Definitions and interpretation 2(1) In these regulations: “Act” means The Wildlife Act, 1998; “adult”, with respect to wildlife, means wildlife 1 year of age or older; “allowed list” means the list of allowed species of wildlife set out in Table 1 of the Appendix; “allowed species” means a species of wildlife that is listed in Table 1 of the Appendix or designated pursuant to section 4; “band” means a leg marker issued or approved by the minister bearing identifying marks specific to that band; “captive upland game bird licence” means a captive wildlife licence issued for the purpose of raising, releasing or selling upland game birds; “captive wildlife” means wildlife that is held in captivity; “captive wildlife licence” means a licence to hold wildlife in captivity issued, renewed or continued pursuant to these regulations and includes the following: (a) a captive wildlife licence issued pursuant to section 9 or renewed pursuant to section 10; (b) a temporary captive wildlife licence issued pursuant to section 57; “dangerous wildlife” means a restricted species of wildlife that poses a risk to public health or public safety if held in captivity; “enclosure” means a place: (a) where captive wildlife is confined; and (b) that is constructed so that the confined captive wildlife has no means of escape; and includes pens and cages, fences, shelters and buildings; “falconry” means the use or training of a raptor for the sport of hunting and may include one or more of the following activities: (a) bird abatement; (b) breeding of raptors for falconry purposes; 4 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 “falconry licence” means a captive wildlife licence for falconry purposes; “ministry” means the ministry over which the minister presides; “raptor” means a bird of prey, whether taken from the wild or hatched and raised in captivity, and includes the birds of all species of the following families: (a) Accipitridae, including Accipitrinae, the Bird Hawks; (b) Buteoninae, the Broad‑winged Hawks and Eagles; (c) Circinae, the Harriers; (d) Falconidae, the Falcons; (e) Pandionidae, the Osprey; (f) Strigidae and Tytonidae, the owls; “restricted list” means the list of restricted species set out in Table 2 of the Appendix; “restricted species” means a species of wildlife: (a) that is listed in Table 2 of the Appendix or designated pursuant to section 4; and (b) that may be held in captivity only: (i) with a licence issued pursuant to the Act or these regulations; or (ii) pursuant to a determination by the minister made in accordance with section 55; “scientific research licence” means a captive wildlife licence for the purpose of conducting scientific research; “shelter” means a building, den, denning box or house that: (a) protects wildlife from weather; and (b) is constructed so that it is waterproof and windproof on at least 3 sides and the roof; “travelling zoo” means a business or organization that temporarily imports and exports wildlife to further conservation, scientific research and public education; “travelling zoo licence” means a captive wildlife licence issued for the purpose of operating a travelling zoo; “unlisted species” means a species of wildlife that is not listed as an allowed species or a restricted species; “veterinarian” means: (a) a registered member of the Saskatchewan Veterinary Medical Association who is in good standing and who is licensed to practise veterinary medicine in Saskatchewan; 5 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 (b) a person who satisfies the minister that the person is a veterinarian who is in good standing and licensed to practice veterinary medicine in another jurisdiction; “wildlife rehabilitation” means the treatment and care of sick, injured or abandoned native wildlife that are: (a) temporarily held in captivity; and (b) to be released after the period of rehabilitation; “wildlife rehabilitation facility” means a location where wildlife is held for the purpose of wildlife rehabilitation; “wildlife rehabilitation licence” means a captive wildlife licence for the purpose of wildlife rehabilitation; “zoo” means a permanent location where captive wildlife is held primarily to further the purposes of conservation, scientific research and public education; “zoo licence” means a captive wildlife licence issued for the purpose of operating a zoo. (2) For the purposes of the definition of “wildlife” in section 2 of the Act, “vertebrate animal” includes any hybrid animal that has an ancestor, within and including 4 generations, that was an individual of a species that is wild by nature. 4 Jne 2021 c W-13.12 Reg 5 s2. Application 3 The exclusions set out in section 3 of The Wildlife Regulations, 1981 apply to these regulations with any necessary modification. 4 Jne 2021 c W-13.12 Reg 5 s3. PART 2 Designations, Prohibitions and Licences Captive wildlife – designations 4(1) After taking into consideration the factors set out in subsection (2), the minister may designate any species of wildlife as a restricted species or an allowed species for the purposes of these regulations if the minister is satisfied on reasonable, scientific grounds that it is appropriate to list the wildlife as a restricted species or an allowed species. (2) In making a decision to designate wildlife as a restricted species or an allowed species or any other decision respecting the holding of wildlife in captivity, the minister may consider any or all of the following factors: (a) whether holding the wildlife in captivity poses a risk to public health or public safety; (b) whether holding the wildlife in captivity requires special care and management; (c) whether there is a significant risk that the wildlife being held in captivity could establish in the wild in Saskatchewan; 6 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (d) whether the conservation status of the wildlife species is a concern; (e) whether the history of the wildlife species being held in captivity is short; (f) whether holding the wildlife species in captivity poses disease risk to domestic animals or native wildlife; (g) whether the wildlife species is well established in the pet industry; (h) whether there is sufficient information to evaluate the wildlife species; (i) whether the wildlife is native to Saskatchewan; (j) any other criteria the minister considers appropriate to further the purposes of the Act and these regulations. (3) If the minister designates any wildlife as a restricted species or an allowed species pursuant to subsection (1), the minister shall cause the designation to be: (a) published in the Gazette; and (b) made known to the public in any manner the minister considers appropriate, including by publishing it on the ministry’s website. 4 Jne 2021 c W-13.12 Reg 5 s4. Prohibition – holding unlisted species in captivity 5 Except as authorized by the Act and subject to the provisions of Part 9, no person shall hold any unlisted species in captivity. 