Entrée en vigueur .................................................................................................................................... 25 Page 4 Current to: December 14, 2013 t c PREAMBLE French Language Services Act Section 1 c FRENCH LANGUAGE SERVICES ACT CHAPTER F-15.2 PREAMBLE WHEREAS the people of Prince Edward Island take pride in the role of Prince Edward Island in the creation of Canada, a bilingual country; AND WHEREAS the Government of Prince Edward Island is committed to supporting the Acadian and Francophone community and maintaining the French language on Prince Edward Island for future generations; AND WHEREAS the Government of Prince Edward Island wishes to establish clear obligations respecting the provision of services by government institutions in French, based on the service priorities of the Acadian and Francophone community and the service capacity of government institutions; THEREFORE, BE IT ENACTED by the Lieutenant Governor and the Legislative Assembly of the Province of Prince Edward Island as follows: INTERPRETATION 1. Definitions In this Act, “Acadian and Francophone Affairs Secretariat” means the employees referred to in subsection 7(3); “Acadian and Francophone community” means the community of people within the province who have a common knowledge and understanding of the French language; “advisory committee” means the Acadian and Francophone Community Advisory Committee established under section 8; “Complaints Officer” means the Complaints Officer appointed by the Minister in accordance with section 11; “Co-ordinator” means, in relation to a government institution, the French Language Services Co-ordinator appointed by the head of the government institution in accordance with subsection 9(1); “designated service” means a service designated in the regulations as a designated service; “government institution” means (a) a department or division of the Government of Prince Edward Island; (b) a Crown corporation; or (c) any other organization, c t Current to: December 14, 2013 Page 5 DESIGNATED SERVICES Section 2 French Language Services Act that is prescribed in the regulations as a government institution; “head” means, in relation to a government institution, (a) in the case of a government institution that is a department or division of the Government of Prince Edward Island, the member of the Executive Council who presides over the government institution; or (b) in the case of any other government institution, the chief officer of the government institution; “Minister” means the Minister Responsible for Acadian and Francophone Affairs; “regulations” means the regulations made by the Lieutenant Governor in Council pursuant to section 16; “service” means a service that is provided to the public by a government institution. 2013,c.32,s.1. 2. Services other than designated services (1) Nothing in this Act or the regulations shall be construed so as to prevent a government institution from providing a service other than a designated service to the public in French. Language of Government (2) Nothing in this Act or the regulations shall be construed as dictating or otherwise limiting the working language of the Government of Prince Edward Island. Use of French language outside Act (3) Nothing in this Act or the regulations shall be construed as limiting the use of French outside of the application of this Act and the regulations. 2013,c.32,s.2. DESIGNATED SERVICES 3. Designated services in French or English (1) Every government institution shall ensure that each designated service provided by that government institution is provided to any member of the public in the person’s choice of French or English. Active offer, comparable quality (2) Every government institution shall ensure that (a) measures are taken, in accordance with the regulations, to make it known to the public that a designated service of the government institution is provided in a person’s choice of French or English; and (b) a designated service of the government institution is provided with comparable quality in French and English. Direct or indirect service (3) For greater certainty, this section applies to a government institution whether the government institution provides a designated service directly or through a third party. 2013,c.32,s.3. Page 6 Current to: December 14, 2013 t c CORRESPONDENCE AND PUBLIC CONSULTATIONS French Language Services Act Section 4 CORRESPONDENCE AND PUBLIC CONSULTATIONS 4. Written correspondence (1) Where a government institution receives written correspondence in French, the government institution shall ensure that such correspondence is responded to, in writing, in French. Public consultations (2) Where a government institution is conducting a public consultation, whether directly or through a third party, the government institution shall (a) where the public consultation is conducted through written or electronic means, ensure that members of the public are provided with an opportunity to participate in the consultations in French and English; and (b) where the public consultation is conducted through one or more public meetings, ensure that members of the public are provided with an opportunity to participate in at least one of the public meetings in French and English. 2013,c.32,s.4. COMMUNITY SIGNS 5. Community signs Where a government institution is responsible for erecting signage giving notice of a community name, the government institution shall, before doing so, consult with the community respecting the community name to be used on the sign, and give consideration to the community name in common usage, the historical name of the community and any Acadian and Francophone cultural ties to the community. 