Weyburn Airport Zoning Regulations

Regulations Respecting Zoning at Weyburn Airport Whereas, pursuant to section 5.5 of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting Weyburn Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I, on December 15th and 22nd, 1990, and in two successive issues of the Weyburn Review on January 23rd and 30th, 1991, and reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto; Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Weyburn Airport. These Regulations may be cited as the Weyburn Airport Zoning Regulations. In these Regulations, airport means the Weyburn Airport, in the vicinity of Weyburn in the Province of Saskatchewan; (aéroport) airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport) approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche) Minister means the Minister of Transport; (ministre) outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure) strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande) transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition) For the purposes of these Regulations, the elevation of the airport reference point is 586.5 m above sea level. These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule. No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point the approach surfaces; the outer surface; or the transitional surfaces. Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth. No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds. The airport reference point shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is a point located on the centre line of runway 12-30 distant 609.5 m from the threshold of runway 12. The approach surfaces, shown on Weyburn Airport Zoning Plan No. E.2702, dated November 14, 1988, are surfaces abutting each end of the strip associated with the runway designated 12-30, and are described as follows: a surface abutting the end of the strip associated with runway approach 12 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295.0 m from the projected centre line; said imaginary horizontal line being 83.3 m above the elevation at the end of the strip; and a surface abutting the end of the strip associated with runway approach 30 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295.0 m from the projected centre line; said imaginary horizontal line being 83.3 m above the elevation at the end of the strip. The outer surface, shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground. The strip associated with runway 12-30 shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 339 m in length. Each transitional surface, shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface. The boundary of the outer limits of lands, shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is described as follows: COMMENCING at the northeast corner of the southeast quarter Section 13, Township 9, Range 14, West of the Second Meridian; THENCE southerly along the easterly limit of said southeast quarter Section 13 and across the intervening road allowance to the northeast corner of Section 12; THENCE easterly across the intervening road allowance and along the northerly limit of the northwest quarter Section 7, Township 9, Range 13, West of the Second Meridian to the northeast corner of the northwest quarter Section 7; THENCE southerly along the easterly limit of the northwest quarter of Section 7, to the southeast corner of the northwest quarter Section 7; THENCE easterly along the northerly limit of the southeast quarter Section 7 to the northeast corner of the southeast quarter Section 7; THENCE southerly along the easterly limits of the southeast quarter of Section 7, Section 6, Section 31, Township 8, Range 13, West of the Second Meridian, northeast quarter Section 30 and across the intervening road allowance to the southeast corner of the northeast quarter Section 30; THENCE westerly along the northerly limit of Registered Plan F.U. 895, across the intervening road allowance to an intersection with the easterly limit of Section 25, Township 8, Range 14, West of the Second Meridian; THENCE southerly across Registered Plan F.U. 895 and along the easterly limit of the northeast quarter Section 24 to the southeast corner of the northeast quarter Section 24; THENCE westerly along the southerly limits of the north halves of Sections 24, 23, the northeast quarter of Section 22 and across the intervening road allowance to the southwest corner of the northeast quarter Section 22;