4 Jne 2021 c W-13.12 Reg 5 s5. Prohibition – holding restricted species in captivity 6(1) Except as authorized by the Act and subject to subsection (2) and the provisions of Part 9, no person shall hold any restricted species in captivity without one of the following licences: (a) a licence issued pursuant to the Act; (b) a captive wildlife licence. (2) In a prosecution for a contravention of subsection (1), the onus is on the person charged to prove that the wildlife held in captivity is not a restricted species. 4 Jne 2021 c W-13.12 Reg 5 s6. Captive wildlife licences 7 The minister may issue a captive wildlife licence to hold wildlife in captivity for any of the following purposes: (a) engaging in falconry; (b) operating a zoo or travelling zoo; (c) operating a wildlife rehabilitation facility; (d) undertaking scientific research; (e) raising, releasing or selling upland game birds. 4 Jne 2021 c W-13.12 Reg 5 s7. 7 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Licence not required 8 Notwithstanding any other provision of the Act and these regulations, a captive wildlife licence is not required to do any of the following with respect to any wildlife species that is designated by the minister as an allowed species or is listed in Table 1 of the Appendix: (a) hold the wildlife species in captivity; (b) import the wildlife species into Saskatchewan; (c) export the wildlife species from Saskatchewan; (d) ship or transport the wildlife species; (e) breed the wildlife species; (f) sell the wildlife species. 4 Jne 2021 c W-13.12 Reg 5 s8. Application for captive wildlife licence 9(1) Every person who wishes to obtain a captive wildlife licence must: (a) apply to the minister in a form satisfactory to the minister; (b) meet the requirements set out in the following: (i) in the case of an application for a falconry licence, section 31; (ii) in the case of an application for a zoo licence or a travelling zoo licence, section 40; (iii) in the case of an application for a wildlife rehabilitation licence, section 45; (iv) in the case of an application for a scientific research licence, section 49; (v) in the case of an application for a captive upland game bird licence, section 51; (c) provide the minister with any other information or material that the minister requests and considers relevant to the application; and (d) pay the fee set out in Table 3 of the Appendix for the licence applied for. (2) The minister may: (a) issue the captive wildlife licence if: (i) the requirements of subsection (1) have been met; (ii) the minister is satisfied that the applicant has complied with the Act and these regulations; and (iii) it is not contrary to the public interest; or 8 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (b) refuse to issue the captive wildlife licence if, in the opinion of the minister: (i) the requirements of subsection (1) have not been met; (ii) the applicant has not complied with these regulations; or (iii) it is not in the public interest to issue the captive wildlife licence. (3) If the minister refuses an application pursuant to clause (2)(b), the minister shall provide the applicant with written notice of the decision together with reasons. 4 Jne 2021 c W-13.12 Reg 5 s9. Renewal 10 The minister may renew a captive wildlife licence if the holder of the licence: (a) satisfies the minister that the holder continues to meet any requirements set out in these regulations to hold the captive wildlife licence; and (b) pays the fee set out in Table 3 of the Appendix for that captive wildlife licence. 4 Jne 2021 c W-13.12 Reg 5 s10. Issuance or renewal of licence on terms and conditions 11(1) When issuing or renewing a captive wildlife licence, the minister may impose any terms and conditions on that licence that the minister considers appropriate. (2) No person shall fail to comply with any term or condition imposed on the captive wildlife licence issued to that person. 4 Jne 2021 c W-13.12 Reg 5 s11. Licence or renewal term 12(1) Subject to subsection (2), a captive wildlife licence issued or renewed pursuant to these regulations expires on March 31 following the date on which it is issued or renewed unless it is previously suspended or cancelled pursuant to these regulations. (2) A falconry licence may be issued or renewed for a period not exceeding 3 years and expires on March 31 of the third year following the date on which it is issued or renewed unless it is previously suspended or cancelled pursuant to these regulations. (3) Every holder of a captive wildlife licence shall, at least 30 days before the expiry of the licence, provide to the minister: (a) a complete list of the number and species of wildlife presently held and where, from whom and when each species was obtained; (b) a complete list of the number and species of wildlife held during the past year that are no longer in that person’s possession that includes when, to whom and how each individual wildlife species was disposed of; and (c) a statement of the person’s intention to renew or not to renew the licence. 4 Jne 2021 c W-13.12 Reg 5 s12. 9 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Amendment, suspension, cancellation and non‑renewal of licence 13(1) Subject to subsection (2), the minister may amend, suspend, cancel or refuse to renew a captive wildlife licence if a captive wildlife licence holder fails to comply with: (a) the Act, these regulations, any other regulations made pursuant to the Act or any policies that the minister has established with respect to captive wildlife; (b) The Animal Protection Act, 2018 and the regulations made pursuant to that Act; or (c) The Animal Health Act and the regulations made pursuant to that Act. (2) The minister shall not amend, suspend, cancel or refuse to renew a captive wildlife licence without giving the captive wildlife licence holder an opportunity to make written representations. (3) Notwithstanding subsection (2), if the minister considers that it is necessary to act to protect the public interest, the minister may immediately suspend or cancel a captive wildlife licence without giving the captive wildlife licence holder an opportunity to make written representations, but shall give the captive wildlife holder: (a) written notice of the suspension or cancellation; and (b) an opportunity to make written representations within 15 days after the date on which the minister takes that action. (4) If the minister suspends a captive wildlife licence pursuant to this section: (a) the captive wildlife licence is suspended until the minister is satisfied that the captive wildlife licence holder has complied with: (i) the Act, these regulations and any policies mentioned in clause (1)(a); (ii) the Act and regulations mentioned in clause (1)(b); and (iii) the Act and regulations mentioned in clause (1)(c); and (b) the minister may prohibit the captive wildlife licence holder from doing any or all of the following during the suspension period: (i) obtaining wildlife; (ii) selling wildlife; (iii) trading wildlife; (iv) transporting wildlife; (v) breeding wildlife; (vi) releasing wildlife. (5) Notwithstanding any other provision of these regulations, if the minister suspends a captive wildlife licence pursuant to this section, the captive wildlife licence holder is not required to dispose of the wildlife held under the captive wildlife licence and is not in contravention of section 7 for holding wildlife in captivity without a licence during the suspension period. 