2013,c.32,s.5. APPOINTMENTS 6. Appointments Where the Lieutenant Governor in Council or the head of a government institution is authorized or required under an enactment to appoint persons to an agency, board or commission, the Lieutenant Governor in Council or the head of the government institution, as the case may be, shall, before making such appointments, give full and fair consideration to the representation of members of the Acadian and Francophone community on the agency, board or commission. 2013,c.32,s.6. ADMINISTRATION 7. Minister (1) The Minister is responsible for the administration of this Act and the regulations. Functions (2) The functions of the Minister include developing and co-ordinating the implementation of policies and programs of the Government of Prince Edward Island relating to (a) Acadian and Francophone Affairs; and c t Current to: December 14, 2013 Page 7 ADMINISTRATION Section 8 French Language Services Act (b) the provision of designated services by government institutions in French. Acadian and Francophone Affairs Secretariat (3) The Minister may, in accordance with the Civil Service Act R.S.P.E.I. 1988, Cap. C-8, engage such employees as the Minister deems necessary, who shall be known collectively as the Acadian and Francophone Affairs Secretariat, to assist with the administration of the functions of the Minister. 2013,c.32,s.7. 8. Advisory committee (1) There is hereby established an advisory committee, known as the Acadian and Francophone Community Advisory Committee, to provide to the Minister advice respecting the service priorities of the Acadian and Francophone community, the designation of services as designated services, the provision of designated services by government institutions in French, and any other matters concerning the Acadian and Francophone community in the province. Membership (2) The advisory committee shall consist of ten members, each of whom is bilingual in French and English, appointed by the Minister, including: (a) one member who represents the West Prince region of the province; (b) one member who represents the Evangeline region of the province; (c) one member who represents the Summerside and Miscouche area; (d) one member who represents the Rustico area; (e) one member who represents the Charlottetown area; (f) one member who represents the Eastern Kings region; (g) four other members, including the Chair. Vacancy does not impair action (3) Notwithstanding subsection (2), a vacancy in the membership of the advisory committee does not impair the right of the members in office to act, if the number of members in office is not less than five members. Term (4) Members shall be appointed to the advisory committee for a term of three years and may be reappointed once. Stagger terms of initial members (5) Notwithstanding subsection (4), the Minister may stagger the terms of the initial members appointed to the advisory committee. Revocation (6) The appointment of a member of the advisory committee is revoked at the time (a) the member resigns from the advisory committee by notice in writing delivered to the advisory committee; (b) the member ceases to reside in the province; or (c) the member’s appointment is revoked by the Minister. Page 8 Current to: December 14, 2013 t c ADMINISTRATION French Language Services Act Section 9 Filing vacancy (7) Where a member of the advisory committee ceases to hold office before his or her term expires, the Minister may appoint a new member to hold office for the remainder of the previous member’s term. Continued membership after expiry of term (8) A member of the advisory committee continues to hold office after the expiry of his or her term as a member until the member is reappointed or a successor is appointed. Remuneration and expenses (9) The members of the advisory committee shall be paid such remuneration and reimbursed for such expenses as the Lieutenant Governor in Council may determine. Executive Secretary (10) The Minister shall appoint an employee from the Acadian and Francophone Affairs Secretariat who is bilingual in French and English as an Executive Secretary to provide operational and administrative support to the advisory committee. Bylaws (11) The advisory committee may make bylaws not inconsistent with this Act or the regulations relating to the administrative operation of the advisory committee. 2013,c.32,s.8. 9. French Language Services Co-ordinator (1) The head of each government institution shall appoint a French Language Services Co- ordinator for the government institution, who shall perform such functions for the government institution as are set out in this Act and the regulations or assigned by the head of the government institution or the Minister. Co-ordinators’ Committee (2) There is hereby established a Co-ordinators’ Committee, composed of all Co-ordinators and a chair appointed in accordance with subsection (3), for the purposes of sharing information and assisting government institutions to meet their obligations under this Act. Chair (3) The Minister shall appoint an employee from the Acadian and Francophone Affairs Secretariat as the Chair of the Co-ordinators’ Committee. 2013,c.32,s.9. 10. Annual plan by government institution (1) Each fiscal year, commencing in the fiscal year in which this subsection comes into force, every government institution shall prepare and submit to the Minister, within such time, in such form and containing such information, as the Minister may request, an annual plan for the next fiscal year. Annual report by government institution (2) Each fiscal year, commencing in the second fiscal year that follows the fiscal year in which this subsection comes into force, every government institution shall prepare and submit to the Minister, within such time, in such form and containing such information, as the Minister may request, an annual report for the past fiscal year. c t Current to: December 14, 2013 Page 9 COMPLAINTS Section 11 French Language Services Act Contents of reports (3) The annual plan and the annual report of a government institution shall, in addition to containing such information as the Minister may request, contain information