Minister of Community Services/Ministre des Services aux collectivités R-CEMA-20-10 (Leases and Approvals) E06-F03-FIN 2020/24 CIVIL EMERGENCY MEASURES ACT CIVIL EMERGENCY MEASURES LEASES, APPROVALS AND REGULATORY TIMELINES (COVID-19) ORDER Whereas a state of emergency throughout the whole of Yukon was declared on March 27, 2020 because of the COVID-19 pandemic; Whereas subsection 9(1) of the Civil Emergency Measures Act provides that I may do all things considered advisable for the purpose of dealing with this emergency; Whereas the pandemic and the measures taken in response to the pandemic may affect the ability of persons to seek renewals or extensions of leases and approvals issued under Yukon law or for governments or government bodies to renew or extend leases or approvals; Whereas the pandemic and the measures taken in response to the pandemic may affect the ability of persons, governments or government bodies to adhere to regulatory timelines; And whereas I consider the following measures advisable for dealing with the emergency; I hereby order: Interpretation 1 In this Order “approval” means a licence, permit, certificate, or other form of authorization issued under a Yukon law; « autorisation » “state of emergency” means the state of emergency relating to the COVID-19 pandemic declared on March 27, 2020 by Order-in-Council 2020/61 and includes any extension of that state of emergency. « état d’urgence » Renewals and extension of leases and approvals 2(1) A deputy minister may renew or extend the term of a lease or approval, or leases or approvals in a class of leases or approvals, that was or were issued or granted by the deputy minister’s department and would otherwise expire during the state of emergency or during the 90- day period immediately after the termination of the state of emergency, so long as the renewal or extension is for a period of not more than 90 days after the end of the original term, as specified in the renewal or extension. (2) If a deputy minster renews or extends a term under subsection (1) and a further renewal or extension of the term after the renewal or extension that was the subject of the renewal or extension under subsection (1) is ordinarily calculated from the end of the term that was renewed or extended under subsection (1), the further renewal or extension is to be calculated from the end of the original term as if the renewal or extension under subsection (1) had not occurred. (3) A deputy minister may renew or extend a term under subsection (1) only if satisfied that to do so is advisable in light of the state of emergency and is appropriate in the circumstances. R-CEMA-20-10 (Leases and Approvals) E06-F03-FIN 2 2020/24 (4) A renewal or extension under subsection (1) must (a) be personally signed by the deputy minister; (b) be posted on an internet website maintained by or for the deputy minister’s department or the Government of Yukon promptly after it is made; (c) in the case of a renewal or extension respecting leases or approvals in a class of leases or approvals, be posted in a place specified by the deputy minister promptly after it is made; and (d) in the case of a renewal or extension respecting a specific lease or approval, be promptly provided to the lessee or holder of the approval. Suspension of regulatory timelines 3(1) A deputy minister may direct that any time period that is set out in a Yukon law that is administered by the Minister who presides over the deputy minister’s department and that relates to the exercise of a power, duty or function or to the performance of an obligation under that law, is suspended or extended for the duration of the state of emergency and for a period of not more than 90 days after the termination of the state of emergency as specified in the direction. (2) If a deputy minster directs that a time period be suspended or extended under subsection (1) and the time period for a further exercise of the power, duty or function, or the performance of the obligation, after the end of the time period that was directed to be suspended or extended under subsection (1), is ordinarily calculated from the end of the time period that was suspended or extended under subsection (1), the time for that further exercise or performance is to be calculated from the end of the original time period as if the suspension or extension under subsection (1) had not occurred. (3) A deputy minister may make a direction only if satisfied that making the direction is advisable in light of the state of emergency and is appropriate in the circumstances. (4) A deputy minister’s direction must (a) be personally signed by the deputy minister; (b) be posted on an internet website maintained by or for the deputy minister’s department or the Government of Yukon promptly after it is made; and (c) be posted in any other place specified by the deputy minister promptly after it is made.