10 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (6) If the minister cancels or does not renew a captive wildlife licence pursuant to this section or if the captive wildlife licence expires, the person who held the captive wildlife licence shall, in a manner determined appropriate by the minister, dispose of the wildlife held under the captive wildlife licence within 60 days after the cancellation, non‑renewal or expiry of the licence by: (a) having the wildlife destroyed by a wildlife officer or veterinarian; (b) in the case of wildlife that is held pursuant to a zoo licence or a travelling zoo licence, transferring or selling the wildlife: (i) within Saskatchewan: (A) to a person or facility that is authorized to hold that species of wildlife pursuant to the Act or these regulations; (B) to a domestic game farm licensed pursuant to The Domestic Game Farm Animal Regulations, 2019; or (C) to a fur farm licensed pursuant to The Fur Farming Regulations, 2017; or (ii) outside Saskatchewan, to a person or facility that is authorized to hold that species of wildlife pursuant to applicable legislation outside Saskatchewan; (c) in the case of native wildlife held pursuant to a wildlife rehabilitation licence: (i) transferring the wildlife within Saskatchewan, to a person or facility that is authorized to hold that species of wildlife pursuant to the Act or these regulations; or (ii) releasing the wildlife within Saskatchewan if it is determined to the satisfaction of the minister that the wildlife is healthy and able to survive in the wild; (d) in the case of wildlife that is held pursuant to a falconry licence and that is an exotic, captive‑bred species of raptor, transferring or selling the raptor: (i) within Saskatchewan, to a person or facility that is authorized to hold that species of raptor pursuant to the Act or these regulations; or (ii) outside Saskatchewan, to a person or facility that is authorized to hold that species of raptor pursuant to applicable legislation outside of Saskatchewan; (e) in the case of wildlife that is held pursuant to a falconry licence and that is a native wild‑caught species of raptor: (i) transferring the raptor within Saskatchewan, to a person or facility that is authorized to hold that species of raptor pursuant to the Act or these regulations; or (ii) releasing the raptor back to its natural habitat if it is determined to the satisfaction of the minister to be healthy and able to survive in the wild; 11 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 (f) in the case of wildlife that is held pursuant to a captive upland game bird licence, transferring or selling the upland game bird: (i) within Saskatchewan, to a person or facility authorized to hold that upland game bird pursuant to the Act or these regulations; or (ii) outside Saskatchewan, to a person or facility authorized to hold that upland game bird pursuant to applicable legislation outside of Saskatchewan; or (g) another manner of disposal, as determined and directed by the minister, and in accordance with any permit or authorization issued pursuant to the Act or these regulations. (7) The minister may extend the period for the disposal of the wildlife mentioned in subsection (6) to a maximum of 180 days if the minister is satisfied that the wildlife being disposed of do not pose a risk to: (a) public safety; and (b) the health of the wild population. (8) If the minister cancels or does not renew a captive wildlife licence or if the captive wildlife licence expires, the minister may impose any terms and conditions on the person who held the captive wildlife licence that the minister considers necessary to protect: (a) the wildlife held under that captive wildlife licence that are in the care of that person; and (b) the public. (9) No person on whom terms and conditions are imposed pursuant to subsection (8) shall fail to comply with those terms and conditions. (10) For the purposes of this section, if the minister establishes any policies, the minister shall cause those policies to be made public in any manner the minister considers appropriate, including publishing them on the ministry’s website. 4 Jne 2021 c W-13.12 Reg 5 s13. Minister’s decision final 14 Notwithstanding any Act or law, the minister’s decision to amend, suspend, cancel or not renew a captive wildlife licence is final and conclusive and no proceedings by or before the minister may be restrained by injunction, prohibition or other proceedings or are removable by certiorari or otherwise by any court. 4 Jne 2021 c W-13.12 Reg 5 s14. PART 3 General Provisions Municipal approval 15 No person shall apply for a captive wildlife licence without providing written confirmation satisfactory to the minister that the council of the municipality in which the wildlife is to be held in captivity is not opposed to the holding of the wildlife within the municipality. 4 Jne 2021 c W-13.12 Reg 5 s15. 12 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 Liability and insurance 16(1) The minister is not responsible for any damage or injury to persons or property with respect to any wildlife held in captivity or that has escaped. (2) The holder of a captive wildlife licence shall have public liability and property damage insurance in an amount appropriate for that species of wildlife, as determined by the minister, to indemnify against any claim for loss of life, bodily injury or property damage caused to any person or business as a result of wildlife held in captivity or that has escaped. 4 Jne 2021 c W-13.12 Reg 5 s16. Records and inspection 17(1) The holder of a captive wildlife licence shall keep a written record in the manner specified by the minister that sets out where and when each wildlife specimen was obtained, disposed of or released. (2) The holder of a captive wildlife licence shall, at the request of a wildlife officer, permit that wildlife officer to inspect the wildlife, enclosures and written records. (3) The records mentioned in subsection (1) are to be maintained as specified in the captive wildlife licence and retained for a period of 5 years after the person no longer holds a licence. 4 Jne 2021 c W-13.12 Reg 5 s17. Release from captivity 18(1) Subject to subsections (2) and (3), no person shall: (a) release wildlife held in captivity from captivity; or (b) allow wildlife held in captivity to roam free or escape. (2) The holder of captive wildlife whose wildlife escapes or is released from captivity: (a) shall immediately make all reasonable efforts to restore the escaped wildlife to captivity; and (b) in the case of captive wildlife held under a captive wildlife licence, shall report the full details of the escape or release to a wildlife officer as soon as possible after the escape or release. (3) The minister may authorize the release of captive wildlife if: (a) the captive wildlife is native wildlife; (b) in the opinion of the minister, the captive wildlife is healthy and able to survive in the wild; and (c) the holder of the captive wildlife complies with any terms and conditions for the release of the captive wildlife that the minister considers appropriate. (4) No person shall release any wildlife on private land without permission of the landowner. 