1 LEGISLATION ACT (PART 4) L-10.2 REG 3 The Legislation Act (Part 4) Regulations being Chapter L-10.2 Reg 3 (effective April 22, 2021). NOTE: This consolidation is not official. Definitions 2 In these regulations: “Act” means The Legislation Act; (« Loi ») “registrar” means registrar as defined in Part 4 of the Act; (« registraire ») “revised regulation” means a regulation that is part of The Revised Regulations of Saskatchewan; (« règlement révisé ») “The Revised Regulations of Saskatchewan” means the body of regulations that consists of all regulations that are: (a) enacted on or after December 5, 1980 pursuant to new Acts that have been assigned an alphanumeric chapter number; (b) numbered in accordance with section 3; and (c) published in Part II of the Gazette; (« Règlements révisés de la Saskatchewan ») “Saskatchewan Regulations” means the body of regulations that consists of the following: (a) all unrevised regulations; (b) all regulations that amend revised regulations; (c) all regulations that are: (i) made pursuant to new Acts enacted on or after January 1, 2020 that have been assigned a numeric chapter number; (ii) numbered in accordance with section 5; and (iii) published in Part II of the Gazette; (d) all regulations that amend a regulation mentioned in clause (c); (« Règlements de la Saskatchewan ») “Saskatchewan Regulations number” means the number mentioned in subsection 5(2) or (3); (« numéro d’ordre des Règlements de la Saskatchewan ») 4 L-10.2 REG 3 LEGISLATION ACT (PART 4) “unrevised regulation” means any regulation: (a) that was enacted before December 5, 1980; or (b) that: (i) amends a regulation mentioned in clause (a); (ii) is numbered in accordance with section 5; and (iii) is published in Part III of the Gazette. (« règlement non révisé ») 30 Apr 2021 c L-10.2 Reg 3 s2. Numbering revised regulations 3(1) Subject to subsection (2), the registrar shall number revised regulations by using the alphanumeric chapter number of the Act pursuant to which the regulations are made, followed by the abbreviation “Reg” and a number that corresponds with the order in which the regulations pursuant to that Act are made. (2) The registrar may assign regulation numbers to revised regulations before the regulations are enacted. (3) If, as a result of the assignment of regulation numbers pursuant to subsection (2), the number of a revised regulation deviates from the order of enactment of regulations pursuant to an Act, that deviation does not constitute an error in assigning a number to the regulation for the purposes of section 7. 30 Apr 2021 c L-10.2 Reg 3 s3. Citing revised regulations 4 A revised regulation may be cited: (a) by using its title, as set out in section 1 of the regulation; (b) by using the expression “The Revised Regulations of Saskatchewan”, followed by the word “chapter”, the alphanumeric chapter number of the Act and the number of the regulation, using the abbreviation “Reg”, as printed in the Gazette; or (c) by using the abbreviation “RRS”, followed by the abbreviation “c”, the alphanumeric chapter number of the Act and the number of the regulation, using the abbreviation “Reg”, as printed in the Gazette. Examples: The Court of Appeal Fees Regulations, 2019 The Revised Regulations of Saskatchewan, chapter C-42.1 Reg 2 RRS c C-42.1 Reg 2 30 Apr 2021 c L-10.2 Reg 3 s4. 5 LEGISLATION ACT (PART 4) L-10.2 REG 3 Numbering Saskatchewan Regulations 5(1) With respect to Saskatchewan Regulations, the registrar shall: (a) begin a new series of regulation numbers in each year; and (b) number the regulations in the order in which they are filed. (2) Subject to subsection (3), a Saskatchewan Regulations number consists of the number assigned pursuant to clause (1)(b), an oblique stroke and the last two figures of the calendar year in which the regulation was filed. (3) In the case of Saskatchewan Regulations enacted on or after January 1, 1999, the Saskatchewan Regulations number consists of the number assigned pursuant to clause (1)(b), an oblique stroke and all figures of the calendar year in which the regulation was filed. 30 Apr 2021 c L-10.2 Reg 3 s5. Citing Saskatchewan Regulations 6 Saskatchewan Regulations may be cited: (a) by using the expression “Saskatchewan Regulations” or the abbreviation “Sask Reg”, followed by the Saskatchewan Regulations number of the regulation; or Examples: Saskatchewan Regulations 69/2020 Sask Reg 69/2020 (b) in the case of a regulation enacted on or after March 1, 1997, by using its title as set out in section 1 of the regulation. 30 Apr 2021 c L-10.2 Reg 3 s6. Correction of numbering errors 7 If an error occurs in assigning a number to a regulation, the registrar shall: (a) cancel the incorrect number assigned to the regulation; (b) assign a new number to the regulation; and (c) publish a notice in the Gazette stating the new number that has been assigned. 30 Apr 2021 c L-10.2 Reg 3 s7. 6 L-10.2 REG 3 LEGISLATION ACT (PART 4) Fees 8(1) Subject to subsections (2), (4) and (5), a person who wishes to obtain copies of regulations that have been exempted from publication in the Gazette pursuant to clause 4‑6(1)(a) or (b) of the Act or that have been published in the Gazette shall pay to the registrar a fee equal to the total of: (a) $0.15 for each page reproduced; and (b) the registrar’s cost of mailing the copies. (2) The minimum fee payable to obtain a copy of regulations mentioned in subsection (1) is $3. (3) Subject to subsections (4) and (5), a person who wishes to obtain copies of parts of regulations that are exempted from publication in the Gazette pursuant to subsection 4-6(2) of the Act shall pay to the registrar a fee equal to the total of: (a) the registrar’s cost of reproducing those parts; and (b) the registrar’s cost of mailing the copies. (4) The registrar may waive payment of a fee prescribed in this section if, in the opinion of the registrar, the person requesting the regulation or part of a regulation requires it to administer or implement the regulation. (5) The following persons are exempt from paying any fee prescribed in this section: (a) the Provincial Auditor; (b) the Clerk of the Legislative Assembly; (c) the Provincial Comptroller; (d) any Member of the Legislative Assembly. 30 Apr 2021 c L-10.2 Reg 3 s8. Statutory instruments designated as regulations 9 For the purposes of the definition of “regulation” in section 4-1 of the Act, all orders made by the Lieutenant Governor in Council pursuant to section 9 of The Reciprocal Enforcement of Judgments Act, 1996 listing the jurisdictions to which that Act applies are designated as regulations. 30 Apr 2021 c L-10.2 Reg 3 s9. RRS c R‑16.2 Reg 1 repealed 10 The Regulations Act Regulations, 1997 are repealed. 30 Apr 2021 c L-10.2 Reg 3 s10.
