1 INTESTATE SUCCESSION I-13.2 REG 1 The Intestate Succession Regulations being Chapter I-13.2 Reg 1 (effective October 1, 2019). In order to preserve the integrity of the original statutes and regulations, errors that may have appeared are reproduced in this consolidation. 2 I-13.2 REG 1 INTESTATE SUCCESSION CHAPTER I-13.2 REG 1 The Intestate Succession Act, 2019 Title 1 These regulations may be cited as The Intestate Succession Regulations. Definition 2 In these regulations, “Act” means The Intestate Succession Act, 2019. 20 Sep 2019 c I-13.2 Reg 1 s2. Prescribed amounts 3(1) For the purposes of section 6 of the Act, if the net value of the estate does not exceed $200,000, the entirety of the estate shall be distributed to the spouse. (2) For the purposes of subclause 6(1)(b)(i) of the Act, if the net value of the estate exceeds $200,000, the spouse is entitled to the greater of the following amounts: (a) $200,000; (b) ½ of the net value of the estate. 20 Sep 2019 c I-13.2 Reg 1 s3. Coming into force 4(1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Intestate Succession Act, 2019 comes into force. (2) If these regulations are filed with the Registrar of Regulations after the day on which section 1 of The Intestate Succession Act, 2019 comes into force, these regulations come into force on the day on which they are filed with the Registrar of Regulations. 20 Sep 2019 c I-13.2 Reg 1 s4.
