About this statute
This provision identifies Law 366 of 1997 and states that it regulates the liquidation, withholding, collection, distribution, and transfers of revenues from the exploitation of precious metals. Los compradores, fundidores o procesadores de metales preciosos deben liquidar y retener las rentas legales cuando reciban, adquieran y paguen esos metales. El Gobierno Nacional puede reglamentar cómo se liquidan, retienen, recauda, distribuyen y transfieren las rentas de oro, plata, platino y concentrados polimetálicos para exportación. Los municipios productores de metales preciosos deben llevar un registro de explotaciones y de quienes extraen o comercializan esos metales; además, el municipio puede suspender actividades sin registro. Cada minero o comerciante debe declarar en el formulario de venta la procedencia exacta del material precioso. Las entidades públicas no pueden usar recursos del tesoro para incentivar o beneficiar a explotadores y comerciantes de metales preciosos con el fin de que declaren sobre el origen del mineral.