respecting (a) the service priorities of the Acadian and Francophone community, as expressed by the advisory committee, in relation to the services provided by the government institution; (b) the service capacity of the government institution to provide services in French; (c) the provision of designated services by the government institution in French; and (d) any complaints received by the government institution respecting compliance by the government institution with this Act. Annual report by Minister (4) Each fiscal year, commencing in the fiscal year that follows the fiscal year in which this subsection comes into force, the Minister shall (a) prepare an annual report for the past fiscal year respecting the activities of the Acadian and Francophone Affairs Secretariat and government institutions; and (b) lay that annual report before the Legislative Assembly, within 15 days of the commencement of a sitting of the Legislative Assembly. 2013,c.32,s.10. COMPLAINTS 11. Complaints Officer (1) The Minister shall appoint a person who is bilingual in French and English as a Complaints Officer, who shall perform such functions respecting complaints as are set out in this Act and the regulations and is accountable to the Minister. Remuneration and expenses (2) The Complaints Officer shall be paid such remuneration and reimbursed for such expenses as the Lieutenant Governor in Council may determine. 2013,c.32,s.11. 12. Complaint (1) Any person may make a complaint to the Co-ordinator of a government institution alleging that the government institution did not comply with or is not complying with section 3 or 4, if the complaint is made (a) within 60 days after the date when the alleged non-compliance occurred; or (b) where the alleged non-compliance is continuing or continues for more than one day, within 60 days after the date when the alleged non-compliance first occurred. Form of complaint (2) A person who wishes to make a complaint under subsection (1) shall (a) state the complaint and the grounds for the complaint in writing; (b) sign the complaint; and (c) serve the complaint on the Co-ordinator. Duties of Co-ordinator (3) Upon receipt of a complaint made in accordance with subsection (2), a Co-ordinator shall Page 10 Current to: December 14, 2013 t c COMPLAINTS French Language Services Act Section 13 (a) notify the head of the government institution regarding the complaint; (b) inquire into the complaint to the extent that the Co-ordinator determines is warranted; and (c) subject to subsection (4), attempt to resolve the complaint. Dismissal of complaint (4) A Co-ordinator may dismiss a complaint if the Co-ordinator finds that the complaint (a) is frivolous, vexatious or without foundation; or (b) was not made within the time limit required under subsection (1). Notice of dismissal of complaint (5) On dismissing a complaint, a Co-ordinator shall notify the head of the government institution of the dismissal and serve on the complainant (a) written notice of, and reasons for, the dismissal; and (b) written notice of the complainant’s right to request a review of the dismissal under subsection 13(1). Referral to Complaints Officer (6) Where a Co-ordinator does not either dismiss or resolve a complaint, the Co-ordinator shall (a) refer the complaint to the Complaints Officer; (b) notify the head of the government institution of the referral to the Complaints Officer; and (c) serve on the complainant written notice of the referral to the Complaints Officer. Idem (7) Where a Co-ordinator refers a complaint to the Complaints Officer, the Co-ordinator shall serve on the Complaints Officer a copy of (a) the complaint; and (b) any documentation or information collected by the Co-ordinator respecting the complaint. 2013,c.32,s.12. 13. Request for review of dismissal of complaint (1) A complainant may, within 15 days after being served with a notice of the dismissal of his or her complaint by a Co-ordinator under subsection 12(5), serve a request, in writing, for a review of the dismissal of a complaint on the Co-ordinator and the Complaints Officer. Duty of Co-ordinator (2) Within 15 days after being served with a request for a review of a dismissal of a complaint, a Co-ordinator shall notify the head of the government institution of the request and serve on the Complaints Officer a copy of (a) the complaint; (b) any documentation or information collected by the Co-ordinator respecting the complaint; and (c) the notice of, and reasons for, the Co-ordinator’s dismissal of the complaint. c t Current to: December 14, 2013 Page 11 COMPLAINTS Section 14 French Language Services Act Decision (3) Within 15 days after being served with a complaint and related documentation and information by a Co-ordinator under subsection (2), the Complaints Officer shall review the dismissal of the complaint and either confirm the dismissal or overturn the dismissal. Notice (4) On confirming or overturning a dismissal of a complaint under subsection (3), the Complaints Officer shall serve on the complainant and the head of the government institution that is the subject of the complaint written notice of, and reasons for, the decision. 2013,c.32,s.13. 