Prince Albert Airport Zoning Regulations

Regulations Respecting Zoning at Prince Albert Airport Whereas, pursuant to section 4.5 of the Aeronautics Act, a copy of the proposed Zoning regulations respecting Prince Albert Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I on May 16th and 23rd, 1987 and in two successive issues of the Prince Albert Herald on June 29th and July 4th, 1987, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto. Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Prince Albert Airport. These Regulations may be cited as the Prince Albert Airport Zoning Regulations. In these Regulations, airport means the Prince Albert Airport, in the vicinity of the City of Prince Albert, in the Province of Saskatchewan; (aéroport) airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport) approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche) Minister means the Minister of Transport; (ministre) outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure) strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande) transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition) For purposes of these Regulations, the elevation of the airport reference point is 424.9 m above sea level. These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described as follows: the lands within the outer limits of lands described in Part VI of the schedule; and the lands directly under that portion of the approach surfaces that extend beyond the said outer limits. No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point the approach surfaces; the outer surface; or the transitional surfaces. Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth. No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds. The airport reference point shown on Prince Albert Airport Zoning Plan No. E.1939 dated January 21, 1986, is a point located at U.T.M. coordinates, Northing 5896141.162 and Easting 455092.714. The approach surfaces, shown on Prince Albert Airport Zoning Plan No. E.1939 dated January 21, 1986, are surfaces abutting each end of the strips associated with the runways designated 08-26 and 16-34 and are described as follows: a surface abutting the end of the strip associated with runway approach 08 consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 538 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 530.7 m from the projected centre line; said imaginary horizontal line being 42.3 m above the elevation at the end of the strip; thence continuing along the centre line, an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 291.54 m above the elevation at the end of the strip; a surface abutting the end of the strip associated with runway approach 26 consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 628 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 544.2 m from the projected centre line; the said imaginary horizontal line being 43.8 m above the elevation at the end of the strip; thence continuing along the centre line, an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 291.24 m above the elevation at the end of the strip; a surface abutting the end of the strip associated with runway approach 16 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295 m from the projected centre line; said imaginary horizontal line being 62.5 m above the elevation at the end of the strip; and a surface abutting the end of the strip associated with runway approach 34 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295 m from the projected centre line; said imaginary horizontal line being 62.5 m above the elevation at the end of the strip. The outer surface, shown on Prince Albert Airport Zoning Plan No. E.1939 dated January 21, 1986 is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground. The strips, shown on Prince Albert Airport Zoning Plan No. E.1939 dated January 21, 1986, are described as follows: the strip associated with runway 08-26 is 300 m in width, 150 m being on each side of the centre line of the runway, and 2 244 m in length; and the strip associated with runway 16-34 is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 122 m in length. The transitional surfaces, shown on Prince Albert Airport Zoning Plan No. E.1939 dated January 21, 1986, are described as follows: the transitional surface associated with runway 08-26 is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip; and the transitional surface associated with runway 16-34 is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 5 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip. The boundary of the outer limits of lands, shown on Prince Albert Airport Zoning Plan No. E.1939, dated January 21, 1986, is described as follows: Commencing at the northwest corner of the south half of Section 30, Township 49, Range 25, West of the 2nd Meridian; thence easterly along the northerly limit of the said half Section 30 to the northeast corner thereof; thence southerly along the easterly limit of said half Section 30 and across the road allowance to the northeast corner of Section 19; thence easterly across the road allowance and along the northerly limit of the northwest quarter Section 20 to the northeast corner thereof; thence southerly along the easterly limit of the west half of Section 20 to an intersection with the northerly Ordinary High Water Mark of the North Saskatchewan River; thence southeasterly to a point being the intersection of the southerly Ordinary High Water Mark of the North Saskatchewan River with the easterly limit of Section 33, Township 48, Range 25, West of the 2nd Meridian; thence southerly along the easterly limit of Section 33 and across the road allowance to the northeast corner of Section 28; thence easterly across the road allowance and along the northerly limit of the west half of Section 27 to the northeast corner thereof;
