Exclusion Approval Order for certain persons and certain positions (Air Traffic Control Group), 1991

Order Approving the Exclusion by the Public Service Commission from the Operation of Section 10 and Subsection 21(1) of the Public Service Employment Act of Certain Persons and Positions Whereas the Public Service Commission has decided that it is not practicable nor in the best interests of the Public Service in relation to qualifications other than language skills, to apply section 10 of the Public Service Employment Act to training positions in the Department of Transport to which are to be or are appointed air traffic controllers who participate in the Selection by Seniority Program for operational training or in the Transfer Down Program, in relation to qualifications other than language skills, to apply section 10 of the Public Service Employment Act to operational positions in the Department of Transport to which are to be or are appointed air traffic controllers who have successfully completed their training in the Selection by Seniority Program for operational training or in the Transfer Down Program, to apply subsection 21(1) of the Public Service Employment Act to all persons who, but for this Order, would have a right of appeal under that subsection against the appointment or proposed appointment to training positions in the Department of Transport of certain air traffic controllers who participate in the Selection by Seniority Program for operational training or in the Transfer Down Program, to apply subsection 21(1) of the Public Service Employment Act to all persons who, but for this Order, would have a right of appeal under that subsection against the appointment or proposed appointment to operational positions in the Department of Transport of air traffic controllers who have successfully completed their training in the Selection by Seniority Program for operational training or in the Transfer Down Program, to apply subsection 21(1) of the Public Service Employment Act to all persons who, but for this Order, would have a right of appeal under that subsection against the appointment or proposed appointment to positions in the Department of Transport of air traffic controllers who have not successfully completed or have terminated without completing their training in the Selection by Seniority Program for operational training or in the Transfer Down Program, during the period beginning on May 1, 1991 and ending on December 31, 1996. And Whereas the Public Service Commission, pursuant to subsection 41(1) of the Public Service Employment Act, has decided that certain persons and positions should be excluded from the operation of section 10 and subsection 21(1) of the Public Service Employment Act; Therefore, His Excellency the Governor General in Council, on the recommendation of the Secretary of State, pursuant to subsection 41(1) of the Public Service Employment Act, is pleased hereby to make the annexed Order approving the exclusion by the Public Service Commission from the operation of section 10 and subsection 21(1) of the Public Service Employment Act of certain persons and positions. This Order may be cited as the Exclusion Approval Order for certain persons and certain positions (Air Traffic Control Group), 1991. The exclusion by the Public Service Commission, from the operation of section 10 of the Public Service Employment Act, in relation to qualifications other than language skills, of training positions in the Department of Transport to which are to be or are appointed air traffic controllers who participate in the Selection by Seniority Program for operational training or in the Transfer Down Program, during the period beginning on May 1, 1991 and ending on December 31, 1996, is hereby approved. The exclusion by the Public Service Commission, from the operation of section 10 of the Public Service Employment Act, in relation to qualifications other than language skills, of operational positions in the Department of Transport to which are to be or are appointed air traffic controllers who have successfully completed their training in the Selection by Seniority Program for operational training or in the Transfer Down Program, during the period beginning on May 1, 1991 and ending on December 31, 1996, is hereby approved. The exclusion by the Public Service Commission, from the operation of subsection 21(1) of the Public Service Employment Act, of all persons who, but for this Order, would have a right of appeal under that subsection against the appointment or proposed appointment to training positions in the Department of Transport of certain air traffic controllers who participate in the Selection by Seniority Program for operational training or in the Transfer Down Program, during the period beginning on May 1, 1991 and ending on December 31, 1996, is hereby approved. The exclusion by the Public Service Commission, from the operation of subsection 21(1) of the Public Service Employment Act, of all persons who, but for this Order, would have a right of appeal under that subsection against the appointment or proposed appointment to operational positions in the Department of Transport of air traffic controllers who have successfully completed their training in the Selection by Seniority Program for operational training or in the Transfer Down Program, during the period beginning on May 1, 1991 and ending on December 31, 1996, is hereby approved. The exclusion by the Public Service Commission, from the operation of subsection 21(1) of the Public Service Employment Act, of all persons who, but for this Order, would have a right of appeal under that subsection against the appointment or proposed appointment to positions in the Department of Transport of air traffic controllers who have not successfully completed or have terminated without completing their training in the Selection by Seniority Program for operational training or in the Transfer Down Program during the period beginning on May 1, 1991 and ending on December 31, 1996, is hereby approved.