4 Jne 2021 c W-13.12 Reg 5 s18. 13 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Importing and exporting captive wildlife 19(1) Subject to subsection 34(1), no person shall import any wildlife to be held under a captive wildlife licence into, or export any captive wildlife from, Saskatchewan unless that person obtains an import or export licence, as the case requires, pursuant to section 31 of the Act. (2) A person who applies to import wildlife to be held under a captive wildlife licence into Saskatchewan, other than an upland game bird or a raptor held for falconry purposes, shall provide to the minister a certificate of a veterinarian attesting to the health of each wildlife specimen not earlier than 30 days before the day on which the wildlife is to be imported into Saskatchewan. (3) No person shall import any wildlife to be held under a captive wildlife licence into, or export any captive wildlife from, Saskatchewan unless: (a) in the case of the import of wildlife other than an upland game bird or a raptor held for falconry purposes: (i) a veterinarian examines the wildlife, determines that the wildlife is free from disease and provides the certificate mentioned in subsection (2) with respect to the wildlife; (ii) the person provides the minister with all of the following: (A) a copy of the certificate mentioned in subsection (2); (B) any other evidence that the minister requires to satisfy the minister that the wildlife is free from disease; and (iii) the fee set out in Table 3 of the Appendix to import wildlife to be held under a captive wildlife licence is paid; (b) in the case of the import of an upland game bird or a raptor held for falconry purposes: (i) the person provides the minister with evidence satisfactory to the minister that the upland game bird or raptor held for falconry purposes is free from disease; and (ii) the fee set out in Table 3 of the Appendix to import wildlife to be held under a captive wildlife licence is paid; (c) subject to subsection (4), in the case of the export of captive wildlife, the fee set out in Table 3 of the Appendix to export captive wildlife is paid. (4) The minister may waive any fee to be paid pursuant to subclause (3)(c) if: (a) in the opinion of the minister, exceptional circumstances exist; and (b) the minister considers it appropriate to do so. (5) This section does not apply to allowed species. 4 Jne 2021 c W-13.12 Reg 5 s19. Shipping or transporting captive wildlife 20 Unless authorized by the Act, these regulations or a captive wildlife licence, no person shall ship or transport captive wildlife. 4 Jne 2021 c W-13.12 Reg 5 s20. 14 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 Quarantine 21(1) Subject to any terms and conditions the minister considers appropriate, the minister may order the quarantine of any captive wildlife: (a) at any location; (b) for any period; and (c) for any reason or purpose the minister considers necessary. (2) If the minister issues an order pursuant to subsection (1), the minister shall give written notice to those who hold the captive wildlife and who are directly affected by the quarantine and cause a notice of the quarantine to be made public in any manner the minister considers appropriate, including by posting the notice on the ministry’s website. 4 Jne 2021 c W-13.12 Reg 5 s21. Diseased wildlife 22(1) In this section, “CWHC” means the Canadian Wildlife Health Cooperative. (2) Unless authorized by the Act, these regulations or a captive wildlife licence, no person shall: (a) hold in captivity, any wildlife that the person knows or ought reasonably to know is diseased; (b) allow any captive wildlife that the person knows or ought reasonably to know is diseased to be transferred to another person; (c) accept or obtain captive wildlife that the person knows or ought reasonably to know is diseased; or (d) release to the wild, captive wildlife that the person knows or ought reasonably to know is diseased. (3) The minister may order any captive wildlife that is diseased, or that the minister has reasonable grounds to believe is diseased, to be destroyed. (4) A person who imports any wildlife to be held under a captive wildlife licence that dies within 30 days after its acquisition shall report the death immediately to a wildlife officer. (5) A person holding captive wildlife shall immediately report any incidence of disease to the minister. (6) Subsections (4) and (5) do not apply to a person holding an allowed species. (7) Immediately on finding any dead captive wildlife, a person who holds a captive wildlife licence shall, if the person reasonably believes or ought reasonably to know that disease is the cause of death, submit the dead wildlife to the CWHC unit at the University of Saskatchewan for examination and report the findings to the minister. 4 Jne 2021 c W-13.12 Reg 5 s22. 15 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Enclosures generally 23 Subject to section 24, no person shall hold captive wildlife under a captive wildlife licence unless: (a) the enclosure in which the captive wildlife is kept is securely locked so as to prevent the following: (i) public access to the enclosure; and (ii) the escape of the wildlife; and (b) the enclosure meets any additional standards with respect to enclosures that are: (i) set out in these regulations; and (ii) required for the type of licence under which the captive wildlife is held. 4 Jne 2021 c W-13.12 Reg 5 s23. Dangerous wildlife 24(1) Subject to subsections (2) and (3), no person shall hold any dangerous wildlife in captivity unless: (a) that person holds a licence issued pursuant to the Act or a captive wildlife licence issued pursuant to these regulations; (b) the enclosure holding the dangerous wildlife is surrounded by a secondary fence constructed so that the public cannot enter within 1 metre of the enclosure; (c) signs are posted, in conspicuous places around the enclosure holding the dangerous wildlife, warning the public that the wildlife is dangerous; and (d) entrances and exits to the enclosure holding the dangerous wildlife are secured and access is impeded by means of locks. (2) Clauses (1)(b) and (c) do not apply to the holder of a falconry licence. (3) The minister may allow the holder of a zoo licence or travelling zoo licence to display dangerous wildlife if the minister is satisfied that the person displaying the dangerous wildlife: (a) has put in place procedures to: (i) ensure that the risk to human health and public safety is addressed; (ii) care for and promote the well‑being of the dangerous wildlife on display; and (iii) handle and transport the dangerous wildlife safely; and (b) complies with the standards and requirements set out in Part 5 of these regulations. 