14. Inquiry by Complaints Officer (1) Where a complaint is referred to the Complaints Officer under subsection 12(6) or the Complaints Officer overturns a dismissal of a complaint under subsection 13(3), the Complaints Officer shall inquire into the complaint to the extent that the Complaints Officer determines is warranted. Resolve or dismiss (2) The Complaints Officer may (a) attempt to resolve the complaint; or (b) dismiss the complaint if the Complaints Officer finds that the complaint (i) is frivolous, vexatious or without foundation, or (ii) was not made within the time limit required under subsection 12(1). Notice of dismissal of complaint (3) On dismissing a complaint, the Complaints Officer shall serve on the complainant and the head of the government institution that is the subject of the complaint written notice of, and reasons for, the dismissal. Representations (4) Where the Complaints Officer does not resolve the complaint or dismiss the complaint within 30 days after receiving the referral under subsection 12(6) or overturning a dismissal of a complaint under subsection 13(3), the Complaints Officer shall serve written notice on the following persons respecting the entitlement of such persons to make representations to the Complaints Officer about the complaint: (a) the complainant; (b) the head of the government institution that is the subject of the complaint; (c) any other person the Complaints Officer considers appropriate. Complaints Officer to determine procedure (5) The Complaints Officer may determine (a) whether representations are to be made orally or in writing; and (b) whether a person is entitled to have access to or respond to representations or to be present when representations are being made. Powers of Complaints Officer (6) The Complaints Officer may (a) require the production of and examine any record related to the complaint that is in the custody of the government institution that is the subject of the complaint or a Page 12 Current to: December 14, 2013 t c GENERAL French Language Services Act Section 15 third party that is providing a designated service on behalf of the government institution that is the subject of the complaint; and (b) enter and inspect any premises related to the complaint that is occupied by the government institution that is the subject of the complaint or a third party that is providing a designated service on behalf of the government institution that is the subject of the complaint. Report (7) On receiving or hearing representations and completing his or her inquiry into a complaint, the Complaints Officer shall, within a reasonable time, (a) prepare a written report setting out (i) the findings of the Complaints Officer with respect to the allegations in the complaint, and (ii) any recommendations of the Complaints Officer with respect to the allegations in the complaint; and (b) serve a copy of the report on (i) the complainant, (ii) the head of the government institution that is the subject of the complaint, and (iii) the Minister. Inclusion in annual report (8) The Minister shall include in the annual report that he or she submits to the Legislative Assembly in accordance with subsection 10(4), information respecting complaints made under this Act during the past fiscal year, including the outcome of such complaints and any actions taken by government institutions to address such complaints. 2013,c.32,s.14. GENERAL 15. Service (1) Whenever a person is required under this Act or the regulations to serve a notice or documents on another person, the notice or documents shall be served by (a) personal delivery to the person to be notified or provided with the documents; (b) facsimile or other electronic means to the person to be notified or provided with the documents; or (c) ordinary mail addressed to the person to be notified or provided with the documents at the person’s last known address. Deemed completion (2) The service of a notice or documents by facsimile or other electronic means in accordance with subsection (1) is deemed to be effected upon the receipt by the server of an acknowledgement of receipt. Idem (3) The service of a notice or documents by ordinary mail in accordance with subsection (1) is deemed to be effected upon the expiration of seven days after the deposit of the notice or documents in the mail. 2013,c.32,s.15. c t Current to: December 14, 2013 Page 13 GENERAL Section 16 French Language Services Act 16. Regulations (1) The Lieutenant Governor in Council may make regulations for the better administration of this Act, including regulations (a) subject to subsections (2) to (5), designating a service as a designated service; (b) prescribing government institutions; (c) respecting measures to be taken to make it known to the public that a designated service of a government institution is provided in a person’s choice of French or English; (d) respecting participation in public consultations in French; (e) respecting the Acadian and Francophone Affairs Secretariat; (f) respecting the advisory committee; (g) prescribing functions of the Co-ordinators; (h) respecting the Co-ordinators’ Committee established under subsection 9(2); (i) respecting the annual plans and annual reports of government institutions; (j) prescribing functions of the Complaints Officer; (k) respecting the complaint process; (l) respecting consultations with the advisory committee under subsection (4); (m) defining words or expressions used but not defined in this Act; (n) prescribing any matter referred to in this Act as prescribed by the regulations; and (o) respecting any other matter that in the opinion of the Lieutenant Governor in Council is necessary to give full effect to the intent and purpose of this Act. Location, manner or time frame (2) A regulation made under clause (1)(a) designating a service as a designated service may limit the scope of the designation with respect to (a) where, when and the manner in which the service is provided; or (b) any other consideration or circumstance relating to the provision of the service that the Lieutenant Governor in Council considers appropriate. Service priorities and service capacity (3) Before making a regulation under clause (1)(a) designating a service as a designated service, the Lieutenant Governor in Council shall consider (a) the service priorities of the Acadian and Francophone community, as expressed by the advisory committee, with respect to the services provided by the government institution; and (b) the service capacity of the government institution to provide the service in French. Consultation (4) A regulation that amends or revokes the designation of a service as a designated service may not be made under clause (1)(a) unless the Minister has first consulted with the advisory committee on the substance of the proposed regulation. Idem (5) Following consultation with the advisory committee under subsection (4), the regulation may be made, as proposed or with any changes that the Lieutenant Governor in Council considers advisable, without further consultation. 