Definitions 2 In these regulations: “apprentice” means an apprentice as defined in The Apprenticeship and Trade Certification Act, 2019; “apprenticeship training allowance” means a living away from home allowance, a living allowance, or both, paid to apprentices in accordance with these regulations; “apprenticeship training program” means a technical training program pursuant to The Apprenticeship and Trade Certification Act, 2019 or the regulations pursuant to that Act; “approved”means approved by the minister; “commission” means the Saskatchewan Apprenticeship and Trade Certification Commission continued pursuant to The Apprenticeship and Trade Certification Act, 2019; “Crown” means the Crown in right of Saskatchewan; “dependent child” means a person who: (a) is the child of the apprentice or the apprentice’s spouse; (b) resides with the apprentice or the apprentice’s spouse; and (c) has a gross income of not more than $280 per week; “dependent spouse” means a person who: (a) either: (i) is the legal spouse of the apprentice; or (ii) has cohabited with the apprentice: (A) continuously for a period of at least 1 year and has represented themselves as the apprentice’s spouse; or (B) in a relationship of some permanence, if that person and the apprentice are the parents of a child; and (b) has a gross income of not more than $280 per week; 4 APPRENTICESHIP E-13.1 REG 30 TRAINING ALLOWANCE “EI client” means an EI Client as defined in the Canada-Saskatchewan Labour Market Development Agreement entered into on or about February 6, 1988 by the Government of Canada and the Government of Saskatchewan, as amended from time to time; “minister” means the member of the Executive Council to whom for the time being the administration of these regulations is assigned; “ministry” means the ministry over which the minister presides; “record” includes any information that is recorded or stored in any medium or by means of any device, including a computer and its hard drive or any electronic media; “social insurance number” means a social insurance number assigned to a person pursuant to the authority of an Act of the Parliament of Canada. 12 Sep 2025 cE-13.1 Reg 30 s2. PART 2 Apprenticeship Training Allowance DIVISION 1 Eligibility Living away from home allowance 3 To be eligible to receive a living away from home allowance, a person must: (a) be an apprentice; (b) have a valid social insurance number; (c) be legally entitled to work in Saskatchewan; (d) be enrolled in an approved apprenticeship training program; (e) be eligible to receive employment insurance pursuant to the Employment Insurance Act (Canada) or be an EI client; and (f) maintain a second residence that is located 50 kilometres or more from the apprentice’s primary residence. 12 Sep 2025 cE-13.1 Reg 30 s3. Living allowance 4 To be eligible to receive a living allowance, a person must: (a) be an apprentice; (b) have a valid social insurance number; (c) be legally entitled to work in Saskatchewan; (d) be enrolled in an approved apprenticeship training program; and 5 APPRENTICESHIP TRAINING ALLOWANCE E-13.1 REG 30 (e) have received employment insurance pursuant to the Employment Insurance Act (Canada) within the previous 60 months or, at the date of application, be ineligible to receive employment insurance. 12 Sep 2025 cE-13.1 Reg 30 s4. Out-of-province programs 5 For the purposes of these regulations, the minister may approve an apprenticeship training program that is offered outside Saskatchewan if an equivalent program is not available in Saskatchewan. 12 Sep 2025 cE-13.1 Reg 30 s5. Ineligibility re allowance 6 The minister may deny an apprenticeship training allowance to a person who has an outstanding overpayment for an apprenticeship training allowance. 12 Sep 2025 cE-13.1 Reg 30 s6. DIVISION 2 Application Application 7 An apprentice may apply to the minister for an apprenticeship training allowance if the apprentice: (a) meets the eligibility requirements set out in section 3 or 4, or both, as the case may be; and (b) submits the following to the minister within the period specified by the minister: (i) an application in the form and manner specified by the minister; (ii) any authorization or acknowledgement that the minister may require; (iii) any release for information or records that the minister may require; (iv) in the case of an apprentice applying for a living away from home allowance, the address of the second residence mentioned in clause 3(f); (v) any other information or record that the minister may reasonably require. 12 Sep 2025 cE-13.1 Reg 30 s7. 6 APPRENTICESHIP E-13.1 REG 30 TRAINING ALLOWANCE DIVISION 3 Payments Payment 8(1) On receipt of an application pursuant to section 7 and subject to sections 9 and 10, the minister may authorize the payment of an apprenticeship training allowance to an apprentice if the apprentice meets the requirements set out in section 3 or 4, or both, as the case may be. (2) The total of the periods for which an apprenticeship training allowance may be paid is not to exceed 36 months during the lifetime of the person to whom the apprenticeship training allowance is being paid. (3) An apprenticeship training allowance is to be paid every 2 weeks. 12 Sep 2025 cE-13.1 Reg 30 s8. Living away from home allowance re amount 9 The amount of a living away from home allowance to be paid to an eligible apprentice is: (a) $250 per week in the case of an apprentice whose principal residence or whose secondary residence for the purpose of attending an apprenticeship training program is located in the Northern Saskatchewan Administration District; and (b) $200 per week in any other case. 12 Sep 2025 cE-13.1 Reg 30 s9. Living allowance re amount 10 The amount of a living allowance to be paid to an eligible apprentice is: (a) $196 per week if the apprentice has no dependants; (b) $232 per week if the apprentice has 1 dependant (dependent child or dependent spouse); (c) $246 per week if the apprentice has 2 dependants (dependent children or dependent spouse); (d) $259 per week if the apprentice has 3 dependants (dependent children or dependent spouse); and (e) $347 per week if the apprentice has 4 or more dependants (dependent children or dependent spouse). 