4 Jne 2021 c W-13.12 Reg 5 s24. 16 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 Maintenance of captive wildlife 25 Every person who holds wildlife in captivity shall comply with section 3 of The Animal Protection Act, 2018, and that section applies with any necessary modification. 4 Jne 2021 c W-13.12 Reg 5 s25. Destruction of wildlife 26(1) Notwithstanding anything in any other provision of the Act or these regulations and subject to subsections (2) and (3), the minister may authorize the destruction of any wildlife held under a captive wildlife licence if, in the opinion of the minister, it is necessary to do so: (a) to ensure the safety of the public; (b) to protect human health; (c) to prevent a threat to native species and ecosystems; (d) to end the pain and suffering of any animal; or (e) for any other similar reason. (2) Any wildlife that is destroyed must be destroyed in as painless and humane a manner as possible. (3) The following persons are authorized to destroy wildlife held under a captive wildlife licence: (a) a wildlife officer; (b) a licensed veterinarian; (c) a person authorized by the minister if the person: (i) holds a captive wildlife licence issued pursuant to these regulations; and (ii) the minister is satisfied that the person has the knowledge required to destroy the species of wildlife held by that person under the licence in a manner that is consistent with subsection (2). 4 Jne 2021 c W-13.12 Reg 5 s26. Disposing of unlisted species or restricted species 27(1) Notwithstanding any other provisions of the Act or these regulations, a person, other than the holder of a captive wildlife licence, who holds wildlife that is an unlisted species or a restricted species may, with the approval of the minister and subject to any terms or conditions the minister may impose, export, sell, transfer or otherwise dispose of the wildlife: (a) within Saskatchewan, to a licensed zoo that is authorized by its licence to hold the restricted species, or unlisted species, as the case may be, that is being sold, transferred or disposed of; 17 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 (b) outside Saskatchewan, to an individual or facility that is allowed by the jurisdiction in which it is located to hold in captivity wildlife of the restricted species or the unlisted species, as the case may be; or (c) in any other manner that the minister determines is appropriate. (2) No person on whom terms or conditions are imposed by the minister pursuant to this section shall fail to comply with those terms and conditions. 4 Jne 2021 c W-13.12 Reg 5 s27. Taxonomic identification of captive wildlife – onus on holder 28(1) If a question arises concerning the taxonomic identification of any captive wildlife, the minister may require the holder of the captive wildlife to provide in a manner acceptable to the minister the taxonomic identification of the captive wildlife in question. (2) In any dispute concerning the taxonomic identification of any captive wildlife, the onus is on the person who holds the wildlife in captivity to establish the taxonomic identification of the captive wildlife in question by a method acceptable to the minister. 4 Jne 2021 c W-13.12 Reg 5 s28. Fees 29 The holder of a captive wildlife licence shall pay the fee set out in Table 3 of the Appendix opposite that licence for the issuance or renewal of the captive wildlife licence before the captive wildlife licence is issued or renewed. 4 Jne 2021 c W-13.12 Reg 5 s29. PART 4 Falconry Licences Definitions for Part 30 For the purposes of this Part: “bird abatement” means the use of a raptor by a licensed falconer to pursue, take or deter nuisance wildlife; “licensed falconer” means a person who holds a captive wildlife licence for falconry purposes. 4 Jne 2021 c W-13.12 Reg 5 s30. Requirements – falconry licence 31(1) No person shall hold wildlife in captivity for the purposes of falconry unless that person holds a falconry licence. (2) No person is entitled to hold a falconry licence unless that person: (a) has previously held a falconry licence; 18 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (b) has been apprenticed to a licensed falconer for 1 year and is sponsored by that licensed falconer; (c) provides evidence satisfactory to the minister that the person is qualified as a falconer in another jurisdiction; or (d) is sponsored by a falconry association in Saskatchewan that is recognized by the minister. (3) Every holder of a falconry licence shall provide to the minister an annual report in a manner that is acceptable to the minister. 4 Jne 2021 c W-13.12 Reg 5 s31. Banding and reporting requirements for falconry 32(1) Every holder of a falconry licence shall: (a) make the raptors that are held under the falconry licence available for banding; and (b) have the band numbers of all raptors held under the licence recorded on the person’s falconry licence. (2) No person shall remove, alter or tamper with a band that is on a raptor unless authorized by the minister. (3) Every holder of a falconry licence shall report to the minister: (a) the acquisition of a new raptor within 3 days after acquiring the raptor; and (b) in a manner approved by the minister, any changes to the information on a falconry licence within 15 days after the change. (4) Within 15 days after the death of a raptor held under a falconry licence, the holder of the falconry licence shall remove the band and return it to the minister along with a written statement indicating the cause of death. (5) All hybrid and exotic raptors must be equipped with telemetry equipment when the raptor is permitted to fly outside of an enclosure. 4 Jne 2021 c W-13.12 Reg 5 s32. Enclosures for raptors 33(1) Subject to subsection (2), every holder of a falconry licence shall maintain a permanent enclosure for the raptors held under the licence that: (a) has a top; (b) is not less than 3 metres high; (c) consists of an area of not less than 25 square metres per adult raptor; and (d) contains a shelter sufficient to house the number of raptors held. 19 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 (2) A raptor held under a falconry licence may be tethered or held in an enclosure that is: (a) suitable to provide limited unobstructed movement; (b) adequate for the protection and comfort of the raptor; and (c) appropriate, in the opinion of the minister, and approved by the minister. 