This preamble says the American States signing the convention agree to act to prevent and punish torture. Los Estados Partes deben prevenir y sancionar la tortura conforme a esta Convención. Defines torture as the intentional infliction of physical or mental suffering, or methods that nullify a person's personality or reduce their physical or mental capacity. This article says certain public employees or officials, and people acting at their instigation, are responsible for the crime of torture if they order, instigate, induce, directly commit it, or fail to prevent it when able to do so. Acting under superior orders does not exempt a person from criminal responsibility.
