1 ALL TERRAIN VEHICLES A-18.02 REG 1 The All Terrain Vehicles Regulations being Chapter A-18.02 Reg 1 (effective August 1, 1988) as amended by Saskatchewan Regulations 27/2012. NOTE: This consolidation is not official. Interpretation 2 In these regulations: (a) “Act” means The All Terrain Vehicles Act; (b) “CSA” means Canadian Standards Association; (c) “DOT” means the Department of Transportation of the United States of America. 15 Jly 88 cA-18.02 Reg 1 s2. Type and manner of placing signs 3 Signs to mark the untravelled portion of provincial highways and other highways or any portion thereof on which the operation of any all terrain vehicle or class or classes of all terrain vehicles is prohibited shall be: (a) not less than 60 centimetres by 60 centimetres in size; (b) erected at a distance of not less than two metres from the ground; (c) white in colour with words in black letters clearly indicating the: (i) all terrain vehicles; or (ii) the class or classes of all terrain vehicles that are prohibited from being operated on the provincial highway or other highway, or portion thereof; and clearly indicating that the operation of those all terrain vehicles on those highways or portions thereof is prohibited; (d) of a sufficient number to reasonably give notice of the prohibition against the operation of all terrain vehicles on the highways or portions concerned. 15 Jly 88 cA-18.02 Reg 1 s3. Amount prescribed for insurance liability 4 The amount prescribed for the purpose of section 14 of the Act is $200,000. 15 Jly 88 cA-18.02 Reg 1 s4. 4 A-18.02 REG 1 ALL TERRAIN VEHICLES Helmets prescribed 5(1) Subject to subsections (1.1) to (2), for the purposes of subsection 18(1) of the Act, every operator of, and every passenger on, an all terrain vehicle shall wear a helmet that is designed for an operator of an all terrain vehicle and that: (a) meets the standards in effect at the time the helmet was manufactured as established by one or more of the following organizations and that bears a label to indicate compliance with those standards: (i) American Motorcycle Association; (ii) American National Standards Institute Z90.1; (iii) British Standards Institution; (iv) CSA; (v) DOT; (vi) Snell Memorial Foundation; (vii) Economic Commission for Europe (ECE); and (b) is in a condition to provide the protection it was manufactured to provide. (1.1) The administrator may approve a helmet for use on an all terrain vehicle that does not meet the requirements of clause (1)(a) if the administrator is satisfied that the helmet is safe and that it is not contrary to the public interest to do so. (1.2) For the purposes of subsection 18(1) of the Act, every operator of and passenger on an all terrain vehicle shall wear the helmet mentioned in subsection (1) by securely fastening it on his or her head by means of the straps and fasteners provided by the manufacturer. (2) A helmet manufactured for use in any industry which helmet meets the conditions set out in subsection (1) is prescribed for the purposes of subsection 18(1) of the Act. 15 Jly 88 cA-18.02 Reg 1 s5; 18 May 2012 SR 27/2012 s2. Eye protection prescribed 6(1) Subject to subsection (2), the following eye protection is prescribed for the purposes of subsection 18(1) of the Act, being any type of goggles or device that is capable of protecting the eyes while being worn by a person operating or who is a passenger on an all terrain vehicle and which goggles or device: (a) is constructed of transparent, shatterproof material and is in such condition that it affords the wearer an unimpaired and clear vision; and (b) is not tinted with any coloured substance if used between sunset of one day and sunrise of the next day. (2) Where an all terrain vehicle is equipped with a face or body screen or shield that meets the conditions set out in subsection (1), that face or body screen or shield is prescribed for the purposes of subsection 18(1) of the Act. 15 Jly 88 cA-18.02 Reg 1 s6.
