1 INTERPERSONAL VIOLENCE DISCLOSURE PROTOCOL (CLARE’S LAW) I-10.4 REG 1 The Interpersonal Violence Disclosure Protocol (Clare’s Law) Regulations being Chapter I-10.4 Reg 1 (effective June 29, 2020). NOTE: This consolidation is not official. Amendments have been incorporated for convenience of reference and the original statutes and regulations should be consulted for all purposes of interpretation and application of the law. Definition 2 In these regulations, “Act” means The Interpersonal Violence Disclosure Protocol (Clare’s Law) Act. 13 Dec 2019 c I-10.4 Reg 1 s2. Applicants prescribed 3 For the purposes of clause (b) of the definition of “applicant” in section 2 of the Act, the parent or guardian of an individual under the age of 18 who makes an application on behalf of that individual is a prescribed individual. 13 Dec 2019 c I-10.4 Reg 1 s3. Disclosure information prescribed 4 For the purposes of the definition of “disclosure information” in section 2 of the Act, risk identification information provided to an applicant or a person at risk by a local police service in accordance with the Interpersonal Violence Disclosure Protocol is prescribed information. 13 Dec 2019 c I-10.4 Reg 1 s4. Prescribed persons at risk 5 For the purposes of the definition of “person at risk” in section 2 of the Act, the following are prescribed individuals: (a) an individual who has been determined by a local police service to be at risk of interpersonal violence; (b) the parent or guardian of an individual described in clause (a), if that individual: (i) is under the age of 18; or (ii) lacks capacity. 13 Dec 2019 c I-10.4 Reg 1 s5. Application on behalf of an applicant 6 For the purposes of clause 3(2)(b) of the Act, the following persons are a prescribed class of persons who may make an application on behalf of an applicant: (a) the parent or guardian of an applicant if that applicant lacks capacity; (b) an individual with a close personal connection to the applicant. 13 Dec 2019 c I-10.4 Reg 1 s6. 4 INTERPERSONAL VIOLENCE I-10.4 REG 1 DISCLOSURE PROTOCOL (CLARE’S LAW) Protocol adopted 7(1) For the purposes of clause 9(2)(a) of the Act, the Saskatchewan Association of Chiefs of Police document titled “Interpersonal Violence Disclosure Protocol”, dated November 25, 2019 is adopted, as amended from time to time. (2) The minister may cause the Interpersonal Violence Disclosure Protocol to be made public in any manner the minister considers appropriate, including publishing it on the ministry’s website. 13 Dec 2019 c I-10.4 Reg 1 s7. Coming into force 8(1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Interpersonal Violence Disclosure Protocol (Clare’s Law) Act comes into force. (2) If these regulations are filed with the Registrar of Regulations after the day on which section 1 of The Interpersonal Violence Disclosure Protocol (Clare’s Law) Act comes into force, these regulations come into force on the day on which they are filed with the Registrar of Regulations. 13 Dec 2019 c I-10.4 Reg 1 s8.
