These regulations adopt most of the federal Transportation of Dangerous Goods Regulations for dangerous goods carried on highways in Prince Edward Island, but exclude Parts X, XI and XIII. They also let the Minister designate a permit issuer and prohibit noncompliant transport by a person subject to a direction.

D-3, Council made the following regulations: 1. Application of Federal regulations Subject to the provisions of these regulations, the English component of the Transportation of Dangerous Goods Regulations, as made under the Transportation of Dangerous Goods Act (Canada) R.S.C. 1985, Chap. T-19 and as amended from time to time, is hereby adopted for the purposes of the Dangerous Goods (Transportation) Act, with the necessary changes, with respect to transportation of dangerous goods therein prescribed in or on a vehicle on a highway in Prince Edward Island. (EC319/85) 2. Exception Notwithstanding section 1, Parts X, XI and XIII in the Transportation of Dangerous Goods Regulations are not adopted. (EC319/85) 3. Interpretation The following terms in the Transportation of Dangerous Goods Regulations shall have the following meanings for the purposes of these regulations: (a) “inspector” includes an inspector designated under subsection 10(1) of the Act; (b) “means of transport” means a vehicle or combination of vehicles. Issue of permit (1) The Minister designates the Director of the Highway Safety Division, Department of Transportation and Public Works, as a person who may issue a permit under section 2 of the Act. Directions under the Federal Act No dangerous goods shall be transported in or on a vehicle on a highway by a person to whom a direction has been given under the Dangerous Goods Protective Directive Regulations made under the Transportation of Dangerous Goods Act (Canada) unless the transportation complies with the direction.