2013,c.32,s.16. Reasonable limits The obligations of government institutions under this Act and the regulations are subject to such limits as circumstances make reasonable and necessary, if all reasonable measures and plans for compliance with this Act and the regulations have been taken or made. 2013,c.32,s.17. 18. Equal authority The French version and the English version of this Act and any regulations made pursuant to this Act are equally authoritative. 2013,c.32,s.18. 19. Repeal The French Language Services Act R.S.P.E.I. 1988, Cap. F-15.1 is repealed. 2013,c.32,s.19. 20. Commencement This Act comes into force on a date that may be fixed by proclamation of the Lieutenant Governor in Council. 2013,c.32,s.20. Définitions Les définitions qui suivent s’appliquent à la présente loi, “agent aux plaintes” L’agent aux plaintes nommé par le ministre conformément à l’article 11. “Comité consultatif” Le Comité consultatif de la communauté acadienne et francophone constitué en vertu de l’article 8. “communauté acadienne et francophone” Les personnes de la province qui ont une connaissance et une compréhension communes de la langue française. c t Current to: December 14, 2013 Page 15 SERVICES DÉSIGNÉS Section 2 French Language Services Act “coordonnateur” Le coordonnateur des services en français d’une institution gouvernementale que nomme le dirigeant principal de celle-ci conformément au paragraphe 9(1). “dirigeant principal” S’entend des personnes suivantes au sein des institutions gouvernementales: (a) dans le cas d’une institution gouvernementale qui est un ministère ou une division du gouvernement de l’Île-du-Prince-Édouard, le membre du Conseil exécutif qui préside l’institution gouvernementale; (b) dans le cas de toute autre institution gouvernementale, son premier dirigeant. “institution gouvernementale” S’entend des organismes suivants qualifiés dans les règlements d’institutions gouvernementales: (a) un ministère ou une division du gouvernement de l’Île-du-Prince-Édouard; (b) une société d’État; (c) tout autre organisme. “ministre” Le ministre responsable des Affaires acadiennes et francophones. “règlements” Les règlements pris par le lieutenant-gouverneur en conseil en vertu de l’article 16. “Secrétariat aux affaires acadiennes et francophones” Le bureau dont le personnel compte les employés mentionnés au paragraphe 7(3). “service” Tout service fourni au public par une institution gouvernementale. “service désigné” Tout service désigné comme tel dans les règlements. 2013,c.32,s.1. 2. Services non désignés (1) La présente loi et les règlements n’ont pas pour effet d’empêcher les institutions gouvernementales de fournir en français au public des services non désignés. Langue du gouvernement (2) La présente loi et les règlements n’ont pas pour effet de dicter ni de restreindre autrement la langue de travail du gouvernement de l’Île-du-Prince-Édouard. Usage de la langue française non visé par la loi (3) La présente loi et les règlements n’ont pas pour effet de restreindre l’usage du français dans les cas qui n’y sont pas visés. 2013,c.32,s.2. SERVICES DÉSIGNÉS 3. Services désignés en français ou en anglais (1) Les institutions gouvernementales font en sorte que tous les services désignés qu’elles fournissent soient offerts au public en français ou en anglais au choix de la personne. Offre active, qualité comparable (2) Les institutions gouvernementales font en sorte: (a) que des mesures soient prises, conformément aux règlements, pour informer le public que leurs services désignés sont offerts en français ou en anglais au choix de la personne; Page 16 Current to: December 14, 2013 t c CORRESPONDANCE ET CONSULTATIONS PUBLIQUES French Language Services Act Section 4 (b) que les services désignés dont elles assurent la prestation soient de qualité comparable en français et en anglais. Service direct ou indirect (3) Il est entendu que le présent article s’applique aux institutions gouvernementales, que celles- ci fournissent leurs services désignés directement ou par l’entremise de tiers. 2013,c.32,s.3. CORRESPONDANCE ET CONSULTATIONS PUBLIQUES 4. Correspondance (1) Les institutions gouvernementales qui reçoivent de la correspondance en français font en sorte qu’il y soit répondu, par écrit, en français. Consultations publiques (2) Les institutions gouvernementales qui tiennent des consultations publiques, directement ou par l’entremise de tiers, doivent: (a) dans le cas d’une consultation publique tenue sous forme écrite ou électronique, faire en sorte que la population ait l’occasion d’y participer en français et en anglais; (b) dans le cas d’une consultation publique tenue au moyen d’une ou de plusieurs assemblées publiques, faire en sorte que la population ait l’occasion de participer à au moins une d’entre elles en français et en anglais. 2013,c.32,s.4. PANNEAUX TOPONYMIQUES 5. Panneaux toponymiques Les institutions gouvernementales chargées d’ériger des panneaux indiquant le nom de collectivités consultent au préalable la population locale sur le nom à y faire figurer et tiennent compte de leur nom d’usage courant, de leur nom historique et des liens culturels des Acadiens et des francophones envers elles. 2013,c.32,s.5. NOMINATIONS 6. Nominations Lorsque le lieutenant-gouverneur en conseil ou le dirigeant principal d’une institution gouvernementale peut ou doit en vertu d’un texte législatif nommer des personnes à un organisme, à un conseil ou à une commission, le lieutenant-gouverneur en conseil ou le dirigeant principal de l’institution gouvernementale, selon le cas, prend en considération au préalable, de manière complète et équitable, la représentation des membres de la communauté acadienne et francophone au sein de l’entité en question. 