4 Jne 2021 c W-13.12 Reg 5 s33. Import and export – raptors held under a falconry licence 34(1) Subject to subsection (2), a holder of a falconry licence may import or export any raptor listed on the licence for a period of not more than 30 days if the raptor accompanies the licensed falconer. (2) No holder of a falconry licence who exports a raptor taken from the wild in accordance with subsection (1) shall fail to return the raptor to Saskatchewan. (3) The holder of a falconry licence may import a raptor that may be held under a falconry licence if the holder: (a) is authorized by a licence issued pursuant to the Act or by a captive wildlife licence issued pursuant to these regulations to import the raptor; and (b) either: (i) provides the minister with evidence satisfactory to the minister that the raptor held for falconry purposes is free from disease; or (ii) ensures that the imported raptor is quarantined in a manner that is appropriate, in the opinion of the minister, for a period of not less than 14 days. 4 Jne 2021 c W-13.12 Reg 5 s34. Capturing wild raptors 35(1) No person to whom a falconry licence has been issued shall: (a) capture more than 2 raptors from the wild in a single year; or (b) at any time, have in that person’s possession for falconry purposes more than 2 raptors that were taken from the wild. (2) No holder of a falconry licence who is not a resident of Saskatchewan shall capture, possess, hold in captivity or export raptors from the wild in Saskatchewan. 4 Jne 2021 c W-13.12 Reg 5 s35. Bird abatement requirements 36(1) Subject to subsection (2), no person shall undertake any bird abatement unless authorized by the minister. (2) The minister may authorize a holder of a falconry licence to undertake bird abatement if the holder submits evidence satisfactory to the minister that the person is qualified to use a raptor to pursue, take or deter nuisance wildlife. (3) Only captive‑bred raptors may be used to undertake bird abatement. 4 Jne 2021 c W-13.12 Reg 5 s36. 20 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 Requirements for breeding raptors 37(1) Except as authorized by a licence issued pursuant to the Act or by a captive wildlife licence issued pursuant to these regulations and subject to subsection (2), no person shall breed raptors. (2) The minister may issue a falconry licence for commercial breeding to a person who provides evidence satisfactory to the minister that the person is qualified to breed raptors. (3) Every person who holds a falconry licence for commercial breeding shall, within 30 days after the expiration of the person’s falconry licence for commercial breeding, provide to the minister, in a form acceptable to the minister, a complete record of all breeding activity, movement or sale of: (a) all raptors listed on the falconry licence for commercial breeding; and (b) any offspring of a raptor listed on the falconry licence for commercial breeding. (4) Notwithstanding subsection 32(1), all offspring from the commercial breeding of raptors held under a falconry licence for commercial breeding must be banded within 10 days after hatching and the band numbers must be recorded on the ledger sheet provided by the ministry. (5) Only raptors bred in captivity may be used for breeding. (6) A holder of a falconry licence for commercial breeding may sell the offspring of raptors bred in captivity. 4 Jne 2021 c W-13.12 Reg 5 s37. PART 5 Zoo Licences and Travelling Zoo Licences Definition for Part 38 For the purposes of this Part, “CAZA” means Canada’s Accredited Zoos and Aquariums. 4 Jne 2021 c W-13.12 Reg 5 s38. CAZA standards 39(1) The standards set out in CAZA Accreditation Standards (2018 edition), published by Canada’s Accredited Zoos and Aquariums, apply to zoos and travelling zoos to which this Part applies. (2) Subject to subsection 40(3), every person operating a zoo or a travelling zoo shall comply with the standard mentioned in subsection (1). 4 Jne 2021 c W-13.12 Reg 5 s39. 21 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Requirements – zoo licence or travelling zoo licence 40(1) No person shall hold wildlife in captivity for the purpose of operating a zoo or a travelling zoo unless that person holds a zoo licence or a travelling zoo licence. (2) Subject to subsections (3) and (4), no person is entitled to hold a zoo licence or travelling zoo licence unless that person provides evidence satisfactory to the minister that the zoo or travelling zoo: (a) has CAZA accreditation; or (b) meets or exceeds CAZA accreditation standards. (3) In the circumstances set out in subsection (4), the minister may issue a zoo licence or travelling zoo licence to a person who operates a zoo or travelling zoo that was in operation before the day on which these regulations come into force but that does not have CAZA accreditation. (4) A person mentioned in subsection (3) must submit evidence satisfactory to the minister in a manner acceptable to the minister that the zoo or travelling zoo may be operated safely by providing the following: (a) the public safety protocols in place at the zoo or travelling zoo; (b) the animal enclosure and care protocols in place at the zoo or travelling zoo; (c) animal escape and recovery plans in place at the zoo or travelling zoo; (d) staff qualifications; (e) veterinary care available at the zoo or travelling zoo; (f) appropriate conservation and educational messaging in place at the zoo or travelling zoo. (5) Every person applying for a travelling zoo licence shall, on application, submit the following to the minister in a manner acceptable to the minister: (a) a list of animals held in the travelling zoo, including: (i) the species, quantity and sex of the animals; and (ii) a unique identifier for each animal; (b) the name of any person who is: (i) authorized by the holder of the travelling zoo licence to act on behalf of the licence holder; and (ii) responsible for the animals listed on the travelling zoo licence; (c) the date of entry into and exit from Saskatchewan and a list of locations at which events will be held and the dates of those events; (d) a list of any animals held in the travelling zoo that will be uncaged and situated within 1 metre of the public; 22 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (e) a list of dangerous wildlife held in the travelling zoo and a description of how the danger to the public will be mitigated; (f) the method of transportation and cage specifications for the animals held in the travelling zoo and a description of how the cages are to be secured during transport; (g) a written protocol detailing how the animals held in the travelling zoo will be transferred from the transportation vehicle to the display venue in a portable cage or container. (6) Every person to whom a travelling zoo licence is issued shall ensure that: (a) an animal held in the travelling zoo that is outside of the animal’s enclosure is under the direct control of: (i) the licence holder; or (ii) a person authorized by the licence holder who is listed on the licence; and (b) except as authorized by a captive wildlife licence, no wildlife that has been identified as dangerous wildlife as required pursuant to clause (5)(e): (i) comes into contact with the public; or (ii) is within 1 metre of the public. 4 Jne 2021 c W-13.12 Reg 5 s40. Breeding and release 41 Unless authorized by a licence issued pursuant to the Act or by the captive wildlife licence, no person to whom a zoo licence has been issued shall: (a) breed restricted species; or (b) release native wildlife. 4 Jne 2021 c W-13.12 Reg 5 s41. PART 6 Wildlife Rehabilitation Licences Definitions for Part 42 For the purposes of this Part: “IWRC” means International Wildlife Rehabilitation Council; “licensed wildlife rehabilitator” means a person who holds a wildlife rehabilitation licence. 