Definition 2 In these regulations, “Act” means The Marriage Act, 2021. Fee for appointment and renewal 3(1) For the purposes of subsection 2-4(1) of the Act and subject to subsection (3), the fee for appointment as a marriage commissioner is: (a) $100 for a one-day appointment; or (b) $200 for any other appointment or renewal of an appointment. (2) Subject to subsection (3), the minister shall not appoint a person as a marriage commissioner or renew a marriage commissioner=s appointment unless the fee mentioned in subsection (1) has been paid. (3) This section applies with respect to any person whose application for appointment or renewal of an appointment pursuant to the Act is received by the director on or after the date on which these regulations come into force. 29 Jly 2022 SR 54/2022 s3. Marriage commissioner appointment and renewal 4(1) For the purposes of clause 2-4(2)(a) of the Act, the prescribed term is 5 years. (2) A marriage commissioner may, before the expiry of that marriage commissioner=s appointment, apply in a manner and form acceptable to the director for renewal of the marriage commissioners appointment. (3) On receipt of an application for renewal pursuant to subsection (2) and payment of the fee mentioned in section 3, the minister may renew a marriage commissioner=s appointment. (4) If a marriage commissioner fails to apply for renewal pursuant to subsection (2) before the expiry of that marriage commissioner=s appointment, that marriage commissioner is not entitled to solemnize marriages pursuant to the Act after the date on which the appointment expires. (5) A person whose appointment expires may apply for a new appointment pursuant to subsection 2-4(1) of the Act. 29 Jly 2022 SR 54/2022 s4. Fees to director 5(1) Every issuer shall pay $35 to the director for each form of licence the issuer receives from the director. Issuer allowed to solemnize marriage with authorization 7(1) Notwithstanding section 5-5 of the Act, if authorized by the director, the following may occur: (a) a marriage identified by the director in the authorization may be solemnized by the religious official or marriage commissioner who issued the licence authorizing the marriage; (b) a religious official or marriage commissioner identified by the director in the authorization may solemnize any marriage authorized pursuant to a licence issued by that religious official or marriage commissioner. (2) An authorization pursuant to subsection (1) may be subject to any terms and conditions that the director considers appropriate. (3) A religious official, marriage commissioner or other person seeking an authorization pursuant to subsection (1) must apply to the director in the form and manner that the director may direct. 29 Jly 2022 SR 54/2022 s7. RRS c M-4.1 Reg 1 repealed 8 The Marriage Regulations, 1997 are repealed. 29 Jly 2022 SR 54/2022 s8. Transitional – licence or declaration 9 If a licence or declaration in the prescribed form pursuant to The Marriage Regulations, 1997 was issued or declared before the coming into force of these regulations, the licence or declaration is deemed to be in the form approved by the director for the purposes of the Act and these regulations. 29 Jly 2022 SR 54/2022 s9. Coming into force 10(1) Subject to subsection (2), these regulations come into force on the day on which section 1-1 of The Marriage Act, 2021 comes into force. (2) If these regulations are filed with the Registrar of Regulations after the day on which section 1-1 of The Marriage Act, 2021 comes into force, these regulations come into force on the day on which they are filed with the Registrar of Regulations. 29 Jly 2022 SR 54/2022 s10.
