This provision identifies Law 389 of 1997 and says it amends articles 1036 and 1046 of the Commercial Code. This provision says insurance is a consensual, bilateral, onerous, aleatory contract with successive execution. If contract terms were not expressly agreed, the contract conditions are those in the policy or annex deposited by the insurer with the Superintendencia Bancaria for the same line, coverage, contract type, and risk type. The insurer must provide the original insurance policy to the policyholder within 15 days of the contract date, and the policy must be written in Spanish and signed by the insurer. La cobertura del seguro de manejo y riesgos financieros, y del seguro de responsabilidad, puede limitarse a ciertos eventos y plazos; el Gobierno Nacional puede extender esta regla a otros ramos de seguros.
