About this statute

This provision is the preamble of Law 358 of 1997, which states that the law regulates Article 364 of the Constitution and includes other rules on indebtedness. Territorial entities’ debt may not exceed their ability to pay. Public credit operations must be used only to finance investment spending, with listed exceptions. A territorial entity with debt at or below the stated limit does not need additional debt authorizations. Current income is calculated by deducting certain territorial-entity assets, investments, and income that support valid securitization processes; those processes must be authorized by the Ministry of Finance and Public Credit.
