1 WEED CONTROL W-11.1 REG 1 The Weed Control Regulations being Chapter W-11.1 Reg 1 (effective December 1, 2010). NOTE: This consolidation is not official. Interpretation 2 In these regulations, “Act” means The Weed Control Act. 26 Nov 2010 cW-11.1 Reg 1 s2. Definition of domestic animal 3 For the purposes of clause 2(1)(g) of the Act, “domestic animal” means any animal, bird, reptile, amphibian or fish that is under the care of a person. 26 Nov 2010 cW-11.1 Reg 1 s3. Definition of machine 4(1) In this section, “emergency vehicle” means an emergency vehicle as defined in The Vehicle Equipment Regulations, 1987. (2) For the purposes of clause 2(1)(n) of the Act, “machine”: (a) includes: (i) a vehicle as defined in The Traffic Safety Act; (ii) a conveyance, an aircraft, a boat or other watercraft; and (iii) any accessory attached to a vehicle, conveyance, aircraft, boat or other watercraft mentioned in subclause (i) or (ii); and (b) does not include any emergency vehicle. 26 Nov 2010 cW-11.1 Reg 1 s4. Form of agreement 5 Every agreement entered into pursuant to subsection 20(1) of the Act is to be in Form A of the Appendix. 26 Nov 2010 cW-11.1 Reg 1 s5. 4 W-11.1 REG 1 WEED CONTROL Form of order 6 Every order issued pursuant to section 21, 23, 26, 29 or 31 of the Act is to be in Form B of the Appendix. 26 Nov 2010 cW-11.1 Reg 1 s6. Recovery from owner or occupant – maximum amount 7 The maximum amount that may be recovered by a municipality from the owner or occupant of the land pursuant to subsection 37(2) of the Act is: (a) if the area of the land is 0.25 hectares or less, $400; and (b) if the area of the land is greater than 0.25 hectares, $1250 per hectare or part of a hectare to a maximum of $10,000 per quarter section of land. 26 Nov 2010 cW-11.1 Reg 1 s7. Deposit on appeal 8 A notice of appeal pursuant to section 34 of the Act must be accompanied by a deposit in the amount of $550. 26 Nov 2010 cW-11.1 Reg 1 s8. Service by courier 9(1) In addition to the means of service described in section 41 of the Act, any document required by the Act or the regulations to be given or served may be delivered by courier to the last known address of the person being served. (2) A document served by courier is deemed to have been received on the second business day following the day it was delivered by the courier, unless the person to whom it was sent establishes that, through no fault of that person, he or she did not receive the document or that he or she received it at a later date. 26 Nov 2010 cW-11.1 Reg 1 s9.
