Interpretation 2(1) In these regulations: (a) “Act” means The Election Act, 1996; (b) “Form” means a Form as set out in Part II of the Appendix. (2) For the purposes of the Act and in these regulations: (a) “adapt any other provision of this Act” includes the power to implement adaptations at any time and at one or more locations in Saskatchewan, including adapting all or any of the following: (i) all or any voting procedures or methods or any manner of voting established in the Act; (ii) all or any timelines, deadlines or time requirements in the Act, including expanding, abridging or extending those timelines, deadlines or time requirements except the matters mentioned in subclauses 7(1) (a) (i) to (iii) of the Act; (iii) imposing any restriction or taking any measure that the Chief Electoral Officer considers necessary or advisable to protect the health and safety of anyone involved in the election process or to reduce a health risk to the public; (b) “emergency order” includes: (i) an emergency declaration ordered pursuant to The Emergency Planning Act; or (ii) an order of the chief medical health officer declaring: (A) that a public health emergency exists in Saskatchewan; and (B) that individuals in Saskatchewan must take measures to prevent or reduce the spread of disease, including isolating themselves from other individuals; 4 E-6.01 REG 1 ELECTION (c) “an emergency exists” includes a situation in which: (i) either: (A) an emergency order was declared at any time before, during or after an election; or (B) the Chief Electoral Officer is of the opinion that it is necessary to decrease or eliminate a risk to the public presented by a disease; and (ii) as a result of the circumstance mentioned in subclause (i), the Chief Electoral Officer considers it necessary or advisable to do all or any of the things mentioned in section 7 of the Act to safely prepare for or conduct an election or complete proceedings after voting. 20 Dec 96 cE-6.01 Reg 1 s2; 4 Jun 99 SR 34/1999 s4; 19 Aug 2011 SR 58/2011 s5; 22 May 2020 SR 55/2020 s2. PART I.1 Voter Identification Address 2.1 For the purposes of subsection 72.1(1) of the Act, “address” means the residential mailing address or legal land description for the voter or individual and includes a post office box number if, in the opinion of the election officer: (a) the address for that post office box number is consistent with the address on the voters’ list for that voter or individual; or (b) in the case of a voter or individual who is not on the voters’ list, the address for that post office box number is consistent with the ordinary residence claimed by that voter or individual. 19 Aug 2011 SR 58/2011 s6. Identifying information 2.2 The prescribed information for the purposes of clause 72.1(2)(b) of the Act is the information set out in Table 1 of Part 1 of the Appendix. 19 Aug 2011 SR 58/2011 s6. PART II Forms and Certain Expenses Forms 3 For the purposes of the Act: (a) subject to clause (b), Form A is prescribed as the form of the ballot paper to be used for the purposes of the Act; (b) Form B is prescribed as the form of the ballot paper to be used for the purposes of Division E [Special Voting Provisions] of Part IV of the Act; 5 ELECTION E-6.01 REG 1 (c) Form C is prescribed as the form of election proclamation for the purposes of section 34 of the Act; (d) Form D is prescribed as the form of return to the writ for the purposes of section 171 of the Act. 20 Dec 96 cE-6.01 Reg 1 s3.; 7 Feb 2020 SR 5/2020 s3. Reimburseable expenses – donated goods and services 4 For the purposes of clause 266(1)(g) of the Act: (a) “receipt” means, in the case of donated goods and services, a receipt acknowledging the donation of the goods or services signed by: (i) the business manager, in the case of a donation to a candidate; or (ii) the chief official agent, in the case of a donation to a registered political party; (b) “supplier document” means, in the case of donated goods and services, a document that contains the following: (i) a statement signed by the donor that describes the goods or services donated, states the value of the goods or services donated and states the date the goods or services were donated; and (ii) a statement of verification by an independent commercial source of the commercial value of the goods or services donated. 20 Dec 96 cE-6.01 Reg 1 s4. PART III Election Officer Remuneration and Reimbursement and Other Election Expenses Definitions for Part and appointment of certain officers 4.1(1) In this Part: (a) “election official” means: (i) an election officer; (ii) Repealed. 22 Mar 2024 SR 11/2024 s3. (iii) an administrative assistant; (iv) an interpreter; (v) an information officer; (vi) a messenger; (vii) an office coordinator; (viii) a registration officer; 6 E-6.01 REG 1 ELECTION (ix) Repealed. 22 Mar 2024 SR 11/2024 s3. (xi) a trainer; (xii) an enumerator; or (xiii) any other position that the Chief Electoral Officer approves as being required to properly administer an election; (b) “online training assignment” means training material delivered through a web-based e-learning application and assigned by the Chief Electoral Officer. (2) A returning officer may appoint a person as an election official: (a) in any of the positions mentioned in subclauses (1)(a)(i) to (xii); or (b) in any other position with respect to which the returning officer is directed and authorized by the Chief Electoral Officer to make the appointment. (3) Subject to the Act, the Chief Electoral Officer shall determine the duties and responsibilities to be assigned to any of the positions mentioned in subsection (2). 