This provision is the preamble/title page for Law 200 of 1995, which adopts the disciplinary code. The State, through its branches and organs, is the holder of disciplinary power. La acción disciplinaria corresponde al Estado, con poder disciplinario preferente de la Procuraduría General de la Nación, y las ramas y órganos del Estado conocen de los asuntos disciplinarios contra sus servidores públicos. El Procurador General de la Nación puede asumir asuntos disciplinarios internos mediante decisión motivada, de oficio o a petición de parte, y también debe fijar criterios imparciales y objetivos para seleccionar quejas y expedientes disciplinarios. Public officials and temporary public-function holders are only subject to disciplinary judgment and sanctions when their acts or omissions in performing functions amount to legal breaches.