2013,c.32,s.6. APPLICATION 7. Ministre (1) Le ministre est responsable de l’application de la présente loi et des règlements. c t Current to: December 14, 2013 Page 17 APPLICATION Section 8 French Language Services Act Fonctions (2) Le ministre a notamment comme fonction l’élaboration et la coordination de l’application, des politiques et programmes du gouvernement de l’Île-du-Prince-Édouard relativement: (a) aux affaires acadiennes et francophones; (b) à la prestation en français des services désignés par les institutions gouvernementales. Secrétariat aux affaires acadiennes et francophones (3) Le ministre peut, conformément à la Civil Service Act R.S.P.E.I. 1988, Cap. C-8, embaucher les employés qu’il juge nécessaires, appelés collectivement le personnel du Secrétariat aux affaires acadiennes et francophones, pour l’aider à exercer ses fonctions. 2013,c.32,s.7. 8. Comité consultatif (1) Est constitué un comité consultatif, appelé Comité consultatif de la communauté acadienne et francophone, chargé de conseiller le ministre sur les priorités en matière de service chez la communauté acadienne et francophone, la désignation des services, la prestation en français des services désignés par les institutions gouvernementales et toute autre question ayant trait à cette communauté dans la province. Composition (2) Le Comité consultatif est composé de dix membres, dont chacun est bilingue (français et anglais) et est nommé par le ministre, à savoir: (a) un membre représentant la région de Prince-Ouest de la province; (b) un membre représentant la région d’Évangeline de la province; (c) un membre représentant les régions de Summerside et de Miscouche; (d) un membre représentant la région de Rustico; (e) un membre représentant la région de Charlottetown; (f) un membre représentant la région de Kings-Est; (g) quatre autres membres, y compris le président. Droit d’agir même en cas de vacance (3) Malgré le paragraphe (2), la vacance d’un poste au sein du Comité consultatif n’empêche pas les membres d’agir s’ils sont au moins cinq. Mandat (4) Les membres sont nommés au Comité consultatif pour un mandat de trois ans, qui peut être renouvelé une fois. Échelonnement des mandats des membres initiaux (5) Malgré le paragraphe (4), le ministre peut échelonner les mandats des membres initiaux nommés au Comité consultatif. Révocation (6) La nomination d’un membre au Comité consultatif est révoquée dans les cas suivants: (a) le membre démissionne sur préavis écrit remis au Comité consultatif; (b) le membre cesse d’être domicilé dans la province; (c) sur décision en ce sens du ministre. Page 18 Current to: December 14, 2013 t c APPLICATION French Language Services Act Section 9 Nomination en cas de poste vacant (7) Lorsqu’un membre du Comité consultatif cesse d’être en poste avant l’expiration de son mandat, le ministre peut nommer un nouveau membre pour le reste du mandat. Maintien en poste après l’expiration du mandat (8) Les membres du Comité consultatif demeurent en poste après l’expiration de leur mandat jusqu’au renouvellement de ce mandat ou à la nomination de leur remplaçant. Rémunération et remboursement des dépenses (9) Le lieutenant-gouverneur en conseil fixe la rémunération et les dépenses remboursables des membres du Comité consultatif. Secrétaire administratif (10) Le ministre nomme un employé du Secrétariat aux affaires acadiennes et francophones qui est bilingue (français et anglais) à titre de secrétaire administratif chargé de fournir un soutien opérationnel et administratif au Comité consultatif. Règlements administratifs (11) Le Comité consultatif peut prendre des règlements administratifs compatibles avec la présente loi ou les règlements relativement à son fonctionnement administratif. 2013,c.32,s.8. 9. Coordonnateur des services en français (1) Chaque institution gouvernementale est dotée d’un coordonnateur des services en français nommé par son dirigeant principal. Les coordonnateurs des services en français exercent les fonctions qui leur sont attribuées par la présente loi ou les règlements ou qui leur sont confiées par le ministre ou le dirigeant principal de leur institution. Comité des coordonnateurs (2) Est constitué un comité des coordonnateurs, composé de tous les coordonnateurs et d’un président nommé conformément au paragraphe (3), qui est chargé de mettre en commun des renseignements et d’aider les institutions gouvernementales à s’acquitter de leurs obligations en vertu de la présente loi. Président (3) Le ministre nomme le président du comité des coordonnateurs parmi les employés du Secrétariat aux affaires acadiennes et francophones. 2013,c.32,s.9. 10. Plan annuel de l’institution gouvernementale (1) Chaque exercice, à compter du premier exercice au cours duquel le présent paragraphe est entré en vigueur, chaque institution gouvernementale établit et soumet au ministre un plan annuel pour l’exercice suivant, selon les modalités que fixe le ministre relativement aux délais, à la forme et aux renseignements devant être fournis. Rapport annuel de l’institution gouvernementale (2) Chaque exercice, à compter du deuxième exercice complet après l’entrée en vigueur du présent paragraphe, chaque institution gouvernementale établit et soumet au ministre un rapport annuel pour l’exercice antérieur, selon les modalités que fixe le ministre relativement aux délais, à la forme et aux renseignements devant être fournis. c t Current to: December 14, 2013 Page 19 PLAINTES Section 11 French Language Services Act Teneur des rapports (3) En plus des renseignements demandés par le ministre, le plan annuel et le rapport annuel d’une institution gouvernementale renferment des renseignements concernant: (a) parmi la gamme de services que fournit l’institution gouvernementale, ceux qui sont prioritaires pour la communauté acadienne et francophone selon le Comité consultatif; (b) la capacité de l’institution gouvernementale de fournir des services en français; (c) la prestation en français par l’institution gouvernementale de services désignés; (d) les plaintes reçues par l’institution gouvernementale quant à son respect de la présente loi. Rapport annuel du ministre (4) Chaque exercice, à compter du premier exercice complet après l’entrée en vigueur du présent paragraphe, le ministre: (a) établit un rapport annuel pour le dernier exercice relativement aux activités du Secrétariat aux affaires acadiennes et francophones et des institutions gouvernementales; (b) dépose son rapport annuel devant l’Assemblée législative, dans les 15 premiers jours d’une session de l’Assemblée législative. 