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s3. Prorated remuneration and allowances for part of day, hour or period 4.11(1) Notwithstanding any other provision of these regulations but subject to subsection (2), if an election official is to be paid remuneration or an allowance pursuant to this Part based on a daily or hourly rate and the election official provides services or attends for less than a day or an hour, as the case may be, the election official is to be paid a prorated amount of the daily or hourly rate for that portion of the day or hour the election official serves or attends. (2) In the case of remuneration for a daily rate, subsection (1) does not apply if the remuneration is expressed to be for a day or part of a day. (3) Notwithstanding any other provision of these regulations, if an election official is to be paid remuneration or an allowance pursuant to this Part as a flat rate for services or attendance for a period specified in these regulations and the election official provides services or attends for less than the specified period, the election official is to be paid a prorated amount of the flat rate or allowance for the portion of the period the election official serves or attends. 20 Sep 2019 SR 66/2019 s2. Returning officers 4.12(1) A returning officer for a constituency is entitled to be paid the following remuneration and to be reimbursed for the following expenses: (a) a monthly allowance of $99 for each month or part of a month under contract; 7 ELECTION E-6.01 REG 1 (b) remuneration at the rate of $33 per hour for services provided before the issue of a writ of election; (c) remuneration of $7,425 provided during the period commencing on the day of the issue of a writ of election and ending on the day fixed for polling day; (d) an allowance of $2,475 provided during the period commencing after polling day and ending on the day fixed for the return to the writ; (e) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the returning officer is necessarily absent from the returning officer’s place of residence in the performance of duties as a returning officer; (f) reimbursement for any expenses for goods or services incurred in the execution of the duties as a returning officer and conducting the election, but only if: (i) in the opinion of the Chief Electoral Officer, the amount of the expense is reasonable; and (ii) the returning officer supplies the Chief Electoral Officer with receipts for the expenses. (2) A returning officer is entitled to be paid the following remuneration and to be reimbursed for the following expenses for attending at a recount: (a) remuneration at the rate of $33 per hour for attending at the recount; (b) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the returning officer is necessarily absent from the returning officer’s place of residence in attending at the recount. (3) A returning officer is entitled to be paid the following remuneration and to be reimbursed for the following expenses for attending at a returning officers’ training session called by the Chief Electoral Officer: (a) remuneration at the rate of $33 per hour for attending at the training session; (b) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the returning officer is necessarily absent from the returning officer’s place of residence in attending at the training session. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s4. Election clerks 4.2(1) An election clerk for a constituency is entitled to be paid the following remuneration and to be reimbursed for the following expenses: (a) remuneration of $6,300 provided during the period commencing on the day of the issue of a writ of election and ending on the day fixed for polling day; 8 E-6.01 REG 1 ELECTION (b) remuneration at the rate of $28 per hour for services provided before the issue of a writ of election; (c) an allowance of $2,100 for services provided during the period commencing after polling day and ending on the day fixed for the return to the writ; (d) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the election clerk is necessarily absent from the election clerk’s place of residence in the performance of duties as an election clerk. (2) An election clerk is entitled to be paid the following remuneration and to be reimbursed for the following expenses for attending at a recount: (a) remuneration at the rate of $28 per hour for attending at the recount; (b) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the election clerk is necessarily absent from the election clerk’s place of residence in attending at the recount. (3) An election clerk is entitled to be paid the following remuneration and to be reimbursed for the following expenses for attending at an election clerks’ training session called by the Chief Electoral Officer: (a) remuneration at the rate of $28 per hour for attending at the training session; (b) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the election clerk is necessarily absent from the election clerk’s place of residence in attending at the training session. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s5. Deputy returning officer 4.21 A deputy returning officer for a constituency is entitled to be paid the following remuneration and allowance: (a) remuneration of $20.50 per hour for each hour spent performing duties, other than completing an online training assignment; (b) an allowance of $15 for each online training assignment completed as directed by the returning officer. 22 Mar 2024 SR 11/2024 s6. Supervisory deputy returning officer 4.3 A supervisory deputy returning officer for a constituency is entitled to be paid the following remuneration and allowance: (a) remuneration of $23 per hour for each hour spent performing duties, other than completing an online training assignment; 9 ELECTION E-6.01 REG 1 (b) Repealed. 22 Mar 2024 SR 11/2024 s7. Poll clerk 4.31 A poll clerk for a constituency is entitled to be paid the following remuneration and allowance: (a) remuneration of $17 per hour for each hour spent performing duties, other than completing an online training assignment; (b) Repealed. 