Certain hog producers in Saskatchewan must pay levies of $0.80 per hog marketed for slaughter, and some buyers/operators must deduct and remit those levies to the Commission.
An Order Providing For the Fixing, Imposing and Collecting of Levies From Certain Hog Producers in Saskatchewan This Order may be cited as the Saskatchewan Hog Marketing Levies Order. In this Order, Act means The Natural Products Marketing Act, 1972 of Saskatchewan; (Loi) assembly yard means premises to which producers may deliver their hogs; (parc de groupage) assembly yard operator means the owner or operator of an assembly yard; (exploitant d’un parc de groupage) Commission means the Saskatchewan Hog Marketing Commission established pursuant to the Act and the Plan; (Commission) hog means any member of the species Sus Scrofa L. (domestic pig) produced in Saskatchewan; (porc) Plan means the Saskatchewan Hog Marketing Plan established and amended from time to time pursuant to the Act; (Plan) processor means any person engaged in the business of processing hogs or using hogs in manufacturing; (transformateur) producer means any person engaged in producing or feeding hogs and making them available for slaughter and includes the employer of any such person, any person who, under any lease or agreement, is entitled to a share of the hogs produced or fed by a person referred to in paragraph (a), and any person who takes possession of any hogs from any person under any form of security for a debt; (producteur) small processor means a processor who, in the previous calendar year, processed less than two per cent of all hogs slaughtered in Saskatchewan according to the reports published by the Department of Agriculture of Canada. (petit transformateur) Subject to section 5, every producer shall pay to the Commission, in addition to the service charges set out under the Plan, levies at the rate of $0.80 per hog marketed for slaughter. The levies payable by a producer shall be deducted from the moneys payable to the producer by the Commission. Every small processor who purchases hogs directly from a producer shall deduct the levies payable in respect of those hogs from the moneys payable to the producer and remit it on a monthly basis to the Commission. Every assembly yard operator who conducts an auction of sows shall deduct the levies payable in respect of those sows from the proceeds payable to the producer and remit it on a monthly basis to the Commission. This Order does not apply to a producer who holds a dispensation certificate issued pursuant to section 8 of the Saskatchewan Hog Marketing (Interprovincial and Export) Regulations; has a hog slaughtered for his own consumption; sells a hog to a consumer for consumption by the consumer; sells a hog to a processor designated by the Commission to provide specific research data; or markets any of the following classes of hogs: breeding stock, weanling pigs, feeder pigs, or boars.