12 Sep 2025 cE-13.1 Reg 30 s10. 7 APPRENTICESHIP TRAINING ALLOWANCE E-13.1 REG 30 Change in circumstances 11(1) No person who is receiving an apprenticeship training allowance shall fail to immediately notify the minister of any change in circumstances that might affect: (a) the person’s continued eligibility to receive an apprenticeship training allowance; or (b) the amount of the person’s apprenticeship training allowance. (2) The minister, on being notified that there has been a change in a person’s circumstances, may vary the amount of or cancel the person’s apprenticeship training allowance. (3) If a person fails to comply with subsection (1), the minister may: (a) vary the amount of or cancel the person’s apprenticeship training allowance; and (b) declare any apprenticeship training allowance, or any portion of an apprenticeship training allowance, paid after the date of the change in circumstances to be an overpayment. 12 Sep 2025 cE-13.1 Reg 30 s11. PART 3 Administrative Matters Agreements with commission 12(1) The minister may enter into an agreement with the commission to have the commission or its employees do all or any of the following: (a) receive applications for apprenticeship training allowances; (b) verify the information that is provided on applications for apprenticeship training allowances; (c) hold funds to be paid as apprenticeship training allowances in trust for the Crown; (d) pay apprenticeship training allowances on behalf of the Crown from the funds mentioned in clause (c); (e) report to the minister within the times and in the manner required by the minister respecting apprenticeship training allowances paid by the commission on behalf of the Crown pursuant to clause (d). (2) In an agreement mentioned in subsection (1), the minister may delegate to the commission or its employees the exercise of the minister’s discretion with respect to applications for apprenticeship training allowances, on a case-by-case basis, within the parameters set out in these regulations respecting: (a) the criteria to be applied when assessing applications for apprenticeship training allowances; and (b) the amount and duration of apprenticeship training allowances. 12 Sep 2025 cE-13.1 Reg 30 s12. 8 APPRENTICESHIP E-13.1 REG 30 TRAINING ALLOWANCE Limits on funding 13 The minister may limit funding in any area or region of Saskatchewan. 12 Sep 2025 cE-13.1 Reg 30 s13. Personal financial assistance limit 14 The minister has the right to limit the total amount of financial assistance paid to a person pursuant to these regulations. 12 Sep 2025 cE-13.1 Reg 30 s14. Prohibitions 15(1) No person shall make a representation on an application for an apprenticeship training allowance that the person knows to be false or misleading. (2) No person shall make a declaration or acknowledgement on an application for an apprenticeship training allowance that the person knows is false or misleading due to the non-disclosure of any fact. (3) No person shall, without reasonable excuse, fail to attend, fail to carry out or fail to complete an apprenticeship training program for which the person receives an apprenticeship training allowance. 12 Sep 2025 cE-13.1 Reg 30 s15. Audit 16 A person receiving an apprenticeship training allowance shall provide, at the minister’s request, any information or record that the minister reasonably requires respecting the person’s application and eligibility for an apprenticeship training allowance. 12 Sep 2025 cE-13.1 Reg 30 s16. Overpayment 17(1) If a person receiving an apprenticeship training allowance contravenes any provision of these regulations, the minister may declare all or any part of a payment received by the person pursuant to these regulations to be an overpayment. (2) If a person fails to complete an apprenticeship training program for which an apprenticeship training allowance is paid, the minister may declare that all or any part of a payment received by the person pursuant to these regulations for the week in which the person ceased to continue in the program and for any subsequent weeks to be overpayments. (3) An overpayment made to a person receiving an apprenticeship training allowance is a debt due and owing to the Crown and may be recovered from the person in any manner authorized by The Financial Administration Act, 1993 or in any other manner authorized by law. 12 Sep 2025 cE-13.1 Reg 30 s17. 9 APPRENTICESHIP TRAINING ALLOWANCE E-13.1 REG 30 PART 4 Repeal, Transitional and Coming into Force RRS c G-5.1 Reg 85 repealed 18 The Skills Training Benefit Regulations are repealed. 12 Sep 2025 cE-13.1 Reg 30 s18. Transitional 19(1) In this section: “former regulations” means The Skills Training Benefit Regulations as those regulations existed on the day before the coming into force of these regulations; “living allowance” means, with any necessary modification, a living allowance within the meaning of Part III.1 of the former regulations; “living away from home allowance” means, with any necessary modification, a living away from home allowance within the meaning of Part III.1 of the former regulations. (2) Notwithstanding the repeal of the former regulations, the former regulations continue to apply to every living away from home allowance or living allowance that was approved pursuant to the former regulations but not paid out in full by the minister before the coming into force of these regulations. (3) Every application for a living away from home allowance or a living allowance made pursuant to the former regulations but not considered by the minister before the coming into force of these regulations is continued and shall be dealt with pursuant to these regulations as if the application were made pursuant to these regulations. (4) Every agreement that was entered into pursuant to the former regulations and that was in force immediately before the coming into force of these regulations continues in force and shall be dealt with pursuant to these regulations as if the agreement were entered into pursuant to these regulations. 12 Sep 2025 cE-13.1 Reg 30 s19.