2013,c.32,s.10. PLAINTES 11. Agent aux plaintes (1) Le ministre nomme à titre d’agent aux plaintes une personne bilingue (français et anglais) qui lui est redevable et qui est chargée d’exercer les fonctions prévues à la présente loi et aux règlements en matière de plaintes. Rémunération et remboursement de dépenses (2) Le lieutenant-gouverneur en conseil fixe la rémunération et les dépenses remboursables de l’agent aux plaintes. 2013,c.32,s.11. 12. Plainte (1) La personne qui estime qu’une institution gouvernementale ne s’est pas conformée ou ne se conforme pas aux articles 3 ou 4 peut formuler une plainte en ce sens auprès du coordonnateur de l’institution, selon les délais suivants: (a) dans un délai de 60 jours après la date du défaut de conformité reproché; (b) dans un délai de 60 jours après la date du début de ce défaut, s’il s’étend ou s’est étendu sur une période de plus d’un jour. Forme de la plainte (2) La personne qui désire porter plainte en vertu du paragraphe (1): (a) énonce par écrit la plainte et les motifs s’y rattachant; (b) signe la plainte; (c) signifie la plainte au coordonnateur. Page 20 Current to: December 14, 2013 t c PLAINTES French Language Services Act Section 13 Devoirs du coordonnateur (3) Sur réception d’une plainte portée conformément au paragraphe (2), le coordonnateur: (a) en avise le dirigeant principal de l’institution gouvernementale; (b) fait enquête sur la plainte dans la mesure où il le juge indiqué; (c) sous réserve du paragraphe (4), tente de résoudre la plainte. Rejet de la plainte (4) Le coordonnateur peut rejeter la plainte s’il estime: (a) soit qu’elle est frivole, vexatoire ou dénuée de fondement; (b) soit qu’elle n’a pas été portée dans le délai prescrit par le paragraphe (1). Avis de rejet de la plainte (5) S’il rejette la plainte, le coordonnateur en avise le dirigeant principal de l’institution gouvernementale et signifie au plaignant: (a) un avis motivé du rejet; (b) un avis du droit du plaignant de solliciter le contrôle du rejet en vertu du paragraphe 13(1). Renvoi à l’agent aux plaintes (6) S’il ne rejette ni ne résout la plainte, le coordonnateur: (a) la renvoie à l’agent aux plaintes; (b) avise le dirigeant principal de l’institution gouvernementale du renvoi; (c) signifie au plaignant un avis du renvoi. Idem (7) Lors du renvoi d’une plainte à l’agent aux plaintes, le coordonnateur signifie à ce dernier copie des pièces suivantes: (a) la plainte; (b) les documents ou les renseignements qu’il a recueillis concernant la plainte. 2013,c.32,s.12. 13. Demande de contrôle du rejet de la plainte (1) Au plus tard 15 jours après avoir reçu signification d’un avis du rejet de sa plainte par le coordonnateur en vertu du paragraphe 12(5), le plaignant peut signifier une demande de contrôle du rejet de la plainte au coordonnateur et à l’agent aux plaintes.

Devoir du coordonnateur (2) Au plus tard 15 jours après avoir reçu signification de la demande de contrôle du rejet de la plainte, le coordonnateur en avise le dirigeant principal de l’institution gouvernementale et signifie à l’agent aux plaintes copie des pièces suivantes: (a) la plainte; (b) les documents ou les renseignements qu’il a recueillis concernant la plainte; (c) l’avis motivé du rejet de la plainte par le coordonnateur. c t Current to: December 14, 2013 Page 21 PLAINTES Section 14 French Language Services Act Décision (3) Au plus tard 15 jours après avoir reçu signification de la plainte et des documents et renseignements connexes par le coordonnateur en vertu du paragraphe (2), l’agent aux plaintes examine le rejet de la plainte et le confirme ou l’infirme. Avis (4) Lorsqu’il confirme ou infirme le rejet de la plainte en vertu du paragraphe (3), l’agent aux plaintes signifie au plaignant et au dirigeant principal de l’institution gouvernementale visée un avis motivé de sa décision. 2013,c.32,s.13. 14. Enquête de l’agent aux plaintes (1) S’il est saisi d’une plainte en vertu du paragraphe 12(6) ou s’il infirme le rejet d’une plainte en vertu du paragraphe 13(3), l’agent aux plaintes fait enquête à son égard dans la mesure ou il l’estime indiqué. Résolution ou rejet (2) L’agent aux plaintes peut: (a) tenter de résoudre la plainte; (b) rejeter la plainte s’il estime: (i) soit qu’elle est frivole, vexatoire ou dénuée de fondement, (ii) soit qu’elle n’a pas été portée dans le délai prescrit par le paragraphe 12(1). Avis de rejet de la plainte (3) S’il rejette la plainte, l’agent aux plaintes signifie au plaignant et au dirigeant principal de l’institution gouvernementale visée un avis motivé du rejet de la plainte. Observations (4) S’il ne résout ni ne rejette la plainte au plus tard 30 jours après en avoir été saisi en vertu du paragraphe 12(6) ou après en avoir infirmé le rejet en vertu du paragraphe 13(3), l’agent aux plaintes signifie aux personnes suivantes un avis concernant leur droit de lui présenter des observations relatives à la plainte: (a) le plaignant; (b) le dirigeant principal de l’institution gouvernementale visée; (c) toute autre personne qu’il juge appropriée. Procédure fixée par l’agent aux plaintes (5) L’agent aux plaintes peut déterminer: (a) si les observations sont présentées oralement ou par écrit; (b) si une personne a le droit de