1 COMMISSIONER FOR OATHS, 2013 C-16.001 REG 1 The Commissioners for Oaths Regulations, 2013 being Chapter C-16.001 Reg 1 (effective February 15, 2013, except for section 7 in force January 1, 2014) as amended by Saskatchewan Regulations 37/2023. Interpretation 2 In these regulations, “Act” means The Commissioners for Oaths Act, 2012. 15 Feb 2013 cC-16.001 Reg 1 s2. Expiry of appointment 3(1) Subject to subsection (2), for the purposes of subsection 3(2) of the Act, the appointment of a commissioner expires five years from the last day of the month in which the appointment is made, unless it is sooner revoked. (2) A commissioner may apply to renew his or her appointment as a commissioner. (3) An application for renewal pursuant to subsection (2) must be made before the expiry of the term mentioned in subsection (1). (4) If a commissioner applies to renew his or her appointment as a commissioner pursuant to subsection (2), the commissioner may continue to exercise the powers of a commissioner on the same terms and conditions as those of his or her appointment for a further period of one month after the expiry of the term mentioned in subsection (1), unless the minister sooner: (a) renews the appointment; or (b) refuses the application. 15 Feb 2013 cC-16.001 Reg 1 s3. Fee 4(1) Subject to subsections (2) and (3), the fee payable for appointment as a commissioner pursuant to the Act is $100. (2) No fee is payable by an employee of the Government of Saskatchewan: (a) who is a commissioner by virtue of his or her office or status pursuant to section 6; or (b) who is required to be appointed as a commissioner in connection with his or her duties. 4 C-16.001 REG 1 COMMISSIONER FOR OATHS, 2013 (3) A fee of $10 is payable for appointment as a commissioner by an employee mentioned in clause (a) or (b) if: (a) in the opinion of the chief of a police service established by a board or council of a municipality, it is necessary for an employee of that police service other than a police officer to be a commissioner in connection with the employee’s duties; or (b) in the opinion of a detachment commander in Saskatchewan of the Royal Canadian Mounted Police, it is necessary for an employee of that police service other than a police officer to be a commissioner in connection with the employee’s duties. 15 Feb 2013 cC-16.001 Reg 1 s4. Requirements for appointment 5 For the purposes of subsection 6(2) of the Act, no person may be appointed as a commissioner unless that person has: (a) reviewed the Guidelines for the Use of Commissioners for Oaths provided by the minister; (b) satisfied the minister that he or she understands the Guidelines for the Use of Commissioners for Oaths; and (c) satisfied the minister as to whether or not he or she has a criminal record and, if he or she has a criminal record, that the criminal record will not interfere with the performance of his or her duties as a commissioner. 15 Feb 2013 cC-16.001 Reg 1 s5. Government officials 6 For the purposes of clause 9(b) of the Act, the following government officials are commissioners by virtue of their office or status: (a) a land agrologist with responsibilities pursuant to The Provincial Lands Act, 2016; (b) a livestock inspector with responsibilities pursuant to The Animal Identification Act; (c) an inspector with responsibilities pursuant to The Animal Products Act or The Animal Health Act; (d) an officer as defined in: (i) The Provincial Lands Act, 2016; (ii) The Natural Resources Act; (e) a fishery officer as defined in The Fisheries (Saskatchewan) Act, 2020; (f) a wildlife officer as defined in The Wildlife Act, 1998; 5 COMMISSIONER FOR OATHS, 2013 C-16.001 REG 1 (g) the following officials with responsibilities pursuant to The Revenue and Financial Services Act: (i) a collections manager, supervisor or senior collections officer whose responsibilities include collection of revenue for the Crown in right of Saskatchewan; (ii) an audit manager or audit supervisor whose responsibilities include auditing tax collection; (h) the director of the Aboriginal Courtworker Program; (i) a family support officer whose responsibilities include enforcement of maintenance orders pursuant to The Enforcement of Maintenance Orders Act, 1997; (j) an official of the Ministry of Justice and Attorney General whose responsibilities include collecting fines and enforcing restitution orders pursuant to The Summary Offences Procedure Act, 1990; (k) an employment standards officer as defined in Part II of The Saskatchewan Employment Act; (l) an occupational health officer as defined in Part III of The Saskatchewan Employment Act; (m) a northern municipal advisor employed in the Northern Municipal Services Branch of the Ministry of Government Relations; (n) a land agent, land officer, land manager or traffic officer whose responsibilities include preparation of affidavits in connection with the administration and enforcement of The Highways and Transportation Act, 1997; (o) an official whose responsibilities pursuant to The Saskatchewan Assistance Act and The Saskatchewan Income Plan Act include: (i) receiving applications for assistance; (ii) conducting eligibility reviews; (iii) verifying information of a recipient or with respect to a recipient; (p) a director or officer as defined in The Child and Family Services Act; (q) an adoption worker pursuant to The Adoption Act, 1998; (r) a director or deputy director of a correctional facility or a probation officer appointed pursuant to The Correctional Services Act, 2012; (s) a supervisor within young offender programs with responsibilities pursuant to The Youth Justice Administration Act, 2019; (t) a firearms officer, as defined in the Firearms Act (Canada), who is designated in writing as a firearms officer for Saskatchewan pursuant to that Act. 15 Feb 2013 cC-16.001 Reg 1 s6; 26 May 2023 SR 37/2023 s2. 6 C-16.001 REG 1 COMMISSIONER FOR OATHS, 2013 Registrar of Provincial Court a commissioner 7(1) For the purposes of clause 10(1)(h) of the Act, the Registrar of the Provincial Court is a commissioner by virtue of his or her office and is not required to apply for an appointment as a commissioner. (2) On every affidavit, declaration or affirmation, the Registrar of the Provincial Court shall display the following words below his or her signature: “A Commissioner for Oaths for Saskatchewan, being a court official”. 15 Feb 2013 cC-16.001 Reg 1 s7. R.R.S. c.C-16 Reg 1 repealed 8 The Commissioners for Oaths Regulations are repealed. 15 Feb 2013 cC-16.001 Reg 1 s8. Coming into force 9(1) Subject to subsections (2) and (3), these regulations come into force on the day on which section 1 of The Commissioners for Oaths Act, 2012 comes into force. (2) If section 1 of The Commissioners for Oaths Act, 2012 comes into force before these regulations are filed with the Registrar of Regulations, these regulations come into force on the day on which they are filed with the Registrar of Regulations. (3) If section 1 of The Commissioners for Oaths Act, 2012 comes into force before The Court Officials Act, 2012 comes into force, section 7 comes into force on the day on which section 1 of The Court Officials Act, 2012 comes into force. 15 Feb 2013 cC-16.001 Reg 1 s9.
