About this statute

This Part updates Yukon’s Enduring Power of Attorney Act, adding rules for who can act, how powers work, notice requirements, recordkeeping, court orders, financial institution responses, and an offence for false reports. The Minister may create a registry for enduring powers of attorney if regulations allow it; those regulations cannot generally allow disclosure of registry documents or information except to the donor, the attorney, or someone authorized in writing. The Commissioner in Executive Council may make regulations for the Act. The Public Guardian and Trustee may investigate certain adults’ financial affairs, and some actions against investigators or the Public Guardian and Trustee are barred unless bad faith or malicious conduct is shown.