prendre connaissance des observations ou d’y répondre ou le droit d’être présente lorsqu’elles sont communiquées. Pouvoirs de l’agent aux plaintes (6) L’agent aux plaintes peut: (a) exiger la production et procéder à l’examen de tout dossier relatif à la plainte sous la garde de l’institution gouvernementale visée ou d’un tiers fournissant un service désigné en son nom; (b) procéder à la visite des locaux mentionnés dans la plainte et occupés par l’institution gouvernementale visée ou le tiers qui fournit un service désigné en son nom. Page 22 Current to: December 14, 2013 t c DISPOSITIONS GÉNÉRALES French Language Services Act Section 15 Rapport (7) Après avoir reçu ou entendu des observations et avoir terminé son enquête sur une plainte, l’agent aux plaintes prend les mesures suivantes dans un délai raisonnable: (a) il établit un rapport écrit indiquant: (i) ses conclusions à l’égard des allégations contenues dans la plainte, (ii) ses recommandations à l’égard des allégations en question; (b) il signifie copie du rapport: (i) au plaignant, (ii) au dirigeant principal de l’institution gouvernementale visée, (iii) au ministre. Présentation dans le rapport annuel (8) Le ministre présente dans le rapport annuel qu’il soumet à l’Assemblée législative conformément au paragraphe 10(4) des renseignements concernant les plaintes portées en vertu de la présente loi pendant le dernier exercice, notamment l’issue de ces plaintes et les mesures prises par les institutions gouvernementales pour y répondre. 2013,c.32,s.14. DISPOSITIONS GÉNÉRALES 15. Signification (1) Pour l’application de la présente loi ou des règlements, la signification d’avis ou de documents peut être valablement effectuée par: (a) leur remise en mains propres à leur destinataire; (b) leur transmission par télécopieur ou d’autres moyens électroniques à leur destinataire; (c) leur envoi par courrier ordinaire à leur destinataire, à sa dernière adresse connue. Signification réputée (2) La signification d’avis ou de documents par télécopieur ou par d’autres moyens électroniques conformément au paragraphe (1) est réputée effectuée au moment où l’expéditeur reçoit un accusé de réception à leur égard. Idem (3) La signification d’avis ou de documents par courrier ordinaire conformément au paragraphe (1) est réputée effectuée sept jours après leur mise à la poste. 2013,c.32,s.15. 16. Règlements (1) Le lieutenant-gouverneur en conseil peut prendre des règlements d’application de la présente loi. Dans le cadre de tels règlements, il peut notamment: (a) déterminer les services constituant des services désignés, sous réserve des paragraphes (2) à (5); (b) déterminer les organismes ayant qualité d’institutions gouvernementales; (c) fixer les mesures devant être prises pour informer le public qu’un service désigné d’une institution gouvernementale est offert en français ou en anglais, au choix de la personne; c t Current to: December 14, 2013 Page 23 DISPOSITIONS GÉNÉRALES Section 16 French Language Services Act (d) établir les modalités ayant trait à la participation aux consultations publiques en français; (e) établir les modalités ayant trait au Secrétariat aux affaires acadiennes et francophones; (f) établir les modalités ayant trait au Comité consultatif; (g) déterminer les attributions des coordonnateurs; (h) établir les modalités ayant trait au comité des coordonnateurs constitué en vertu du paragraphe 9(2); (i) établir les modalités ayant trait aux plans annuels et aux rapports annuels des institutions gouvernementales; (j) déterminer les attributions de l’agent aux plaintes; (k) établir les modalités ayant trait au processus de plainte; (l) établir les modalités ayant trait aux consultations avec le Comité consultatif en vertu du paragraphe (4); (m) définir les termes ou les expressions qui sont utilisés dans la présente loi mais qui n’y sont pas définis; (n) prendre toute autre mesure d’ordre réglementaire prévue par la présente loi; (o) prendre toute autre mesure qu’il estime nécessaire ou souhaitable pour donner effet à l’objet et à l’esprit de la présente loi. Lieu, mode ou délai (2) Le règlement pris en vertu de l’alinéa (1)(a) désignant un service peut restreindre la portée de la désignation relativement: (a) au lieu, au moment et au mode de prestation du service; (b) à toute autre considération ou circonstance ayant trait à la prestation du service que le lieutenant-gouverneur en conseil juge appropriée. Priorités de service et capacité en matière (3) Avant de désigner des services par règlement en vertu de l’alinéa (1)(a), le lieutenant- gouverneur en conseil prend en considération: (a) parmi la gamme de services que fournit l’institution gouvernementale, ceux qui sont prioritaires pour la communauté acadienne et francophone selon le Comité consultatif; (b) la capacité de l’institution gouvernementale en cause de fournir les services visés en français. Consultation (4) Avant de prendre un règlement qui modifie ou révoque la désignation de services en vertu de l’alinéa (1)(a), le ministre consulte le Comité consultatif relativement au fond du règlement envisagé. Idem (5) Suivant la consultation avec le Comité consultatif en vertu du paragraphe (4), le lieutenant- gouverneur en conseil peut prendre le règlement, sous sa forme initiale ou avec les modifications qu’il estime indiquées, sans consultation supplémentaire. 2013,c.32,s.16. Limites raisonnables Si toutes les mesures raisonnables ont été prises et que tous les plans raisonnables ont été élaborés afin de faire respecter la présente loi, les obligations qu’elle impose aux institutions gouvernementales sont assujetties aux limitations raisonnables et nécessaires qu’exigent les circonstances. 2013,c.32,s.17. 18. Authenticité égale Les versions française et anglaise de la présente loi et de ses règlements d’application ont également force de loi. 2013,c.32,s.18. 19. Abrogation La French Language Services Act R.S.P.E.I. 1988, c. F-15.1 est abrogée. 2013,c.32,s.19. 20.
