This article creates the Multilateral Investment Guarantee Agency and gives it legal personality and power to contract, own or sell property, and sue in court. El Organismo debe seguir este artículo en sus decisiones y puede otorgar garantías, hacer actividades complementarias y ejercer otras facultades para promover inversiones. This article defines key terms used in the Convention, including Member, Recipient Country/Government, Developing Member Country, Special Majority, and Freely Usable Currency. El artículo permite ser miembros del Organismo a los miembros del Banco y a Suiza, y define como miembros fundadores a los Estados del Apéndice A que sean parte del Convenio el 30 de octubre de 1987 o antes.
