These regulations define business identifiers and business information, allow the minister to obtain and disclose that information for assigning identifiers, and permit certain filings without a handwritten signature.
1 COMMON BUSINESS IDENTIFIERS C-16.002 REG 1 The Common Business Identifiers Regulations being Chapter C-16.002 Reg 1 (effective October 19, 2013) as amended by Saskatchewan Regulations 91/2015, 52/2018, 70/2020 and 127/2023. NOTE: This consolidation is not official. Amendments have been incorporated for convenience of reference and the original statutes and regulations should be consulted for all purposes of interpretation and application of the law. Interpretation 2 In these regulations: (a) “Act” means The Common Business Identifiers Act; (b) “business number” means a number assigned to a business by the Canada Customs and Revenue Agency for federal programs; (c) “program account number” means a number, consisting of the business number and an alphanumeric identifier, assigned to a business entity, that is used by the minister in administering a program pursuant to a designated enactment. 25 Oct 2013 cC-16.002 Reg 1 s2. Designated business information 3 For the purposes of subclause 2(b)(xiii) of the Act, the following information, as applicable in relation to a business entity’s legal structure and associated filing requirements pursuant to a designated enactment, is business information: (a) the date of its registration; (b) its registered address; (c) the mailing addresses of its directors; (d) the name of its sole proprietor; (e) the telephone numbers of the partners mentioned in subclause 2(b)(xii) of the Act; (f) the name and telephone number of its authorized representative; (g) a description of the business it carries on; (h) the jurisdiction pursuant to whose law it is registered and its entity number or similar identifying number in that jurisdiction; (i) its entity number in Saskatchewan if it is registered in a jurisdiction other than Saskatchewan; 4 C-16.002 REG 1 COMMON BUSINESS IDENTIFIERS (j) notice that it: (i) is continued in Saskatchewan pursuant to the laws of another jurisdiction; (ii) is amalgamated or was part of an amalgamation; (iii) has a receiver or receiver-manager appointed; (iv) has a liquidator appointed; (k) if it has changed its name: (i) its new name; and (ii) the date of its name change. 25 Oct 2013 cC-16.002 Reg 1 s3. Designated enactments 4 For the purposes of clause 2(e) of the Act, the designated enactments are set out in Table 1 of the Appendix. 25 Oct 2013 cC-16.002 Reg 1 s4. Adoption of system of common business identifiers 5 The numbering system used by the Minister of National Revenue for the purposes of the definition of “business number” in the Income Tax Act (Canada) is adopted as the system of common business identifiers for identifying business entities for the purposes of section 4 of the Act. 25 Oct 2013 cC-16.002 Reg 1 s5. Collection and disclosure of information 6(1) For the purpose of assigning a common business identifier to a business entity, the minister may obtain from the business entity and disclose to the Minister of National Revenue the business entity’s business information in accordance with an agreement entered into pursuant to subsection 4(2) of the Act. (2) The authority to disclose information pursuant to subsection (1) applies notwithstanding any provision of any enactment restricting or prohibiting the disclosure of information. 25 Oct 2013 cC-16.002 Reg 1 s6 Prescribed date 7 The prescribed date for the purposes of subsection 6(2) of the Act is October 19, 2013. 25 Oct 2013 cC-16.002 Reg 1 s7. 5 COMMON BUSINESS IDENTIFIERS C-16.002 REG 1 Filing information, documents or forms requiring signatures 8(1) Any forms that business entities are required to file pursuant to these regulations that are required to be signed may be filed without signatures if: (a) the minister has established a procedure satisfactory to the minister to ensure the forms accurately represent the information contained on a signed version of the form; or (b) in the circumstances the minister considers it appropriate to accept the filing without signature. (2) Any information, forms or documents that are required to be signed by a person for filing with the minister pursuant to these regulations may be filed with the minister if signed: (a) by electronic signature in a manner approved by the minister; or (b) by electronically transmitted or reproduced signature. 25 Oct 2013 cC-16.001 Reg 1 s8. Coming into force 9(1) Subject to subsection (2), these regulations come into force on October 19, 2013. (2) If these regulations are filed with the Registrar of Regulations after October 19, 2013, these regulations come into force on the day on which they are filed with the Registrar of Regulations. 25
