) beyond the external ear canal, (ii) beyond the point in the nasal passages where they normally narrow, (iii) beyond the pharynx or larynx, (iv) beyond the opening of the urethra, (v) beyond the labia majora, (vi) beyond the anal verge, or (vii) into an artificial opening into the body; (e) applying sound energy or electrical energy, other than ionizing radiation; (f) performing a psycho-social intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality or the ability to meet the ordinary demands of life. Conditions (2) A registered psychiatric nurse shall not perform a reserved activity referred to in clauses (1)(a) to (e) unless it is performed pursuant to (a) an order made by a person authorized to practise as a medical practitioner or a nurse practitioner under the laws of this province or another province or territory; or (b) a Health PEI protocol. Exceptions (3) Notwithstanding subsection (2), a registered psychiatric nurse is authorized to perform the following reserved activities under the specified conditions: (a) administering by any means, a drug or vaccine prescribed by (i) a registered nurse with a special authorization issued under section 13.1, (ii) a registered psychiatric nurse with a special authorization issued under section 23.10, or c t Current to: April 1, 2026 Page 19 PART 3.1 – REGISTERED PSYCHIATRIC NURSES Section 23 Registered Nurses and Registered Psychiatric Nurses Regulations (iii) a person authorized to practise as a pharmacist under the laws of this province; (b) performing a procedure on tissue below the dermis to collect blood for a screening or diagnostic test ordered by (i) a registered nurse with a special authorization issued under section 13.1, (ii) a registered psychiatric nurse with a special authorization issued under section 23.10, or (iii) a person authorized to practise as a pharmacist under the laws of this province. (EC755/24; 202/25) 23.10 Special authorization to perform additional reserved activities (1) A registered psychiatric nurse may apply to the registrar, in the form approved by the Council, for a special authorization to perform the following reserved activities: (a) diagnosing a disease, disorder or condition for which a drug listed in clause (c) may be prescribed, dispensed or administered, and communicating the diagnosis in circumstances in which it is reasonably foreseeable that it will be relied on in health care decisions; (b) ordering and interpreting screening and diagnostic tests that do not use prescribed forms of energy for the purpose of making a diagnosis under clause (a) or monitoring and managing drug therapy prescribed, dispensed or administered under clause (c); (c) prescribing, dispensing and administering the following drugs or classes of drugs: (i) analgesics, (ii) antibiotics, (iii) anti-inflammatories, (iv) antivirals, (v) contraceptives, (vi) emergency contraceptives, (vii) laxatives, (viii) sedatives. Requirements for special authorization (2) An applicant is eligible for a special authorization to perform the reserved activities listed in subsection (1), if the applicant has successfully completed (a) a certificate or diploma program in prescribing for registered psychiatric nurses, approved by the Council; or (b) an education program that the Council considers substantially equivalent to a program described in clause (a).

Grant of special authorization (3) On receipt of an application in accordance with subsection (1), the registrar may grant the applicant a special authorization to perform the reserved activities listed in subsection (1), if the registrar is satisfied that the applicant meets the requirement in subsection (2). Referral to the council (4) Where the registrar is not satisfied that the applicant meets the requirement in subsection (2), the registrar shall refer the application to the Council. Page 20 Current to: April 1, 2026 t c PART 4 - GENERAL Registered Nurses and Registered Psychiatric Nurses Regulations Section 24 Review by the council (5) On receipt of an application referred by the registrar, the Council shall review the application and may (a) direct the registrar to grant a special authorization to perform the reserved activities listed in subsection (1); and (b) impose any terms and conditions on the special authorization that the Council considers appropriate. Register and certificate (6) Where the registrar grants a special authorization under subsection (3) or (5), the registrar shall record the special authorization and any terms and conditions on the special authorization in the register and on the certificate of registration of the registered psychiatric nurse. Notice (7) Where the Council refuses to grant a special authorization, the Council shall serve on the applicant written notice of and reasons for the refusal. Suspension, cancellation, expiration, renewal (8) A special authorization granted under this section is suspended or cancelled, or expires, on the suspension, cancellation or expiration of the registered psychiatric nurse’s registration, as the case may be, and may be renewed on renewal of the registered psychiatric nurse’s registration. (EC755/24) PART 4 - GENERAL 24. Online directory The registrar shall maintain a directory of members of the College on the College’s website, which includes information respecting (a) the member’s type and class of registration; (b) any terms or conditions imposed on the member’s registration; (c) any special authorization held by the member; and (d) the suspension, expiration or cancellation of the member’s registration, where applicable. Name of corporation (1) For the purpose of clause 15(1)(d) of the Act, the name of a corporation applying for a permit to carry on the business of providing the professional services of a member registered under these regulations shall be, in the opinion of the registrar, in good taste, dignified and professional. Change of name (2) Before changing its name, a health profession corporation shall obtain written confirmation from the registrar that the proposed name meets the requirements of subsection (1).
