About this statute

This provision states that Law 173 of 1994 approves the Hague Convention on the Civil Aspects of International Child Abduction. The Convention’s purpose is to secure the immediate return of children who have been wrongfully moved or kept in a contracting state, and to make custody and visitation rights in one contracting state respected in other contracting states. The Contracting States must take appropriate measures within their territories to apply the Convention’s objectives, and they must use emergency procedures for that purpose. A child’s transfer or non-return is treated as unlawful if it breaches a custody right under the law of the child’s habitual residence and that right was being exercised, or would have been exercised, when the transfer or non-return happened. The Convention applies to a child who was habitually resident in a Contracting State immediately before a visitation-right violation, and it stops applying when the child turns 16.
