This preamble identifies Law 619 of 2000, states that it amends Law 141 of 1994, and includes a vigency note that the law was declared unconstitutional with effects deferred until 20 June 2002. If a non-renewable natural resource deposit lies in two or more territorial entities, royalties and compensation are to be distributed proportionally to each entity’s share in the deposit. El Ministerio de Minas y Energía define por resolución qué entidades territoriales participan y en qué proporción; además, ciertos departamentos deben ceder el 10% de regalías y compensaciones en un caso específico del Mar Caribe. When certain nonrenewable resources and derivatives are first transported through a port, maritime, or river municipality, the National Royalties Commission must distribute the resulting royalties and compensation. If non-renewable natural resources are exploited in or near an indigenous reserve, part of the royalties must be used for investment in the communities’ areas; if the reserve is a territorial entity, it may receive and execute the resources directly.