4 Jne 2021 c W-13.12 Reg 5 s42. 23 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Standards for wildlife rehabilitation 43(1) The standards set out in Minimum Standards for Wildlife Rehabilitation, 4th edition (2012), published by the National Wildlife Rehabilitators Association and the International Wildlife Rehabilitation Council apply to wildlife rehabilitation to which this Part applies. (2) Every licensed wildlife rehabilitator shall comply with the standards mentioned in subsection (1). (3) Any captive wildlife held under a wildlife rehabilitation licence must be held in an enclosure that meets the standards mentioned in subsection (1). 4 Jne 2021 c W-13.12 Reg 5 s43. No property acquired in wildlife held for rehabilitation 44 Notwithstanding any other provisions of the Act or these regulations, no person acquires any property rights, title or interest in and to any wildlife held under a wildlife rehabilitation licence. 4 Jne 2021 c W-13.12 Reg 5 s44. Requirements – wildlife rehabilitation licence 45(1) No person shall hold any wildlife in captivity for the purpose of wildlife rehabilitation unless that person holds a wildlife rehabilitation licence. (2) No person is entitled to hold a wildlife rehabilitation licence unless that person provides evidence satisfactory to the minister that the person is qualified to rehabilitate wildlife. 4 Jne 2021 c W-13.12 Reg 5 s45. Restrictions – wildlife not to be rehabilitated 46(1) No person shall rehabilitate wildlife that is not native wildlife. (2) Subject to subsections (3) and (4), no person shall rehabilitate any of the following restricted species: (a) black bear; (b) bobcat; (c) caribou; (d) coyote; (e) cougar; (f) elk; (g) lynx; (h) moose; (i) mule deer; (j) prairie rattlesnake; 24 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (k) pronghorn; (l) white‑tailed deer; (m) wolf; (n) wolverine. (3) A licensed wildlife rehabilitator may rehabilitate the following restricted species if the wildlife is less than 1 year of age: (a) mule deer; (b) pronghorn; (c) white‑tailed deer.

(4) The minister may issue a captive wildlife licence to a person for the purposes of rehabilitating any of the restricted species mentioned in subsection (2) if: (a) in the opinion of the minister, exceptional circumstances exist; and (b) the minister considers it appropriate to do so. 4 Jne 2021 c W-13.12 Reg 5 s46. Wildlife rehabilitation practices 47 No licensed wildlife rehabilitator shall: (a) undertake the care of wildlife in a manner that habituates wildlife to people; (b) allow public viewing or profit from the viewing of wildlife held under the licence; (c) import wildlife for rehabilitation; (d) export native wildlife for rehabilitation unless authorized by the minister; (e) hold wildlife under the licence that cannot be released or hold wildlife permanently; (f) breed wildlife held under the licence; or (g) release unhealthy or diseased wildlife held under the licence from captivity. 4 Jne 2021 c W-13.12 Reg 5 s47. PART 7 Scientific Research Licences Definitions for Part 48 For the purposes of this Part: “Association for Assessment and Accreditation of Laboratory Animal Care International” means the international organization that promotes the humane treatment of animals in science; 25 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 “Canadian Council on Animal Care” means the national organization in Canada responsible for the standards for animal ethics and care in science; “Certificate of GAP ‑ Good Animal Practice” means a certificate issued by the Canadian Council on Animal Care for sound animal ethics and care programs; “research permit” means a permit issued pursuant to subsection 21(2) of the Act; “scientific research” means the careful and systematic investigation within a specific field of knowledge undertaken to establish facts or principles. 4 Jne 2021 c W-13.12 Reg 5 s48. Captive wildlife licence – scientific research 49(1) Subject to subsection (3), no person shall hold any restricted species of wildlife in captivity for the purpose of conducting scientific research unless that person holds a scientific research licence. (2) No person is entitled to hold a scientific research licence unless that person provides details satisfactory to the minister of the following: (a) the purpose of the scientific research; (b) the species of wildlife to be held in captivity for scientific research; (c) how the scientific research is to be undertaken; (d) any other information the minister may require. (3) A person may hold a restricted species of wildlife in captivity for the purpose of conducting scientific research without holding a scientific research licence if: (a) the person holds a research permit; or (b) the scientific research being conducted by the person has been approved by an animal care committee at or associated with an academic institution that holds: (i) a Certificate of GAP ‑ Good Animal Practice; or (ii) accreditation with the Association for Assessment and Accreditation of Laboratory Animal Care International. 4 Jne 2021 c W-13.12 Reg 5 s49. PART 8 Captive Upland Game Bird Licences Definitions for Part 50 For the purposes of this Part, “upland game bird” means the following: (a) Phasianus colchicus, commonly known as ring‑necked pheasants; and (b) Perdix perdix, commonly known as European gray, or Hungarian partridges. 4 Jne 2021 c W-13.12 Reg 5 s50. 26 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 Captive wildlife licence – upland game birds 51(1) No person shall hold any upland game bird in captivity for the purpose of raising, releasing or selling the upland game bird unless that person holds a captive upland game bird licence. (2) No person is entitled to hold a captive upland game bird licence unless that person provides evidence satisfactory to the minister that the person has available for use an enclosure that meets or exceeds the requirements set out in section 52. 