22 Mar 2024 SR 11/2024 s8. Interpreters 4.4 An interpreter used pursuant to subsection 78(1) of the Act is entitled to be paid remuneration of $16 per hour for each hour spent performing duties. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s9. Information officers 4.41 An information officer is entitled to be paid the following remuneration and allowance: (a) remuneration of $16 per hour for each hour spent performing duties, other than completing an online training assignment; (b) Repealed. 22 Mar 2024 SR 11/2024 s10. (c) an allowance of $15 for each online training assignment completed as directed by the returning officer. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s10. Rental of polling places 4.5(1) A returning officer is authorized to issue payment for renting a polling place for the day of an election, the five days of an advance poll, the day after the end of advance voting, or the day before the start of advance voting in an amount equal to the sum of: (a) $200 per day; and (b) if the polling place is used for more than one poll, $50 per day for each poll in addition to the first poll. 10 E-6.01 REG 1 ELECTION (2) The rent mentioned in this section is to cover a charge for utilities, including heat and light, for janitorial services and for any tables, chairs or other furniture to be used at the polling place. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s11. Personal care facility poll, mobile poll or temporarily displaced voter poll 4.6(1) Repealed. 22 Mar 2024 SR 11/2024 s12. (2) A returning officer is entitled to be reimbursed for the expense of arranging and paying for transportation to and from a mobile poll or temporarily displaced voter poll for all election officers and for transporting all election materials but only if: (a) in the opinion of the Chief Electoral Officer, the amount of the expense is reasonable; and (b) the returning officer supplies the Chief Electoral Officer with receipts for the expense. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s12. Messengers 4.7 A messenger appointed by a returning officer to deliver ballot boxes or election materials to an election officer is entitled to be paid the following remuneration and to be reimbursed for the following expenses: (a) remuneration of $16 for each hour spent performing duties; (b) reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred while the messenger is necessarily absent from the messenger’s place of residence in the performance of duties as a messenger. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s13. Enumerators 4.71 An enumerator is entitled to be paid the following remuneration and allowance: (a) remuneration of $16 per hour for each hour spent performing duties, other than completing an online training assignment; (b) Repealed. 22 Mar 2024 SR 11/2024 s14. Office coordinators 4.83 An office coordinator is entitled to be paid remuneration of $23.50 per hour for each hour spent performing duties. 22 Mar 2024 SR 11/2024 s18. Trainers 4.84 A trainer is entitled to be paid remuneration of $23.50 per hour for each hour spent performing duties. 22 Mar 2024 SR 11/2024 s19. Administrative assistants 4.85 An administrative assistant is entitled to be paid an allowance of $19 per hour for each hour spent performing duties. 20 Sep 2019 SR 66/2019 s2; 22 Mar 2024 SR 11/2024 s20. 4.86 Repealed. 22 Mar 2024 SR 11/2024 s21. Cell phone reimbursement 4.9(1) In this section, ‘poll official’ means a supervisory deputy returning officer, deputy returning officer or poll clerk. (2) Poll officials are entitled to be reimbursed for the use of their personal cell phone in the performance of their duties, when requested by the returning officer, at a rate of $5 for each day they are required to attend at a polling location. 20 Sep 2019 SR 66/2019 s2. Travel allowances 4.91 Every election official is entitled to reimbursement, at the rates paid to members of the public service of Saskatchewan, for any travel, sustenance and accommodation expenses incurred for: (a) travel to and from a training session or school of instruction; (b) travel to and from a poll on election day; 12 E-6.01 REG 1 ELECTION (c) travel to and from an advance poll on each day an advance poll is held; (d) travel to receive or return a ballot box at the direction of a returning officer; (e) travel while discharging duties connected to voter registration; (f) travel while discharging duties connected with a mobile poll or a temporarily displaced voter poll. 20 Sep 2019 SR 66/2019 s2. PART IV Coming into Force Coming into force 5(1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Election Act, 1996 comes into force. The counterfoil shall be that portion of the ballot paper which is to the right of the stub and which is two inches (2.08 centimetres) in width. The portion of the ballot paper in which the names and other particulars of candidates are listed shall be that portion of the ballot paper which is to the right of the counterfoil and shall be four and one-half inches (11.43 centimetres) in width. The stub shall be in the natural colour of the paper. The counterfoil shall be coloured black, with the instructions to vote appearing in the natural colour of the paper and reading as follows: INSTRUCTIONS TO VOTE Vote by making a cross X within the circle to the right of the candidate’s name of your choice. The portion of the ballot paper in which the names and other particulars of candidates are listed shall be coloured black with the names and other particulars of the candidates and circles to the right of the name of each candidate appearing in the natural colour of the paper. The circles shall be one-half inch (1.27 centimetres) in diameter and shall be one-sixteenth of an inch (0.4064 centimetres) from the right side of the ballot paper and the last letter of the name of each candidate shall end one-sixteenth of an inch (0.4064 centimetres) to the left of the circle.
