This Order creates an amnesty period for certain individuals who possess a non-restricted firearm and lack the required registration certificate, allowing them to regularize, deactivate, export, surrender, sell, give away, or temporarily keep the firearm before doing so.
Order Declaring an Amnesty Period (2006) Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to subsection 117.14(1)a of the Criminal Code, hereby makes the annexed Order Declaring an Amnesty Period (2006). S.C. 1995, c. 39, s. 139 The following definitions apply in this Order. non-restricted firearm means a firearm other than a prohibited firearm or a restricted firearm. (arme à feu sans restriction) public service agency has the same meaning as in section 1 of the Public Agents Firearms Regulations. (agence de services publics) The amnesty period set out in subsection (3) is declared under section 117.14 of the Criminal Code for an individual who, at any time during the amnesty period, is in possession of a non-restricted firearm, holds a licence to possess firearms or a licence to possess and acquire firearms but does not hold a registration certificate for the firearm; or is in possession of a non-restricted firearm, does not hold a registration certificate for the firearm and will have held a licence to possess firearms or a licence to possess and acquire firearms that expired during the period beginning on January 1, 2004 and ending on May 16, 2006, or that will have expired during the period beginning on May 17, 2006 and ending on May 16, 2015. The purpose of the amnesty period is to permit the individual to in the case of an individual described in paragraph (1)(a), obtain the registration certificate; in the case of an individual described in paragraph (1)(b), obtain the licence and registration certificate; deactivate the firearm so that it is no longer a firearm; export the firearm in accordance with all applicable legal requirements, including the legal requirements of the country to which the firearm is exported; turn in the firearm to a police officer or a firearms officer for destruction or other disposal; sell or give the firearm to a public service agency, to a business, including a museum, that holds a licence authorizing the acquisition of firearms or to an individual who holds a possession and acquisition licence for firearms; or possess the firearm before doing one of the things described in paragraphs (a) to (f). The amnesty period begins on May 17, 2006 and ends on May 16, 2015. This Order comes into force on the day on which it is registered.