4 Jne 2021 c W-13.12 Reg 5 s51. Enclosures for upland game birds 52 Upland game birds over 10 weeks of age are to be kept in an enclosure: (a) with a top that is not less than 2.5 metres high; (b) consisting of an area of not less than 4 square metres per bird; and (c) that contains a completely enclosed shelter sufficient to house the number of birds held. 4 Jne 2021 c W-13.12 Reg 5 s52. PART 9 Transitional Provisions Transitional – licences issued pursuant to The Captive Wildlife Regulations 53(1) Notwithstanding the repeal of The Captive Wildlife Regulations, any licence issued pursuant to those regulations as those regulations existed on the day before the coming into force of these regulations that is valid and not under suspension or cancellation on the day on which these regulations come into force: (a) continues in effect according to its terms until it expires; and (b) notwithstanding its terms: (i) in the case of a captive wildlife licence issued pursuant to The Captive Wildlife Regulations to a person operating a zoo, is deemed to be a zoo licence or a travelling zoo licence, as the case may be, issued pursuant to these regulations and may be dealt with pursuant to these regulations as if issued pursuant to these regulations; (ii) in the case of a captive wildlife licence issued pursuant to The Captive Wildlife Regulations to a person holding raptors for falconry, commercial breeding or bird abatement, is deemed to be a falconry licence issued pursuant to these regulations and may be dealt with pursuant to these regulations as if issued pursuant to these regulations; (iii) in the case of a captive game bird farm licence issued pursuant to The Captive Wildlife Regulations to a person holding native upland game birds, is deemed to be a captive upland game bird licence issued pursuant to these regulations and may be dealt with pursuant to these regulations as if issued pursuant to these regulations; 27 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 (iv) in the case of any other captive wildlife licence issued pursuant to The Captive Wildlife Regulations, is deemed to be a captive wildlife licence issued pursuant to these regulations and may be dealt with pursuant to these regulations as if issued pursuant to these regulations. (2) If a licence issued pursuant to The Captive Wildlife Regulations contains provisions that are expressly inconsistent with any provision of these regulations, those provisions are void to the extent that they are inconsistent with these regulations. 4 Jne 2021 c W-13.12 Reg 5 s53. Transitional – unlisted species 54(1) A person who holds wildlife in captivity that is an unlisted species and who does not hold a captive wildlife licence for that wildlife shall, no later than November 30, 2021, notify the minister in the manner specified by the minister of the wildlife that is being held in captivity. (2) A person mentioned in subsection (1) must provide to the minister evidence satisfactory to the minister that the wildlife mentioned in subsection (1) was held in captivity in Saskatchewan before the date on which these regulations came into force. (3) If the minister is satisfied that subsection (2) applies and subject to subsection (4), the minister may allow the person who holds the wildlife in captivity to continue to hold the wildlife mentioned in subsection (1) during the time in which the minister makes a determination respecting: (a) whether the unlisted species is to be designated as an allowed species or as a restricted species; and (b) if the species is designated as a restricted species, whether the species is to be listed in Division 1 of Table 2 of the Appendix or Division 2 of Table 2 of the Appendix. (4) No person who holds wildlife in captivity that is an unlisted species shall continue to hold that wildlife in captivity if the wildlife poses an imminent risk to public health or safety. (5) After taking into consideration the factors set out in subsection 4(2), the minister may make a determination to: (a) designate the species as an allowed species and add the species to the allowed list; or (b) designate the species as a restricted species and add the species to the restricted list. (6) After making a determination pursuant to subsection (5), the minister shall notify the person who holds the wildlife in captivity of the decision in writing and, in the case of a decision pursuant to clause (5)(b), provide reasons for the decision. 28 W-13.12 REG 5 CAPTIVE WILDLIFE, 2021 (7) If the minister designates the species as a restricted species, after receiving the notice mentioned in subsection (6), the person who holds the wildlife in captivity shall: (a) in the case of a species listed in Division 1 of Table 2 of the Appendix, dispose of the wildlife in accordance with section 27 within the period that is determined by the minister; or (b) in the case of a species listed in Division 2 of Table 2 of the Appendix, at the option of the person: (i) continue to hold the wildlife; or (ii) dispose of the wildlife in accordance with section 27. 4 Jne 2021 c W-13.12 Reg 5 s54. Transitional – restricted species 55(1) A person who holds wildlife in captivity that is a restricted species and who does not hold a captive wildlife licence for that wildlife shall, no later than November 30, 2021, notify the minister in the manner specified by the minister of the wildlife that is being held in captivity. (2) A person mentioned in subsection (1) who wishes to continue to hold the wildlife mentioned in subsection (1) in captivity must provide to the minister evidence satisfactory to the minister for the purposes of determining if the wildlife mentioned in subsection (1): (a) is a restricted species that is listed in Division 2 of Table 2 of the Appendix; and (b) was held in captivity by that person in Saskatchewan before the date on which these regulations came into force. (3) If the minister determines that the wildlife mentioned in subsection (1) is a species listed in Division 2 of Table 2 of the Appendix and if the minister is satisfied that clause (2)(b) applies, the minister shall: (a) notify the person who holds the wildlife of the decision in writing; and (b) order that the person who holds the wildlife may continue to hold the wildlife in captivity, subject to any terms and conditions that the minister may impose. (4) If the minister determines that the wildlife mentioned in subsection (1) is a species listed in Division 1 of Table 2 of the Appendix, the minister shall: (a) notify the person who holds the wildlife of the decision in writing along with reasons; and (b) order the person who holds the wildlife to dispose of the wildlife in accordance with section 27 within the period that is determined by the minister. 4 Jne 2021 c W-13.12 Reg 5 s55. 29 CAPTIVE WILDLIFE, 2021 W-13.12 REG 5 Failure to notify the ministry 56(1) If a person fails to notify the minister on or before November 30, 2021 that the person holds wildlife in captivity that is an unlisted species or a restricted species: (a) the person is not allowed to continue to hold that wildlife in captivity; and (b) the wildlife being held in captivity may be seized and disposed of in a manner that the minister considers appropriate. (2) The person holding in captivity the wildlife mentioned in subsection (1) is responsible for any costs incurred by the minister in seizing and disposing of the wildlife. 4 Jne 2021 c W-13.12 Reg 5 s56. Transitional – temporary captive wildlife licence ‑ seized wildlife 57 Subject to any terms and conditions that the minister considers appropriate, the minister may issue a temporary captive wildlife licence, for any of the purposes for which a captive wildlife licence may be issued, to a person to temporarily hold wildlife if: (a) the wildlife has been seized pursuant to section 56; or (b) the minister: (i) is notified, no later than November 30, 2021, concerning an unlisted species or a restricted species held in captivity; (ii) is satisfied that exceptional circumstances exist; and (iii) considers it in the interest of public health and public safety to do so. 4 Jne 2021 c W-13.12 Reg 5 s57.
