About this statute

This law establishes instruments to compensate victims of human rights violations under decisions from certain international human rights bodies. The National Government must pay damages compensation after the procedure in this law is completed. The Committee must give a favorable opinion on compliance with an international human-rights decision when the stated requirements are met, and it has 45 days to issue the opinion. Si el Comité da concepto favorable, el Gobierno Nacional debe pedir la audiencia de conciliación en hasta 30 días; luego el agente del Ministerio Público debe citar a los interesados, trasladar las pruebas y citar a las partes, y se convoca al Defensor del Pueblo. La entidad pública vinculada al servidor público responsable debe acordar y fijar el monto de la indemnización, y solo pueden reconocerse indemnizaciones por perjuicios probados con nexo causal con los hechos.
